Law. Part 617. of Title 6 of the New York State Codes. Rules and Regulations.
and Chapter 44 of the Southold Town Code. the Southold Town Trustees. as
Lead Agency. does hereby determine that the action described below is a Type 1
Action and is likely to have a significant effect on the Environment. The applicant
is requested to prepare a Draft Environmental Impact Statement.

Name: John H. Geideman on behalf of the Gardiners Bay Property Owners Association
Location: Foot of Orchard Lane. East Marion.
Description of Action: To construct a bulkhead behind an existing catwalk for
erosion control.
Reasons supporting this determination:
1. In accordance with 97-28 Standards. [A] Apversely affect the wetlands
of the town. Loss of approximately 1.000 sq. ft. of intertidal marsh.

7. No structure may be erected on the "Beach for the Use of Lot Owners"

unpaid for the years prior to January 1, 1975, rèmain the property of

The following action was taken by the Board of Town Trustees during their
regular meeting held on September 24, 1987 regarding the above matter.
RESOLVED that the Southold Town Trustees RESCIND the Negative Environmental
Assessment declared on June 25, 1987 regarding the application of the Gardiners
Bay Property Owners Association and before the Trustees will reclassify the
project they will have to resubmit new plans to include a Licensed Land Survey
showing what is existing on the property and what is proposed.

NOTICE IS HEREBY GIVEN THAT PUBLIC HEARINGS WILL BE HELD BY THE
TOWN TRUSTEES OF THE TOWN OF SOUTHOLD, AT THE SOUTHOLD TOWN HALL,
MAIN ROAD, SOUTHOLD, NEW YORK ON MONDAY, JULY 27, 1987 ON THE FOLLOWING
APPLICATIONS FOR PERMITS UNDER THE PROVISIONS OF THE WETLAND ORDINANCE
OF THE TOVlN OF SOUTHOLD.
7: 40 P. M. In the matter of the application of J. H. Geideman on behalf of the
Gardiners Bay Property Owner's Association to construct a bulkhead 150' to tie in to
an existing bulkhead on the north end. To remove an existing catwalk. Property is locat
on Orchard Lane, East Marion.
Trustee Smith: Are there any comments for or against this application?
Trustee Goubeaud: They came back with another request to amend the application
again because the Association does not want the catwalk removed.
Trustee Bredemeyer: We should, before we move on tþe final vote, vote on the
amendment. The amendment was not offered by the agent, as was previously seen
on the application.
John Geideman: The members of the Association are here and the decision has been
made that the catwalk is on the wrong side of the proposed bulkhead that we are going
to construct. There is no place that will provide a walking area on the canal side of
the bulkhead. With the removal of the bulkhead we are going to construct a ground
walk that will take us above any tide elevation.
Trustee Bredemeyer: For the purpose of clarifying the application, can I ask you a
few questions? Are you saying that the Association wishes to maintain a catwalk?
Mr. Geideman: No, no catwalk.
Trustee Bredemeyer: We saw that you want to construct a bulkhead/retaining wall
landward of the marsh fringe.
Mr. Geideman: Above the high tide line.
Trustee Bredemeyer: For that section that parallel's the existing catwalk, and to rebuild
the attachment to the existing bulkhead.
John Geideman: No attachment to the bulkhead, it will be a ground level walk behind
the bulkhead.
Trustee Bredemeyer: You have an existing bulkhead to the east that it will tie in
to at some point. So the finished project will run to protect all the marsh fringe
and have a walk behind it.
Mr. Geideman: Exactly.
Trustee Krupski: H()_w wide is the proposed walk?
Mr. Geideman: It is very seldem used and it is just there so that we can maintain the
bulkhead that we are putting up.

John Geideman: Just on the land, just an area that will be available for walking along
behind the bulkhead for maintenance, clearing.
Trustee Smith: We have Conservation Advisory Council's approval. Any other Comments?

RESOLVED that the Southold Town Trustees accept the amended plan as requested
for the proposed project on behalf of the Gardiners Bay Property Owners Assoc.
to construct a retaining wall 3' landward of the MHW line to be 135' long and to
tie in to an existing bulkhead and to remove an existing catwalk. Property is
located on Orchard Lane, East Marion. There is to be no dredging associated
with this project. The Trustees will inspect the site on Aug. 19, 1987 before
they make a determination on the application.

This notice is issued pursuant to the prov~s~ons of Article 8
of the Environmental Conservation Law State Environmental Quality
Review and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the
Code of the Town of Southold, notice is hereby given that the Southold
Town Trustees, as lead agency for the action described below has determined
that the project will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency which
may also have an application pending for the same or similar project.
TYPE OF ACTION:
UNLISTED
DESCRIPTION OF ACTION: To construct a bulkhead 150' to tie in to existing
bulkhead on the north end. To remove existing catwalk. There is to be no
filling or dredging.
LOCATION: Orchard Lane, East Marion.
REASONS SUPPORTING THIS DETERMINATION:
1. An environmental assessment form has been submitted which
indicated that there would be no adverse effect to the
environment should the project be implemented as planned.
2. Because there has been no response in the allotted time from
the Southold Town Building Dept. and the New York State D.E.C.
it is assumed that there are no objections nor comments from
those agencies.

The Southold Town Conservation Advisory Council held its regular meeting
June 18, 1987. The following recommendations were made at that meeting:
No. 527 - Mr. and Mrs. John Lang - Recommend approval with the stipula-
tion that applicant does not distub the natural vegetation (spartina
wetland) .
No. 528 - Mr. and Mrs. Alan Watson - Recommend approval.
No. 529 - Hide-A-Way Boat Basin- Recommend approval.
No. 530 - West Lake Association - Recommend approval.
No. 531 - Alexander Koke - Recommend approval of the berm and filling.
No. 532 - Gardiners Bay Property Owners Association - Recommend approval.
No. 533 - Van H. Rieger - Recommend approval.
No. 534 - Peter Fakiris - Recommend approval of the dock but disapprove
of the bulkheading. The CAC suggests applicant extends the
ramp from the base of the dock up further and that would eliminate
the need for the bulkheading. The CAC does not approve of the
bulkhead because there are no other bulkheads in the area and
the bulkhead would create erosion problems.
No. 536 - John C. W. Campbell - Recommend approval with the stipulation that
a 50' natural vegetation buffer be maintained between the house and
bulkheading.
No. 510 - James E. Fitzgerald Jr., Pres., Broadwaters Cove Association, Inc.
Recommend approval.
No. 522 - Michael S. Gillilund - Recommend approval with the stipulation that
it be mandatory that applicant does not disturb the natural
vegetation buffer between the house and bluff.

RESOLVED that the Southold Town Trustees declare itself lead
agency in regard to the State Environmental Quality Review
Act in the matter of the application of J. H. Geideman on behalf of
the Gardiners Bay Property Owners Association
for a Wetland Permit on certain property located
on a private canal to Spring Pond, foot of Old Orchard Lane, East
Marion.

Dear Mr. Geideman:
The following action was taken by the Board of Town Trustees during
their regular meeting held on July 27, 1987 regarding the above referenced
matter.
WHEREAS, J. H. GEIDEMAN ON BEHALF OF THE GARDINERS BAY PROPERTY
OWNERS ASSOCIATION applied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated May 5, 1987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
ívHEREAS, a public hearing was held by the Town Trustees with
respect to said application on July 27, 1987 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in questioü and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE, BE IT
RESOLVED that J. H. GEIDEMAN ON BEHALF OF THE GARDINERS BAY BE AND
HEREBY IS GRANTED PERMISSION UNDER THE
PROVISIONS OF THE WETL,AND ORDINANCE OF THE TOWN OF SOUTHOLD TO:
Construct a retaining wall 3' landward of the MHW line to be constructed 135' long
and to tie in to an existing bulkhead and to remove an existing catwalk. Property
is located on 0 "chard Lane, East Marion. There is to be no dredging associated
with this project.

Gardiners Bay Property Owners Association
This permit will expire on July 27, 1989 if work has
not commenced by said date. There are two inspections required and
the Trustees are to be notified upon the completion of the work.
Prior to the issuance of said permit by the Clerk, the applicant
shall file with the Clerk a certificate that he has public liability
insurance policies insuring against any liability which may arise
in the performance of the operations pursuant to such permit in such
amount as shall be fixed by the Trustees, which said policies shall
name the Town as a name insured. Please take further notice that
this declaration should not be considered a determination made for
any other department or agency which may also have an application
pending for the same or similar project.
PLEASE RETURN TO THE BUILDING DEPT. FOR A DETERMINATION ON
THE NEED OF ANY OTHER TOWN PERMITS THAT MAY BE REQUIRED FOR THIS
PROJECT.
PLEASE REMIT A $10. 00 WETLAND INSPECTION FEE AT THIS TIME.
UPON REMITTANCE YOUR PERMIT WILL BE FORWARDED BY MAIL.

Dear Sirs:
On October 19, 1991, the Board of Directors of Gardiners
Bay Estates Homeowners Association, Inc., resolved to
place a four slip floating dock in Spring Pond, on the
Dogwood Road right of way. The land and the pond-bottom
is fully owned by the Association. It is the widest
Association right of way on the shoreline of the pond
(187'atMW).
We are enclosing, herewith, our applications for the
necessary permits.
Our boat rules do not allow flushing of toilets or
sleeping on boats overnight. 'rhe Marine Committee has
made a determination that "boats with opera table, flush
overboard, marine toilets will not be permitted to dock
or moor in Spring Pond".
We look forward to receiving a favorable review of the
attached permit applications.

Dear Mr. Matzen:
The following is in regards to the subject application
to construct a 3 foot wide by 16 foot long fixed pier dock
elevated a minimum of 4 feet above grade, install a 3 foot
wide by 16 foot long ramp, a 4 foot by 24 foot float with two
3 foot b¥ 14 foot finger floats, and three piles, and to move
an exist1ng pier 12 feet eastward in Spring Pond, Gardiners
Bay, at East Marion, Suffolk County, New York.
We have received your letter dated January 21, 1992 and
the supporting documentation. Based on our previous
experience with the Federal environmental agencies, we
recommend that you extend the ramp as necessary to insure
that a minimum depth of 2 feet at mean low water will be
available to avoid foreseeable objection on this matter in
the future, and to revise the submitted drawings accordingly.
Once we have received such drawings, we will resume
processing your application. If you have any questions,
please contact Mr. Roberto Barbosa of my staff at (212) 264-
6730.

Dear Mr. Matzen:
The following is in regards to the subject ap~lication
to construct a 3 foot wide by 16 foot long fixed p1er dock
elevated a minimum of 4 feet above grade, install a 3 foot
wide by 16 foot long ramp, a 4 foot by 24 foot float with two
3 foot b¥ 14 foot finger floats, and three piles, and to move
an exist1ng pier 12 feet eastward in Spring Pond, Gardiners
Bay, at East Marion, Suffolk County, New York.
We have received your letter dated January 21, 1992 and
the supporting documentation. Based on our previous
experience with the Federal environmental agencies, we
recommend that you extend the ramp as necessary to insure
that a minimum depth of 2 feet at mean low water will be
available to avoid foreseeable objection on this matter in
the future, and to revise the submitted drawings accordingly.
Once we have received such drawings, we will resume
processing your application. If you have any questions,
