Box 4 East Marion, NY 11939 ACTIVITY: To dredge an existing dug canal to a depth of 3 feet below mean low water, removing approximately 900 cubic yards of material to be disposed of at a state-approved upland site. Box 447 Quogue NY 11959-0447 Re: GARDINERS BAY ESTATES SCTM 137-4-18 Dear Mr. Just, The following action was taken by the Board of Town Trustees during its Regular Meeting held on January 28, 1998, regarding the above matter: WHEREAS, GARDlNERS BAY ESTATES, applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated January 6, 1998 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on January 28, 1998, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code, . . WHEREAS, the Board has determined that will not affect the health, safety and people of the town, the project as proposed general welfare of the NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approves the application of GARDINERS BAY ESTATES to maintenance dredge an existing bulkhead canal to a depth of -3 feet at ALW. Resultant 900 +/- c.y. of spoil shall be trucked off to an upland site. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct and complete proiect will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. For the Board's review, we are enclosing the plans depicting these depths. It is also my understanding that the Board is concerned that dredging too close to the existing bulkheads might cause them to cOllapse or be damaged. Kindly note that the plans show that there should be no dredging within 5' of the bulkheads and that there will be slopes created pitching into the dredged channel. Sheet 3 of 3 (copy enclosed) depicts this. A statement of how the activity is consistent with the applicable policies was not included as part of the policy analysis required in Section D of the Federal Consistency Assessment Form. Therefore, you should provide a narrative assessment indicating how the activity is consistent with the applicable policies. This assessment is required in order to complete the Federal Consistency Assessment Form ( see itemS C(l)(h), C(2)(a), C(2)(c), C(3)(a), and D(2)). In order to address New York Coastal Management Program (CMP) Policies 1t2, 7, 15,35, and 44, please submit a photograph depicting the disposal site. Also please submit a modifIed drawing depicting the relationship (including the actual distance) of the disposal site to Orient Harbor and to Spring Pond's irùet; and confirming that the disposal site is upland. Please discuss the effects, if any, of the dredge material disposal upon osprey nesting or the bay scallop shellfishery ( a copy of the Orient Harbor Significant Coastal Fish and Wildlife Habitat narrative is enclosed). Please submit a drawing indicating the extent of ownership of both the dredge disposal site and the dredging area. Is the pedestrian bridge, that will be temporarily removed, owned by the applicant? Pursuant to 15 CFR 930.60(a), the review of your consistency certification will begin after we receive and determine that the necessary data and information is adequate to assess coastal zone effects. please provide the information requested above to the Department of State within 30 days.
