Box 1179 Southold, New York 11971-0959 CONSERVATION ADVISORY COUNCIL TOWN OF SOUTHOLD MINUTES Tues., January 11,2005 Down's Farm Preserve 5:00 PM RECEIVED FEB 1 5 2005 A meeting of the Southold Town Conservation Advisory Council was held Tues., January 11,2005 at Down's Farm Preserve. Present Were: Don Wilder, Chairman William Cook, Jr., Member Doris McGreevy, Member Jack McGreevy, Member Nicholas Dickerson, Junior Member Tom Schlichter, Member Peggy Dickerson, Trustee Lauren Standish, Secretary CALL TO ORDER Chairman Don Wilder called the meeting to order at 5:00 PM. CHAIRMAN'S ANNOUNCEMENTS The Council expressed their concerns regarding the purpose and the future of the Conservation Advisory Council. Chairman Don Wilder will set up a meeting with the Supervisor to discuss all of the issues and report back to the Council in February. REPORTS Jack McGreevy will be attending the next Trustee Meeting on Wed., January 19, 2005. RESOLUTIONS Moved by Don Wilder, seconded by William Cook, it was RESOLVED to recommend to the Southold Town Board the appointment of Alicia Marin as a new member of the Conservation Advisory Council. AYES: All - Motion Carried Moved by Don Wilder, seconded by William Cook, it was RESOLVED to recommend to the Southold Town Board the appointment of Jennifer Mannino as a new member of the Conservation Advisory Council. AYES: All - Motion Carried Moved by Don Wilder, seconded by William Cook, it was RESOLVED to recommend to the Southold Town Board the appointment of Jacob Smith as a new student member of the Conservation Advisory Council. AYES: All- Motion Carried APPROVAL OF MINUTES Moved by Jack McGreevy, seconded by William Cook, to Approve the Minutes of December 7, 2004. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Don Wilder, seconded by William Cook, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of REDDY INDUSTRIES, INC., as contract vendee to construct a 4'X 15' ramp, 4'X 110' elevated fixed dock, 4'X 16' ramp, and 6'X 16' floating dock, and to clear a 4' access path to docking facility. Located: 930 Clearview Rd., Southold. SCTM#89-3-11.4 The CAC recommends Approval of the application with the Condition no CCA timber is used and such note should be removed from the construction plans. Vote of Council: Ayes: All Motion Carried Moved by William Cook, seconded by Tom Schlichter, it was RESOLVED to TABLE the Wetland Permit application of J&C HOLDING, LP to construct a single-family dwelling with attached garage, pervious driveway, and sanitary system. Located: 450 Albacore Dr., Southold. SCTM#57-1-43 3 The CAC Tables the application because the wetlands line is inaccurate. The CAC requests an opportunity to re-inspect the property with an accurate survey. Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by William Cook, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of ALEXANDER LEDONNE to reconstruct in-place 97' of concrete bulkhead utilizing vinyl sheathing and to backfill structure with approx. 10 cy. of clean sand to be trucked in from an upland source. Located: 850 Oak Ave., Southold. SCTM#77-1-5 The CAC recommends Approval of the application with the Condition of a 20' non-turf buffer. Vote of Council: Ayes: All Motion Carried PETER O. CRISP requests a Wetland Permit to construct a 16'X 24' addition onto an existing single-family dwelling. Located: Equestrian Ave., Fishers Island. SCTM#9-3-10.1 The CAC did not make an inspection, therefore no recommendation was made. Moved by William Cook, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Wetland Permit application JUDIE LIZEWSKI to construct a single-family dwelling with on-site sewage disposal system and private well, and construct a 4'X 26' fixed walkway dock. Located: 145 Fleetwood Rd., Cutchogue. SCTM#137-4-10.1 The CAC recommends Approval of the application with the Condition a landscape plan is submitted specifying what trees are to be removed and what trees are to remain, before the permit is issued, and a 50' non-disturbance buffer in order to protect water quality. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of BOB TAPP & NICK ELLIS to demolish the existing residence and reconstruct further back from the wetlands with a new sanitary system. Located: 275 West Rd., Cutchogue. SCTM#110-7-11.1 The CAC recommends Approval of the application with the Condition hay bales are placed down at the top of the bluff before construction begins and drywells are installed to contain the roof run-off. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by William Cook, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of DOUGLAS CARLEN to rebuild the existing 12'X 16' deck and to construct a 3'X 20' catwalk and recommends DISAPPROVAL of the attached 4'X 8' platform. Located: 5550 New Suffolk Ave., Mattituck. SCTM#115-10-5 The CAC recommends Disapproval of the platform in order to limit unnecessary development on the creek. Vote of Council: Ayes: All Motion Carried AEROS CULTURED OYSTER CO. to use the existing aquaculture dock, preserved for aquaculture, for floating upweller system. A maximum of four (4) units will be secured to floating dock at south end of aquaculture dock. Two small land-based upweller tanks will be temporarily located on aquaculture dock until greenhouse is improved. Additionally, 30 floating cages will be used to culture shellfish in saltwater pond. Located: 10273 North Bayview Rd., Southold. SCTM#79-5-20.12 The CAC has reviewed the application and recommends a SEQRA review as well as a review of the Peconic Estuary guidelines with regard to aquaculture, before any consideration is given. Moved by Don Wilder, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of MICHAEL GRIFFIN to demolish the existing dwelling and construct a new dwelling, swimming pool, driveway, two-story deck, and a septic system. Located: 435 Pine Place, East Marion. SCTM#37-4-14&15 The CAC recommends Disapproval of the application because of the following reasons: The project was not staked. The proposed house is twice the size as the existing footprint and will have a negative impact on the wetlands. The pool discharge drainage is not shown. A landscaping plan should be required limiting the removal of significant trees. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by William Cook, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit & Coastal Erosion Permit applications of ANGELO PA, DA, VAN to construct a single-family dwelling, sanitary system, gravel driveway, and bulkhead. Located: 22455 Soundview Ave., Southold. SCTM#135-1-23&24.1 The CAC recommends Disapproval of the applications because of the following reasons: There is existing erosion. The septic system should be located beyond 100' from the wetlands and landward of the CEHA. The entire project is located within the CEHA. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Tom Schlichter, it was RESOLVED to TABLE the Wetland Permit application of SHANNON GOLDMAN & DEBORAH MCKEAND to construct a single-family dwelling and garage. Located: 8605 Soundview Ave., Southold. SCTM#59-6-27.2 The CAC Tables the application because the wetlands line is inaccurate. The CAC recommends a full wetlands review. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Nicholas Dickerson, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of PARADISE POINT ASSOC., INC. to repair the existing bulkhead. Located: Basin Rd., Southold. SCTM#81-1-16.10 The CAC recommends Approval of the application with the Condition the bulkhead is repaired in-place. Vote of Council: Ayes: All Motion Carried CHARLES M. WENDY, JR. to construct a fixed platform 4'X 4', hinged ramp 4'X 16', and floating dock 5'X 20'. Located: 765 Willow Point Rd., Southold. SCTM#56-5-28 The CAC did not make an inspection because the gate was locked, therefore no recommendation was made. Moved by Donald Wilder, seconded by William Cook, it was RESOLVED to TABLE the Wetland Permit application of ANTHONY CACIOPPO to construct a 24'X 24' two-story extension to the existing house, with garage on ground level and living space with bath above; with 9'X 8' fully enclosed and conditioned connecting hallway to the existing house. Located: 1455 Inlet Way, Southold. SCTM#92-1-4 The CAC Tables the application because the garage was not staked, however it appears to be too close to the wetlands. Vote of Council: Ayes: All Motion Carried Moved by William Cook, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of KAREN & RICHARD SEELIG to remove and replace (in- place) remaining 4'X 50' section of previously existing 4'X 75' fixed catwalk with 4'X 86' fixed catwalk, 3'X 14' ramp and 6'X 20' float secured by (2) 8" piles. Located: 1515 Calves Neck Rd., Southold. SCTM#63-7-37 Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Nicholas Dickerson, it was 7 RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of ALAN & TERESA MONTANO SUCHER to remove and replace (in-place) approx. 168 linear ft. of existing timber bulkhead with vinyl bulkhead and backfill with approx. 75 cy. clean sand fill to be trucked in from an upland source. Remove and replace (inkind/inplace) existing step- down platform (as necessary) during construction of bulkhead. Construct dormer, deck, and chimney additions to an existing 1.5 story, one-family dwelling. Located: 60 Fisherman's Beach Rd., Cutchogue. SCTM#111-1-6 The CAC recommends Approval of the application with the Condition of a 15' non-turf buffer in order to prevent chemicals from entering into the water. Vote of Council: Ayes: All Motion Carried Moved by Nicholas Dickerson, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of JOAN O'LEARY to replace (within 18") approx. 100 linear ft. of existing concrete seawall with fiberglass bulkhead and backfill with approx. 75 cy. clean sand fill to be trucked in from an upland source. For bulkhead installation purposes, remove and replace 3'X 8' platform. Located: 770 Old Salt Rd., Mattituck. SCTM#144-5-14 The CAC recommends Approval of the application with the Condition the seawall is replaced in-place and the existing 12' buffer is maintained. Vote of Council: Ayes: Ail Motion Carried Moved by William Cook, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of ZBIGNIEW KOZLOWSKI to expand the existing single- family dwelling by converting decks and the front stoop into interior living space. Located: 7345 Soundview Ave., Southold. SCTM#59-6-5.2 Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND PERMITS Moved by William Cook, seconded by Jack McGreevy, it was 8 RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the application of EDWARD KAVANAGH to Amend Permit #5914 for an expansion of the deck and covered porch. Located: 2000 Glenn Rd., Southold. SCTM#78-2-37 The CAC recommends Approval of the application with the Condition there is a limit to the number of trees being removed on the property. Vote of Council: Ayes: All Motion Carried ANCHOR LANE LLC to Amend Permit #1650 to construct a floating dock with a ramp no larger than 6'× 20'. Located: 1615 Anchor Lane, Southold. SCTM#79-4-6.1 The CAC reviewed the application and recommends the property boundaries are verified before final consideration. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the application of CHARLES BURNHAM to Amend Permit #4350 to construct an addition to the existing dwelling. Located: 3155 Pine Neck Rd., Southold. SCTM#70-6-19 The CAC recommends Approval of the application with the Condition drywells are installed on the addition and on the existing dwelling. Vote of Council: Ayes: All Motion Carried The next meeting of the Conservation Advisory Council has been scheduled for Mon., February 14, 2005 at 5:00 PM at Down's Farm Preserve.
