I believe the above-referenced matter is on the calendar ~_April
Enclosed herewith please find survey which I had completed in order to
demonstrate to the Board that I have not exceeded the permit which was granted. You may
recall that the pcmfit which was granted allowed that the deck on the eastern end of the house
could be 38' x 16'. The deck as constructed is 24' x 16' at its widest point and 24' x 14 ki' at its
narrowest point.
Additionally, the other decks and the porch which had been approved are now
shown on the survcy.
If there is any question with respect to this or if you desire further clarification
prior to the hearing, please communicate with me.

Dear Mr. Kowalski,
The following action was taken by the Board of Town Trustees
during a Regular Meeting, held on January 26, 2000, regarding
the above matter:
WHEREAS, DANIEL C. MOONEY, applied to the Southold Town
Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated January 3,
2000 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
· recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on January 26, 2000, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
DANIEL C. MOONEY to construct a 55'6" X 10' deck and a 36'6" X
16'3" deck with roof over both decks with condition that
drywells be placed to catch roof run off. Located: 575 Pine
Place, East Marion.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Dear Madam/Sir:
Enclosed herewith please find a copy of the above-referenced Sumnlons, together
with the Notice of Violation given to me by the bay constable.
In accord with the provisions of the Notice, I would appreciate the Trustees
affording me a hearing for the following reasons:
I previously filed for an amendment to the permit which had been issued
by the Board of Trustees and that matter is on the calendar for April 22,
2002; and
I previously submitted the plans to the Zoning Board of Appeals and the
Building Department. A copy of the Bu4ilding Department permit is
annexed hereto for your information. It statds that the building permit was
issued in accord with the Trustees, New Yo~k State DEC, and Town ZBA
resolution. Accordingly, I do not believe ! violated Chapter 97 Article 2
Sections 97-20 of the Southold Town Code since any work outside of the
existing structure was properly permitted by the Trustees. The only other
work is within the original footprint.
