Town Clerk Southold Bishops Lane Southampton, NY 11968 Dear Mr. Samuels : I received your letter of February 5 , 1982 along with informa- tion on dredging scheduled for «unneweta Lagoon, Nassau Pt. , Cutchogue, New York. I also received additional material from Mr. Stoutenburgh, President for Southold Town Trustees , indi- cating the concerns of the Trustees . After reviewing the information and based on my knowledge of groundwater hydro- geology for Long Island, both regional and local, I offer the following comments : 1) The proposed dredging activity should not impact any fresh groundwater resources in the Nassau Point area. 2) The investigation prepared by the Suffolk County Department of Health Services accurately presents the groundwater situation for Nassau Point. The report discusses ground- water hydrogeology and indicates that a minimum amount of water is available based on a certain percentage of annual rainfall returning to the groundwater (recharge) . The amount of recharge that is available for use is affected by several factors including land mass . Technically, if the shoreline were to be reduced, the land mass would diminish and, subsequently, the total recharge to Nassau Point would be decreased. Therefore, the report recommends : "prevent any dredging of the shoreline. " In reviewing the proposed dredging application, there does not appear to be any change occurrring to the shoreline . However, based on the material reviewed, this project will not impact the groundwater resources of Nassau Point. Dear Mr. Stoutenburgh: I am in receipt of your letter of 1/22/82 regarding your requirement for additional information on the possibility of salt i water intrusion of the above project. Allow me to follow the progression of events on this matter. 1. The Trustees requested lead agency status from the Town Board and the N.Y.S.D.E.C. (SEQRA) . 2. The Town denied without prejudice our Wetland's applic- ation, due to insufficient time for the Trustee 's deliberations, and allowed the Trustees to be lead agency (SEQRA) . ' 3. The N.Y.S.D.E.C. subsequently granted the Town lead r agency status. 4. The Trustees requested professional evaluation of the application and referred the owner's agent to the firm of Geraghty & Miller, Inc. for an opinion on the menace to ground water. 5. Rambo did, in fact, hire Geraghty & Miller, Inc. to evaluate the project. It did so, and replied that there was no risk to the water supply of Nassau Point and explained it 's rationale for that opinion. Their opinion is unqualified and should be easily understood by any fair minded person. 6. The N.Y.S.D.E.C. in it' s letter to you of 1/14/82 states "We have been informed of the analysis of ground water impacts by the firm of Geraghty & Miller, Inc. as requested by your agency. We agree with the analysis for the reasons stated and because of the reduced depth (4' below mean low water) of proposed dredging." cont. 2. The D.E.Ce is not without expertise in it 's evaluation of ground water and it is significant that the possibility of salt s� water intrusion was not part of it's concern as stated to us, in it's evaluation of the project (See incomplete notice of Dec. 15, 1981). 7. We are presently preparing core sample evaluation and benthic organism analysis for the D.E.C. Th'e •Lagoon is in the process of eutrofication with very poor .tidal interchange, due to shallow water depths. The purpose of the dredging is to allow small boat access and to increase the biological quality of the lagoon, as well as the viability and vigor of the wetlands surrounding it's borders. The most significant point I can make about your concern of salt water intrusion is that the studies are dealing with the development of new areas involving dredging of shorelines, invasion of marshes, creation of basins and pumping of ground water (i.e. irrigation, etc.). This project does not in any way jeopardize the quality, or quantity of fresh water on Nassau Point. I feel therefore, that Mr. McCallum's letter should suffice for your purposes. I will be in attendance at the Trustee 's meeting of 2/2/82 to further discuss this matter and I hope to have additional information at that time. Sincerely, Thomas E. Y. 11968 Dear Mr. Samuels : This Board has received the letter of January 5th you sent us from Geraghty & Miller, Inc. , concerning the proposed dredging of the Lagoon on Nassau Point in Southold Town. We, the Southold Town Trustees, as lead agency, are very concerned that this dredging may affect the limited groundwater by salt water intrusion now or in -the future. We base our concerns on the following : 1) Nassau Point could be considered an island and not treated as part of the mainland that has a larger reserve of groundwater to draw from, i. e. Nassau Point has limited water and low head. 2) In the report INVESTIGATIONS OF GROUNDWATER QUALITY OF THE NASSAU POINT PENINSULA, SOUTHOLD TOWN, ' prepared by James Heil, P. E. , Water Quality Section, Suffolk County Health Department, under their recommen- dations on page eight, No. 2, they state : "Prevent any dredging of shoreline. " =� 3) In Raymond and May's COMPREHENSIVE DEVELOPMENT PLAN FOR SOUTHOLD TOWN, they state the following under DREDGING OF WETLANDS AND INLAND SALTWATER CHANNELS : "The dredging of wetland basins and salt water inlets for the purpose of removing sand and gravel deposits, for' any other reason, can jeopardize the salt water character of the underlying aquifers. In addition, such dredging seriously contributes to salt water intrusion into the fresh water wells and storage areas. " 4) Finally, in a report MATTITUCK CREEK WATER SHED STUDY, PHASE I, INVENTORY OF EXISTING CONDITIONS AND IDENTIFICATION OF DEVELOPMENT OPPORTUNITIES by the Suffolk County Planning Department, dated April 30, 1981, a discussion of groundwater was undertaken. On page 32, paragraph one, it states : "The natural low groundwater heads indicate that an extremely limited amount of pumping can take place on the Fork before serious saltwater encroachment will occur. " If this is true on the main- land, then wouldn't it be doubly true on Nassau Point? With the above in mind, we would like a study as previously suggested, 2. not an opinion as stated in the above mentioned letter, on what the effect of your proposed dredging at the Lagoon on Nassau Point would have on the fresh water in the immediate area. Bishops Lane Southampton, N.Y. 11968 Dear Mr. Samuels: We have reviewed the proposed plan for maintenance dredging of the Wunnemeta Lagoon, located on the Nassau Point peninsula in the Town of Southold. Relevant hydrogeological data were also reviewed. In our opinion, the proposed dredging will have no impact on the fresh ground water of the area, i.e. , it will not cause salt-water in- trusion. This is because the lagoon is a discharge point for fresh water, which flows into it at or near the shorelines. This flow is caused by mounding of fresh water beneath the land areas. Such mound- ing creates gradients that cause flow toward the lagoon. Since dredg- ing cannot result in a reversal of gradients, it will not generate an impact upon fresh water. FOR WUNNEWETA LAGOON ASSOCIATION FOR A PERMIT UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD. SUPERVISOR PELL: I call the first hearing open of Wtnnewe,ta Lagoon. We are going to waive hearing of the public notice. This has already been done. This is a continuation of a recessed hearing that was held on November 5th. Do we have input from the Trustees? TOWN CLERK TERRY: No,, I have not received anything from the Trustees. SUPERVISOR PELL: On November 5th we said we would put this back on the agenda today and open it back up for anyone who further wishes to comment it. Is there anyone from the audience here wishing to comment on it? TRUSTEE PAUL STOUTENBURGH: I would like to represent the Town Trustees and to again reiterate that we would like to become the lead agency in this dredging operation and to exert our authority in this area. There seems to be some confusion as to whether or not we have authority in this area and perhaps 'Mr . Tasker might want to review this. If he has anything additional. I did meet with him and we were both going to look into it a little further to see if we could find out if there was a definite opening to the Bay, therefore giving the Trustees the jursidiction of tidal waters. TOWN ATTORNEY TASKER: I have looked at some other maps. It is very inconclusive, really, to be honest with you. Some maps show an opening in the Lagoon and none in Wtnneweta Pond and other maps show the contrary. That ' s all I found to date, TRUSTEE STOUTENBURGH: The Trustees believe that they do have the authority there and would like to become lead agency in this project . Mainly because they are very concerned. You just heard Frank Bear speak about the problem of fresh water. If you look into the first water study, the first study that this Town did, when they spoke about dredging, the chapter on dredging says that they should do it in a limited way because of the very tenuous water supply. Nassau Point, I think, could be considered an island for the simple reason it is only connected to the mainland by a causeway and we feel that they have a real water problem. They also have had a water study done some time ago in their water study it speaks about the very problem of very limited water supply. And so we felt that the Trustees should be the one to make sure by a complete impact statement and emphasis on the water supply, we would then feel a little more free about saying go in there and dredge. If it should be, it should be very limited. That' s basically our stand. I might add I have maps here which will prove to you beyond a question of a doubt, we do have jurisdiction. I- have a map here which is dated filed 1919 which I think Mr. Tasker is familiar with. I also have one filed 1871. These are maps that have been filed in the Clerk' s Office in Riverhead and they show that we do have jurisdiction. Here' s the opening into Wunnaweta Lagoon and I specifically had a map made. I went down and got another one of these because I knew this was a poor map and you will see there is a marshy area that connects these two together as it shows in this one here, the 1900 map. I don' t think they were thinking too much of connections or anything but here you can see a definite connection between the two . This one shows the opening down here, this one shows the opening up here. I might add, if you know anything about literal drift of sand moving along back and forth, these things open and close continually. It ' s like an inlet on the Fire Island Beach. At one time there -were nine inlets in there but they close and open and close and open. So, I'm just trying to say that these things open and close, so I think we have jurisdiction there. SUPERVISOR PELL: Are you leaving the maps? TRUSTEE� STOUTENBURGH: They're Town Trustee maps, 'so I would say if you would like to look at them you -are welcome to. Just make sure they get back to the Trustee' s file. COUNCILMAN DRUM: I know in some of these waterways I know the Assessors have not considered some of them Town waters. Perhaps we must lay official claim to these waters as being Town waters. This is something legal that we the Town Board must consider. TOWN ATTORNEY TASKER: Are you saying they are or are not? COUNCILMAN DRUM: I don't know. I don ' t believe they have been, they have been looked at in some cases as private waters. SUPERVISOR PELL: Anybody else wish to comment? Mrs . Ruth Oliva. MRS. We would agree - with the Trustees that it is absolutely imperative that an environ- mental impact statement be prepared by the applicant for this area because of the critical water supply in that area. " I have proof of publication from Pat Wood of the Watchman-Traveler, Judith Terry that it was posted on the Bulletin Board at the Town Clerk' s Office, and from Troy Gustayson that it was published in the Suffolk Times. There' s a letter here from the Town Board of Trustees with a resolution: "Resolved to recommend to the Southold Town Board to hold in abeyance decision on the wetland application #72, of The Lagoon, as the Trustees feel there is a problem with the Town Code. " -There is -alsb -a letter from the Conservation Advisory Council: "The following action has been taken by the Southold Town Conservation Advisory Council at a regular meeting held September 22, 1981. Resolved to recommend to the Southold Town Board approval of Wetland Application #72 of Enconsultants, Inc. for Wunneweta Lagoon Association. " I believe that ' s it, Judy. We' d be against granting this application at this time as there are just too many unanswered questions down on that whole Lagoon area that has to be resolved before I think any application should be granted. If permit is being sought for a more sizeable excavation than the construction of a private single dock or jetty, then this application must be accompanied by a survey and topographical map certified by a registered land survey or Professional Engineer. The horizontal control of survey shall be based upon an approval local coordinate system. The vertical control for elevation and sound- ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological Survey datum. F. A statement mush accompany the application describing any known prior operations conducted on the premises in question and whether any prior licenses or permits have been issued to erect structures or to dredge or deposit fill on said premises and whether any such permits or licenses were ever revoked or suspended by a governmental agency. G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection, there is a $5.00 fee for each additional inspection. H.
