The validity of this permit is or may be subject to the- approval of
other governmental or municipal authorities_ The Town accepts no
responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit
shall not commence operations hereunder until such approval has been
obtained in writing_ The failure to obtain such other approval when
required shall subject this- permit to immediate revocation by the -
Town Clerk upon receipt by the Town Clerk of written notice from such
other governmental or municipal authorities of its refusal or disapprova
The applicant does by the acceptance of this permit, assume all
responsibility for operations undertaken pursuant to this permit,
and shall take all precautions for the prevention of injuries to
persons and property resulting from such operations. By such
acceptance, the applicant also agrees to indemnify and save harm-
less the Town, and its officers, agents and employees from any and
all claims arising from operations under this permit and any and
all acts or omissions of applicant, his agent and employees.
The applicant and the owner and occupants of the premises upon which
the operations authorized by this permit are being conducted, do,
by the acceptance of this permit, give consent to the Town, and its
officers and employees to enter upon the premises where such opera-
tions are being conducted to make such inspections as the Town may
deem necessary to insure that such operations are being conducted
in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town_
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion intothe fresh water resources
of the town.
D. Adversely affect fish, shellfish or other beneficial marine
organisms, aquatic wildlife and vegetation or the natural
habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal
flow of the tidal waters of the town_
G. Change the course of any channel or the natural movement
or flow of any waters_
H. Weaken or undermine the lateral support of other lands in
the vicinity.
I. Otherwise adversely affect the health, safety and general
welfare of the people of the town_

MINUTES OF HEARING
IN THE MATTER OF THE
APPLICATION OF WHITCOM INVESTMENT COMPANY
A public hearing was held by the Southold Town Board at the Southold Town
Hall, Main Road, Southold, New York 11971, at 7:30 P.M. on Tuesday, November 21,
1978 in the matter of the application of Whitcom Investment Company for a permit
under the provisions of the Wetland Ordinance of the Town of Southold.

SUPERVISOR MARTOCCHIA: I call the hearing to. order of application #35 of
Whitcom Investment Company. The Notice of Hearingewill be read by Councilman Drum.
COUNCILMAN DRUM: Legal Notice. Notice of Hearing. Notice is hereby
given that a public hearing will be held by the Town- Board of the Town of Southold
at the Southold Town Hall, Main Road, Southold, New York, at• 7:30 P.M., November 21,
1978, in the matter of the application of Whitcom Investment Company for a permit
under the provisions of the Wetland Ordinance of the Town of Southold for permission
to provide for a 50-foot road, and if so required by the Town of Southold, with a
gravel bed not in excess of 30 feet along the westerly portion there as an access
road to a proposdd minor four-lot subdivision on the north side Main Road, New York
State Route 25, Orient, New York. All persons interested in said matter shall
appear at the time and place above specified and will be given an opportunity to
be heard. Dated: October 10, 1978. By Order of the Southold Town Board, Judith T.
Terry, Town Clerk. I have an affidavit signed by Troy Gustayson that this has been
published in the Suffolk Weekly Times, so notarized. I also have an affidavit
signed for the Long Island Traveler-Watchman signed by Mr. Wood, and so notarized.
I have also notice that this has been published, posted on the Town Clerk Bulletin
Board, Town Clerk's Office, Main Road, Southold, signed by Judith T. Terry, Town
Clerk. I also have a letter from the Board of Town Trustees:

The following action was taken by the Board of Southold Town Trustees
at a regular meeting held October 3, 19789 RESOLVED to recommend to the Southold
Town Board approval of application #35 for a Wetland Permit submitted by,Whitcom
Investment Company to provide a road not in excess of 30 feet in width along a

freshwater marsh subject to the following: (1) the natural drainage from west
to east across the proposed road not to be disturbed and culverts be placed where
necessary; (2) the freshwater marsh be maintained permanently in its present
natural state, several adjoining' property owners indicated to Board Members
their concern that the freshwater marsh remain in its natural state; (3)
the two operating irrigation poncb not to be disturbed. Yours very truly,

tion was approved. Conditions: Input of surface drainage from west to pond
and the minimum standards should be considered for this road to lessen environ-

SUPERVISOR MARTOCCHIA: You have heard the legal notice read and the
applicant's request, that 'it has been posted on the Town Clerk's Bulletin Board,
and also certified in the local legal newspapers, The Suffolk Times and The Long
Island Watchman. Also, comments of the Town Trustees approving it, with conditions.
The Southold Town Conservation Advisory Council approving it with conditions,.
The floor is open to the applicant or anyone representing the applicant who
wishes ,to speak on this matter.

RICHARD CRON, ESQ.: If it would please the Board, Richard J. 11 Cron on
behalf of the applicant, Whitcom Investment Company. As the ,rB`o'ard has already
indicated, this is an application for a freshwater permit under the Southold
Town Wetlands Ordinance. I would indicate to the Board that a similar applica-
tion had already been made to the DEC, and we have from them their approval
indicating that no wetlands permit is required, and that there would be no-
adverse effect upon the freshwater lands. I would like to submit this to the
Board to be incorporated into their file. We would respectfully submit that
the application would have a most minimal effect upon the freshwater wetlands
which adjoin this proposed road. What is basically proposed_ is actually a 50'
road, but only of,which a maximum 30 feet would be utilized in terms of a gravel
bed for travel. The road would serve in both a southerly and a northerly direc-
tion, a proposed 4-lot minor subdivision. There would also be a road running
east and west but it wouldn't really affect the freshwater wetlands in any way,
shape or form. I think on the basis of the' maps submitted, it can be readily
determined that there is a minute area of the freshwater lands that are affected
by this application. Most minimal when you consider that the area that will
remain open, consisting of the freshwater `lands, is almost 18 acres. There is
no intent whatsoever to develop that land, and in fact that will probably be
given to one of the conservacy groups' as a donation. So we ask the Board also
in the light of the recommendations of the Advisory Council as well as the
Town Trustees, that they grant approval of the application.

SUPERVISOR MARTOCCHIA: Thank you, Mr. Cron. Is there anyone else who
wishes to speak in behalf of granting this application?
(There was no response.)
SUPERVISOR MARTOCCHIA: Is there anyone who wishes to speak in opposition
to granting this application?
LOUIS DEMAREST: Chairman? I would like- to comment first that I am
neither in favor of it or against it. It's just that this property which is
immediately adjacent to the east of property that belongs to my two brothers
and myself, the line, property line and the right-of-way which we have over this
property is, there's some question about it. They had it surveyed and they ar-
bitrarily ran a line from the Main Road directly north. The right-of-way that
we have, that was purchased from in 1883 by Lydia Young who is the mother of my
uncle who left the land and the right-of-way to my mother and father, and which
we subsequently bought from my mother and father. Now the description of the
right-of-way, it's a carriage right-of-way adjacent to the easterly line of land
of Lydia Young along a road used by me, this man is Hank Mulford who owned both
pieces of property originally and owned by me, used by me and known to the public.
Now where they have put this right-of-way is not where the road as I know it and
many others in Orient, so that I think the granting of any right-of-way or any
use of any of this property for a road should wait until the matter is settled
between mybrothers and either the present owner or the prospective buyers.
MR. HOMAN: Does that mean there is litigation? Is there litigation or
a contract sort. ,
MR. DEMAREST: Well, we have notified with, I notified Mr. Cron, Mr.
Glickman I believe notified him, the title company has notified the lawyers for
the -present owner that they cannot give them any guaranteed title until it's
settled. So I think that it might be wise to wait until it is settled.
SUPERVISOR MARTOCCHIA: Thank you. Is there anyone else who wishes to
speak in opposition?
(There was no response.)
SUPERVISOR MARTOCCHIA: Is there anyone who wishes to make comments on
this application in either direction?
MR. CRON: If it would please the Board, I would like to comment on
Mr. Demarest's statement. No. 1, 1 don't think it's necessary determination of

this Board as to whether there's a marketable title to the boundary line or not.
The application before this Board is,,on a proposal based upon a specific area as
to where we understand the right-of-way to be, and the effect that it will have
upon the freshwater marsh in the immediate vicinity thereof. If subsequently it
determines that a greater portion of the freshwater lands are affected, 'we would
be obligated I believe to go back before this Board as well as back before the
DEC, and make new applications. I don't feel that this Board should withhold,
or hold up this pending application. Secondly, it was my understanding from
Mr. Demarest himself that the area of the right-of-way which affects the freshwater
marsh is not an area that's in conflict; that's in dispute. My, understanding of
what his claim is it's an area further north near the woodlands, and as it may
project its way into the Sound. The area that directly affects this application
in my understanding is not in dispute. He himself according to my survey, pointed
out to the surveyor the starting point of this particular right-of-way, which was
placed as he had indicated. So I don't believe there's any merit to what he says
in that we are not in dispute as to this particular area. The area is further
down or further north on the right-of-way that's in dispute.
SUPERVISOR MARTOCCHIA: Is that for the junction of where the east, west,
the other right-of-way?
MR. CRON: No. It's even north of that. If .I understand that the area
of the right-of-way that'staffectdd by the freshwater marsh is not in dispute.
Maybe Mr. Demarest would like to comment, but that's my understanding of what
he said.
MR. DEMAREST: I actually don't know where they set the line. I really
can't tell from the map where it is because this land is.
MR. CRON: This is the map the way it currently reads.
MR. DEMAREST: Well, it said general. Well, at the time I told him that
the boundary-line agreement would have to be made because-. Of course and then
we are also concerned, I don't know where our right-of-way is, as far as-.
MR. CRON: The letter I got from the title company is based upon a
conversation with Mr. Glickman, and that letter indicated that the, at a point
somewhere up here going in about 75 feet to the Sound is all that's in dispute
in terms of the right-of-way. There was no indication to me or to the title
company that this portion of the right-of-way was in dispute.
MR. DEMAREST: Well, what we said was we agreed that for a long portion
of this, straight, but where they have put it, I don't know. There's no mark.

MR. CRON: You indicated there was an elm at one time, right?
MR. DEMAREST: Yeah, we said there was an elm tree, and the road went
in to the east of the elm tree. And the elm tree has been long gone. 38 feet.
All T can say is this line .was drawn; you had
MR. CRON: All I can say is, this line was drawn, that you had indicated
to the surveyor.
MR. DEMAREST: In the general area. But' I also told him that up here
it went off in another direction.
MR. CRON: I understand that.
MR:, DEMAREST: And so, yeah, but what did they do? They ran it straight
on up. So I don't know where they placed this line. There's no marker.
MR. CRON: Monuments. They found a monument over here, apparently
somebody put in, but we didn't.
MR. DEMAREST: We didn't either, as far as I know.
MR. CRON: I don't know who put it in.
JUSTICE SUTER: It shows a monument now though.
MR. CRON: Yeah. It's a monument they found. I don't know who put it
in. I'm sure our people didn't.
MR. CRON: That's all the comments on this matter.
SUPERVISOR MARTOCCHIA: Is there anyone-else who wishes to speak on this
application? Give your name to the steno, please.
MRS. YOUNG: Mrs®=Young. I just want to ask what their, intentions are
with regard to the old house on that property.
MR. CRON: Well, that's not a subject of this application.
MRS. YOUNG: I know it isn't.
MR. CRON: But with hope it will be kept in perpetuity the way.it is or
improved. It's going to go to somebody who is going to have a great deal of
determination to make it what it was. It will be preserved.

SUPERVISOR MARTOCCH L4: Is there anyone else who wishes to speak? Has
everyone had the opportunity to speak on this application that wishes to make
comments?
JUSTICE SUTER: As Mr. Demarest pointed out, it has to go back to the
Planning Board anyway but as a minor, right? And they may acquire proof of
boundary lines, the Planning Board may require it. I think that's another
thing we should state in mind.
SUPERVISOR MARTOCCHIA.: Hearing none, the hearing is called to a close.
The- Board will make a decision at the proper time. Thank you.

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by written permission from the owner of the property if not
the some as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to the Permit Application:)
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection,
there is a $5.00 fee for each additional inspection.
H. The Town Board upon request of the applicant for a permit, may waive in whole or in part,
the provisions of Article 11, Section 210, subdivisions (d) and (g) where it finds that nature of the
proposed operations are such that 'the requirements of such provisions are not necessary for a
proper consideration of a permit application.
I. Upon approval of this application the Town Clerk will issue a permit to the applicant. Such
,permit shall be available for inspection at any time, upon request.
