WETLANDS PERMIT This Wetlands Permit # 13 has been granted by the Southold Town Board according to information furnished in Application # 25 filed by Applicant Henry C. Weismann on August 1 19 75 A map of the proposed work will be kept on file in the Town Clerk ' s Office under the application number given. Permit granted to do the following work Remove material from an existing canal and deposit same behind a proposed new bulkhead. Location of property on which work to be done Southeast terminus of Tarpon Drive, Arshamomaque; fronting on an existing- canal on the south side of the property. Entended use of property, Residential ' Page 2 Conditions if any none Expiration Date— The validity of this permit is or may be subject to the approval of other governmental or municipal authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the event that such approval is necessary, the holder of this permit shall not commence operations hereunder until such- approval has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the Town Clerk of written notice from such other governmental or municipal authorities of its refusal or disapproval. The applicant does by the acceptance of this permit, assume all responsibility for operations undertaken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemnify and save harm- less the Town, and its officers , agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees . The applicant and the owner and occupants of the premises upon which the operations authorized by this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and its officers and employees to enter upon the premises where such opera- tions are being conducted to make such inspections as the Town may deem necessary to insure that such operations are being conducted in conformity with this permit. Supervisor Martocchia: You have heard the legal notice read, proof of publication in the local papers, the Suffolk Times and the Long Island Traveler, the recommendation for approval from the Town Trustees and the recommendation for approval from the Southold Town Conservation Advisory Council. At this time, I would like to hear from the applicant or someone representing him. Henry C. Weismann: Mr. Supervisor, gentlemen, my name is Henry Weismann. I am the applicant. My wife and I are the owners of the property. The proposal is to continue existing bulkheading that terminates at our property line. We are the only parcel on this canal that is not bulkheaded. We are losing quite a bit of land as a result of erosion and it' s very inconvenient to the people who own along the canal because the erosion results in the filling in of the canal. It creates a problem getting in and out of there. We have received our building permit for our residence and barn we plan on putting on the property. Hopefully, our footings will be in next week. Needless to say, we would like to install this bulkheading, about 165 feet of it, while we are constructing the house and the barn. I would like to mention that I have talked to Daniel Larkin of the State Conservation people yesterday at Stony Brook and he advised me that the draft approval was prepared by them and forwarded to Albany on September 24th for the state approval but oddly enough, another one that was forwarded on the same day is missing, too. They should have received it about a month ago. It will probably be a week or so before we actually receive the permit. Needless to say, the Army Corps of Engineers will not act until so advised by the Department of Conservation. Supervisor: Thank you, Mr. Weismann. Is there anyone else who would like to speak in behalf of the applicant? In favor of granting this application? Does anyone wish to speak in opposition to this application? Does anyone wish to speak in either direction? Hearing none, I will call the hearing to a close and the Board will make a determination within the proper amount of time, I believe it is twenty days from the hearing. Presumably, the waters involved are not town waters . I have been advised the canal was dug by the developer- of the land approximately 10 years ago on private property, to wit, property that he had acquired title to. For what it is worth, I might mention that I was also advised that the body of water in front of my lot was not exactly naturally created. That it was private property used for mining clay until some years ago when the bay broke through a barrier and flooded the area. Since that time, it has been open water, at least leading into the bay. However, I understand that the land under it is apparently owned principally by the Sage family. This application is to be completely filled in by typewriter or ink and submitted to the Town Clerk in quadruplicate, accompanied by writter permission from the owner of the property if not the some as the applicant. B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location of property, the names,-and locations of owners of adjoining properties, and a detailed description of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached to the Permit Application:) C. No operation shall be initiated by the applicant until all permits that are required are issued. D. A detailed statement of the rehabilitation and proposed condition of the premises after the work is completed must be given, including a survey if required. E. If permit is being sought for a more sizeable excavation than the construction of a private single dock or jetty, then this application must be accompanied by a survey and topographical map certified by a registered land survey or Professional Engineer. The horizontal control of survey shall be based upon an approval local coordinate system. The vertical control for elevation and sound- ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological Survey datum. F. A statement must accompany the application describing any known prior operations conducted on the premises in question and whether any prior licenses or permits have been issued to erect structures or to dredge or deposit fill on said premises and whether any such permits or licenses were ever revoked or suspended by a governmental agency. G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection, there is a $5.00 fee for each additional inspection. H. The Town Board upon request of the applicant for a permit, may waive in whole or in part, the provisions of Article 11, Section 210, subdivisions (d) and (g) where it finds that nature of the proposed operations are such that 'the requirements of such provisions are not necessary for a proper consideration of a permit application. I. Upon approval of this application the Town Clerk will issue a permit to the applicant. Such permit shall be available for inspection at any time, upon request.
