The validity of this permit is or may be subject to the approval of other governmental or municipal authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the event that such approval is necessary, the holder of this permit shall not commence operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when required'shall subject this permit,to immediate revocation by the Town Clerk upon receipt by the Town Clerk of written notice from such other governmental or municipal authorities of its refusal or disapproval. The applicant does by the acceptance of this permit, assume all responsibility for operations under- taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon Which the operations authorized by this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and its officers and employees to enter upon the premises where such operations are being conducted to make such inspections as the Town may deem necessary to insure that such operations are being con- ducted in conformity with this permit. This operation will not substantially: A. Adversely affect the wetlands of the town. B. Cause damage from erosion, turbidity or siltation. C. Cause saltwater intrusion into the fresh water resources of the town. D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege- tation or the natural habitat thereof. E. Increase the danger of flood and storm-tide damage. F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town. G. Change the course of any channel or the natural movement or flow of any waters. H. Weaken or undermine the lateral support of other lands in the vicinity. I. Otherwise adversely affect the health, safety and general welfare of the people of the town. • 1 d. DESCRIPTION OF ACTION Application of En-Consultants, Inc. on behalf of Walter Trappe for a wetland permit . Permission is requested to construct dock, catwalk, ramp, and float secured by two pilings on property located at Corey Creek at the south side of Corey Creek Lane, Southold, New York. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental- assessment has been submitted which indicated that no significant adverse effect to the environment are likely to occur should the project be implemented as planned. Because there has been a response from the Board of Southold Town Trustees and Southold Town Conservation Advisory Council indicating that this project would not have a significant effect to the environment . Because there has been no response in the allotted time from the New York State Department of Environmental Conservation and the Southold Town Building Department, it is assumed that there are no objections nor comments from those agencies. Specifically, the catwalk has been placed more to the center of the property, the structure, does not extend out as far into the waterway, and the float has been realigned so that it is parallel to the shore on its longer axis. SUPERVISOR MURPHY: Okay, ypulve heard the official reading. Is there anyone here would like tosspeak on behalf of Enconsultants on behalf of Walter Trappe? (No response.) Anyone like to speak in opposition to this application? (No response.) Anyone would like to make any comments at all? Jean? MRS. JEAN TIEDKE, Southold: l;d' like to know if there!s been any effort made in any of these creeks, by anyone, Lori -Brooks, or the Trustees, to decide whether or not they should come to some decisions about how many ramps, floats, docks, etc. can be accomodated in each creek. Now, Corey Creek is sort of round, it's not linear,. like Mattituck is a much longer stretch. How many of these things can you have? You're going to have ramp, ramp, ramp, dock, dock, dock. Where are the boats going to go? It seems to me there should be some kind of at least a giai`ck_;`study of just how far we can go. Whether perhaps there should be some communal docks. Two adjoining,Lchou'ses use the same dock and ramp perhaps. It's going to get pretty hairy, I think. SUPERVISOR MURPHY: Good. comments, Jean. Is there. anyone else in' the audience? COUNCILWOMAN COCHRAN: May I make a comment? SUPERVISOR MURPHY: Yes, Jean. COUNCILWOMAN COCHRAN: Jean, the Trustees are now taking that under discussion. What they're waiting for is some reports from the' Suffolk County Health Department, because when they do look at this kind of thing they also want to know at what level the qualify of the water is 'at, because that, certainly determines how many more you put into a given creek or a given area as far as the protection of the water. Terry Southold Town Clerk Town Hall Southold, New York 11971 Dear Judy: In the matter of the application of En-Consultants, Inc. for Walter Trappe to construct a timber dock consisting of a 172+' x 4' fixed elevated (3 ' above grade) catwalk with rail, a 12' x 4' hinged ramp with rail and a 16' x 6' float secured by two pilings in a canal off Corey Creek, Southold, Trustee Kujawski stated that all of the Trustees visited the site on May 23, 1984. The only difference about this is that the actual location of the catwalk is not where it is indicated on the drawing. It ' s actually more to the. . . . actually a little right of center of the lot , and I believe the owner also agreed with us that the float , rather than being perpen- dicular to the shoreline, which would probably be a navigational hazard, should be parallel to the shoreline, brought back in as close to the shore, similar to his neighbors (Mr. Occhiogrosso') . There was no objection to the rails, on the ramp and catwalk, as this was probably for safety reasons. The Trustees want a corrected diagram, reflecting the proper location of the structure, from Mr. Haje. On motion made by Trustee Kujawski seconded by Trustee Bredemeyer it was RESOLVED to recommend to the Town Board Approval of the Wetland Application for Walter Trappe submitted by En-Consultants, Inc. as amended to place the float parallel to the shoreline, brought back in as close to the shore and that Mr. Haje submits a corrected diagram reflecting the new location. A statement must accompany the application describing any known prior operations conducted on the premises in question and whether any prior licenses or permits have been issued to erect structures or to dredge or deposit fill on said premises and whether any such permits or licenses were ever revoked or suspended by a governmental agency. G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection; there is a $5.00 fee for each additional inspection. H. The Town Board upon reques�y applicant for a permit, may waive in whole or in part, the provisions of Article 11, Sectiorf w subdivisions A and ('where it finds that nature of the proposed operations are such that the requirements of such provisions are not necessary for a proper consideration of a permit application.
