The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to-immediate revocation by the Town Clerk upon receipt by the
Town Clerk of written notice from such other governmental or municipal authorities of its refusal or
disapproval.

The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save'harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give,consent to the Town, and
-its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the'natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.,

Gentlemen:
We are in receipt of your recent approval of our permit application for the
above-referenced project.
In your comments you make mention of a provision for fishing at the new bridge.
Since no one from this Department was present at your hearing on August 5, 1981 , we
would like you to know our present position with regard to this matter.
On June 26, 1981 , representatives of this Department met with the New Suffolk
Civil Association. At the-meeting the people in attendance, all residents of the
immediate area surrounding West Creek Bridge, asked that no provision for fishing be
made at the new bridge as it would attract too many people along with the associated
problems of parking, etc. The point -was also made that the existing bridge is presently
posted for "No Fishing". The local residents also inquired about strict enforcement of
no parking signs which they would like posted at the bridge, and it was suggested that
they contact the Southold Police Department.
As a result of the meeting, the Department has decided to- proceed with the design
of the bridge replacement at West Creek Bridge with no provision being made for fishing.
This Department would be willing to reconsider its' position if an official request,
in the form of a Town Resolution, was received requesting that provisions for fishing
at the new bridge be incorporated into the project.

COUNCILMAN MURPHY: NOTICE IS HEREBY GIVEN that public hearings will
beheld by the Town Board of the Town of Southold at the Southold
Town Hall, Main Road, Southold, New York, on August 25, 1981 as
follows : 3: 45 P.M. o' clock in the matter of the application of R. M.
Kammerer, Commissioner, Suffolk County Department of Public Works for
a permit under the provisions of the Wetland Ordinance of the Town of
Southold for permission to reconstruct bridge carrying New Suffolk
Avenue over West Creek at the New Suffolk in the Town of Southold.
I have a notice of publication from the Long Island Traveler-
Mattituck Watchman on the 13th and also from Troy Gustayson of the
Suffolk Times . I have a notice from Judith Terry, Southold Town
Clerk that this has been posted on her Bulletin Board.
There is a Negative Declaration concerning no significant effect
on the environment .
A letter from Anna Hataier, President of the Southold Town
Trustees: "Dear Mrs. Terry: The following action was taken by the
Board of Southold Town Trustees at a regular meeting held August 5,
1981: RESOLVED to recommend to the Southold Town Board aprpoval of
the wetland application of the Suffolk County Department of Public
Works, #70, for permit for reconstruction of the bridge carrying New
Suffolk Avenue over 'Vest Creek at New Suffolk. " Signed Anna Hataier .
SUPERVISOR PELL: Does anybody present wish to speak in favor of the
application before the Town Board from the Department of Public Works
to put a bridge over West Creek, New Suffolk? Yes, sir.
BILL LIFFERT, Suffolk County Department of Public Works: On behalf
of the Commissioner we would like to urge the Town Board to approve
our permit for the reconstruction of the bridge across West Creek.
The present bridge is in a deteriorated condition. It ' s now posted
for six tons and if the deterioration continues over the next few
years eventually it will have to be lowered to three ton. The bridge
also has some geometric deficiencies in addition to its structural
deficiencies and by approving our permit will enable us to rebuild
the bridge with a configuration that would be safer for the traveling
public. As examplified in our draft environmental impact statement
the County has made every effort to minimize the environmental effects
and take into account all various aspects of the community, in -proposing

the new bridge and therefore the ask for your speedy approval of
the permit so we can get on with the project . As was mentioned
earlier at the informational meeting held in May, the bridge will
be financed 80% by federal funds and the remaining 20% by local
funds, of which 15% of that will come from the state government .
So the county would only have to pay 57o.
SUPERVISOR PELL: Thank you. This bridge is just like the one you
held an information meeting for the New Suffolk Chamber, New Suffolk?
MR. LIFFERT: That ' s correct .
SUPERVISOR PELL: Does anybody wish to speak in favor of the bridge?
In favor of the bridge going over West Creek in New Suffolk? (No
response. )
Does anybody wish to speak in opposition to the application of
the bridge going over New Suffolk? (No response. )
Does anybody wish to be heard on the subject? Yes sir .
JOHN BLEAUT, New Suffolk: I am representing the New Suffolk Civic
Association and I am not speaking either for or against the bridge.
I just have been told to bring back some little more information
about the present state of the planning for the bridge. How wide
it ' s going to be, how'.many tons it is going to carry and what sort
of schedule is planned for it.
MR. LIFFERT: The new bridge will be 29 feet out to out. The road-
way will be a total of 26 feet rail to rail, which will consist of
two 10 foot lanes and two three foot shoulders. The bridge will be
the exact same length within inches of the existing bridge. The
existing bridge which consists of four spans will be replaced by
a bridge which consists of two. There will now only be one pier
in the center of the channel. The bridge will have four rail bridge
railing, a guide rail leading up to it . There will be resurfacing
in the local area to bring the road up to the elevation of the bridge
without the present dip in the road which exists at the intersection
with Jackson Avenue. The new bridge will be at the same elevation
and have the same clearance under it as the existing. One improvement
will be that there will be additional horizontal clearance due to the
removal of two of the piers, but in elevation the bridge would be
at the same elevation as the existing bridge.
MR. BLEAUT: That answers some of my questions. What weight will it
carry and will this be sufficient to carry school buses and fire
engines?
MR. LIFFERT: Yes. The new bridge will be capable of taking 36 ton
loads which are a full highway load. It ' s designed in accordance with
standard requirements for all bridges now a days so that every biridge
is capable of taking every vehicle presently allowed on the road by
law. As it'-is right now there will be no provisions for fishing on
the bridge. The existing is posted for no fishing. The results of
our various meetings with members of the community, the issue was
split perhaps slightly weighted towards no fishing and our position
right now is that we will reconstruct a bridge similar in nature--in

other words, we are going to keep the status quo. There are no
fishing signs posted on the ekisting bridge and right now we plan
to continue that . Are there any further questions?
MR. BLEAUT: No.

hearing closed.

Conservation Advisory Council at a regular meeting held August
25, 1981.
RESOLVED to recommend to the Southold Town Board approval

imum of 2 ' at M.H.W.
RESOLVED to recommend to the Southold Town Board approval
of Wetland Application #70 of R. M. Kammerer, Commissioner,
Suffolk County Department of Public Works to reconstruct bridge
carrying New Suffolk Avenue over West Creek at New Suffolk on
the condition that the board see the complete plans of construc-
tion and see it staked out before the job starts so that they
will know the construction limites of the project. Any wetlands
that are damaged must be put back in their natural state after
construction is completed.
RESOLVED to recommend to the Southold Town Board approval of
Wetland Application #71 of Agnes Pagnozzi to attach existing dock
to two new wood pilings and add two additional pilings for a hoist
for permanent use.

NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT
Dated: August 12, 1981
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6 NYCRR Part 617, Section
617. 10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Board, as lead agency for
the action described below, has determined that the project , which
is unlisted, will not have a significant effect on the environment .
DESCRIPTION OF ACTION
Application of R. M. Kammerer, Commissioner, Suffolk County
Department of Public Works, for a permit under the provisions of
the Wetland Ordinance of the Town of Southold, for permission to
reconstruct bridge carrying New Suffolk Avenue over West Creek at
New Suffolk in the Town of Southold. '
The project has been determined not to have a significant
` effect on the environment for the following reasons :
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment are likely to occur should the project be
implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation, it is assumed that there is no objection
nor comments by that agency.

A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by writter permission from the owner of the property if not
the some as the applicant, z
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to the Permit Application:)
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A del-ailed statement of the rehabilitation and proposed condition of the premises after the 1
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revolted or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection;
there is a $5.00 fee for each additional inspection.

14. The Town Board upon requestpp�j fl�mp applicant for a permit, may waive in whole or in part,
the provisions of Article I I, Sectionr7,`subdivisions and �g3-where it finds that nature of the
proposed operations are such that the requirements of such provisions ore not necessary for a
proper consideration of a permit application.
