The validity of this permit is or may be subject to the approval of other governmental or municipal',
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here
under until such approval has been obtained in writing. The failure to obtain such other approval when`
required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the
Town Clerk of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by-the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal 'waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

RECONSTRUCTION OF BRIDGE OVER MUD CREEK
A public hearing was held by the Town Board of the Town of
Southold at the Southold Town Hall, Main Road, Southold , New York,
at 3: 15 o'clock P.M. , Tuesday, June 9, 1981 in the matter of the
application of R.M. Kammerer, Commissioner of the Suffolk County
Department of Public Works , for a permit under the provisions of
the Wetland Ordinance of the Town of Southold , for permission to
reconstruct bridge carrying New Suffolk Avenue over Mud Creek,
Town of Southold, New York.

SUPERVISOR PELL: I will open the hearing on the construction
of a bridge over Mud Creek, New Suffo;l;k Avenue, New Suffolk. It will
be read by Councilman Murdock.
COUNCILMAN MURDOCK : NOTICE IS HEREBY GIVEN that a public hearing
will be ehld by the Town Board,`,,of the Town of Southold at the Southold
Town Hall, Main Road, Southold , New York, on June 9, 1981 as follows :
3: 15 P.M. in the matter of the application of R.M. Kammerer,
Commissioner of the Suffolk County Department of Public Works , for a
permit under the provisions of the Wetland Ordinance of the Town of
Southold, for permission to reconstruct bridge carrying New Suffolk
Avenue over Mud Creek, Town of Southold , New York.
I have an affidavit from Patricia Wood attesting to the publication
of notice , an affidavit from Troy Gustayson attesting to the publication
of notice. A letter from Frank Cichanowicz•, Cons,ervation Advisory Council:
"Dear Mrs . Terry: The following action was taken by the Southold Town
Conservation Advisory Council at a regular meeting held April 28, 1981 .
RESOLVED to recommend to the Southold Town Board approval of wetland
application of the Suffolk County Department of Public Works #62 for a
permit to reconstruct bridge carrying New Suffolk Avenue over Mud Creek
subject to strict adherence to revegation and restoration of all wetlands
as outlined in the Environmental Study prepared by the Suffolk County
Department of Public Works , such to be included in the contractor's

performance bond and final approval that same has been complied
with by the Southold Town Conservation Advisory Council. Signed

of Public Works #62 for a permit to reconstruct bridge carrying New

I also have a notice from Judith T. Terry attesting to the posting of
the notice on the Town Clerk 's bulletin board.
SUPERVISOR PELL : Thank you Larry. Does anybody wish to speak
in favor of the proposed bridge construction over Mud Creek?
The Department of Public Works is here to make a statement .
MR. PETER LIFFORD , Suffolk County Department of Works : About
a month ago we held an informational meeting in this room. At that
time the chief engineer pointed out the deteriorated condition of the
bridges makes it imperative that we do something in the next year or
so. At present the funding for the bridges will be 80% federal and
20% local funds of which- right now 15% is scheduled to come from the
state. We have already filed the environmental study with the Town
Board demonstrating that there would be minimal environmental effects
caused by the construction. We would like to re-state our position
that the County feels that they have done everything possible to
minimize the size of the bridge, at least on current design standards.
We ask for your approval of the application. Are there any questions?
COUNCILMAN FRANCIS MURPHY : How does the funding look? Like it
is going to gothrough?
MR. LIFFORD: At present, it does. Right now , the biggest
problem with the funding is our own capital budget. But with regard
to the federal situation, they are cutting back on road construction
funds. But there seems to be no indication on cutting back of bridge
construction funds.
SUPERVI,S;OR PELL : Thank you. Are there any other questions for
this gentleman?
MR. RUSSELL CASE : At that last information meeting, I brought up
the cost of the culverts? Have they ever received any information on
that?
SUPERVISOR PELL : I have received nothing from them.
MR . LIFFORD: There is no question in our mind that a culvert is
cheaper. We ruled out a culvert earlier in the design stage in Mud
Creek which is the only one we considered , due to, we were trying to
obtain an area of flow consistent with the area that exists to the
present bridge. Due to the shape of the culverts that you referred
to at the meeting, we would have had to have raised the road. One
of the problems we had with fitting in the bridge the way it is right
now, is that we didn 't want to encroach on private property. With the

necessary side slopes to get in a culvert, we would have had difficulty
fitting it in to attain the same total volume of flow throughlthe
culvert that we presently have through the bridges.
SUPERVISOR PELL : It is my understanding that the County is taking
the responsibility of the approaches and going away from the bridges.
MR. LIFFORD: Yes, that 's correct. It is all included in the
contract.
SUPERVISOR PELL : Does anybody else wish to speak in favor of the
proposed bridges?
(There wasno response. )
SUPERVISOR PELL: Does anybody wish to speak in opposition to the
proposed bridge construction at Mud Creek?
MR. RUSSELL CASE : I don ' t really want to speak in opposition to
it. I don ' t know where all these people are. I had it written down
on the calendar and my wife reminded. I just want to restate the
position of , the people that own the property and live around there.
Now, the Williamses have to have a bridge. They, in particular, feel
that if they had just as much bridge, that would be sufficient . I
think what I want to do is state their positions which makes this Board
absolutely independent. They can do what they want. But these people
don ' t care if, they have bridges or not, they would just as soon do with-
out and they ,4re the ones that are going to be inconvenienced the most .
Another thing that I have noticed there, in going back and forth to
Mattituck. The local people slow down for you on both sides . But if
you meet someone that is going through , they are always racing to get
ahead of you. It isn ' t the local people that are creating the problem,
it is the through traffic that is going to New Suffolk. But , I think
the feeling of the people who own property and live there is that they
don ' t care whether they get the bridges or not. That leaves you pretty
independent to do what you want.
SUPERVISOR PELL: Does anyone wish to speak, I 'm going to say in
opposition to the bridge at Mud Creek?
(There was no response. )
SUPERVISOR PELL: Does anyone else wish to be heard at all?
(There was no response. )
SUPERVISOR PELL: If not , I ' ll declare the hearing closed.

Re: Mud Creek Bridge and Downs Creek Bridge
Dear Ms. Terry:
In accordance with your recent letter, we are sending a voucher in
the amount of $50.00 for proper signature. This amount should cover
the permit application fees mentioned in your letter. We pay this under
protest since our department has always waived fees to the Town of
Southold and other municipalities throughout the County. Regardless of
what the Town Attorney says, the Town can certainly waive such a fee
when it is in the interest of the Town to do so.

Dear Ms. Terry:
In accordance with your recent letter, we are sending a voucher in
the amount,of $50.00 for proper signature. This amount should cover
the permit application fees mentioned in your letter. We pay this under
protest since our department has always waived fees to the Town of
Southold and other municipalities throughout the County. Regardless of
what the Town Attorney says, the Town can certainly waive such a fee
when it is in the interest of the Town to do so.

A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by writter permission from the owner of the property if not
the some as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of;adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to the Permit Application)
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.

F. A statement must accompany the application describing any known .prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.

G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection.
there is a $5.00 fee for each additional inspection.
H. The Town Board upon request applicant fa permit, may waive in whole or in part,
the provisions of Article Il, Secti,on9 subdivisions I and Orwhere it finds that nature of the
proposed operations are such that 'the requirements of such provisions are not necessary for a
proper consideration of a permit application.
