The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been lobtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the
Town Clerk of written notice from such other governmental or municipal authorities of its refusal or
disapproval.

The applicant does by the acceptance of,this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance:, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees. r
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit. -
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely.affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase-the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

A public hearing was held by the Town Board of the Town of
Southold at the Southold Town Hall, Bain Road , Southold , New York,
at 3:35 o'clock P.M. , Tuesday, June 9, 1981 in the matter of the
application of R.M. Kammerer, Commissioner of the Suffolk County
Department of Public Works , for a permit under the provisions of
t'he Wetland Ordinance of the Town of Southold , for permission to
reconstruct bridge carrying New Suffolk Avenue over Downs Creek,
Town of Southold, New York.

of a bridge over Downs Creek , New Suffolk Avenue, New Suffolk. If

COUNCILMAN MURDOCK: NOTICE IS HEREBY GIVEN that a public hearing
will be held by the Town Board of the Town of Southold at the Southold
Town Ha11, Main Road, Southold, New York, on June a9, 1981 as follows:
T:20 P.M. in the matter of the application of R.M. Kammerer,
Commissioner of the Suffolk County Department of Public Works, for a
permit under the provisions of the Wetland Ordinance of the Town of
Southold, for permission to reconstruct bridge carrying New Suffolk
Avenue over Downs Creek, Town of Southold , New York.
I have an affidavit from Patricia Wood on behalf of the L.I .
Traveler Watchman attesting to publication of the notice and from
Troy Gustayson publisher of the Suffolk Weekly Times attesting to

Dear Mrs. Terry: The following action was taken by the Southold Town
Conservation Advisory Council at a regular meeting held April 28, 1981 .
RESOLVED to recommend to the Southold Town Board approval of wetland
application of the Suffolk County Department of Public Works #63 for
a permit to reconstruct bridge carrying New Suffplk Avenue over Downs
Creek in the Town of Southold subject to strict adherence to revegetation

board in the town hall in the Town of Southold.
SUPERVISOR PELL: Thank, you -Larry. Does anyone wish to speak in
favor of the bridge over Downs Creek, the construction of the new
bridge over Downs Creek?

MR. PETER LIFFORD , Suffolk County Department of Public Works :
Mr. Pell, members of the Town Board. The County's position on Downs
Creek is similar to Mud Creek. We have a situation where the bridge
is in terrible need of repair to the point where it would be too
expensive to repair the existing bridge , as opposed to building a
new bridge consistent with the drawings that we havie already submitted
to you. We have already submitted the environmental study indicating
that there will be minimal environmental effects. With regard to those
submissions , we urge your approval of the application. Are there any
questions regarding Downs Creek bridge?
SUPERVISOR PELL : Any questions from the Board? Any questions
from the audience?
(There was no response. )
SUPERVISOR PELL: Does anybody else wish to speak in favor of
the bridge at Downs Creek?
(There was no response. )
SUPERVISOR PELL : Does anybody wish to speak in opposition?
MR. RUSSELL CASE : Again, not in opposition. But , I know they
were talking about starting a petition. The people who live adjacent
to it in that area where they would be affected the most by not having
it . They were talking about starting a petition not to have it. This
I am passing onto you, that information. The one worry seems to be with
one particular person is that if they open this up, then they'd have
kids going up there water skiing which one person found objection to.

INSTRUCTIONS FOR PERMIT"
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by writter permission from the owner of the property if not
the some as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to the Permit Application)
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by writter permission from the owner of the property if not
the some as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to,the Permit Application.')
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
