The validity of this permit is or may be subject to the approval of other governmental or municipal authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the event that such approval is necessary, the holder of this permit shall not commence operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the Town Clerk of written notice from such other governmental or municipal authorities of its refusal or disapproval. The applicant does by the acceptance of this permit, assume all responsibility for operations under- taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. Page 2 - Public Hearir i.,_-=- November 1, 1983 Wetlarid Application of the Suffolk County Department of Public Works SUPERVISOR PELL: Thank you. You've heard the reading of the application of the Department of Public Works for repairs of the Oaklawn Avenue Bridge over Jockey Creek. Does anybody wish to speak in favor of this application? (No response.) In opposition to it? MR. WILLIAM POLLERT, Southold, New York: I don't want to speak exactly in opposition to it. I just wonder if the Board knows what changes will be made in the present bridge? I just want to announce that the Southold-Peconic Civic Association has gone .on record in favor of the bridge change, which as little upset to the population as possible, but without any material change in the height, width, nature of the bridge as it is now. SUPERVISOR PELL: 1 believe the basic change is going to be raising the bridge one foot; three inches. MR. POLLERT: I heard that. Minimal, of course. SUPERVISOR PELL: That's the basic change. Other than that it's going to be practically---as much as I know right now at this time---as is. MR. BOB HUGHES, Greenport, New York: I'm here representing Ulrich Marine. I have a couple of things that I'd like to say on the bridge. At present the clearance is five and a half, foot at high tide. The federal government has deemed that the 100 year flood plain for this area is eight feet, and with the increase that is being proposed, the bridge would be a foot underwater-on the 100 year flood plain---the clearance of the bridge would be one foot underwater-. - I think this would indicate that the increase of one foot three inch is not really an adequate increase at this time, considering that this bridge has been here 50 years and it will probably be another 50 years before the bridge is updated once again. Also, it seems to me that there is a definite need for dredging of the creek while the bridge is down. We have a tremendous amount of silting that has occurred land- side of the bridge with the drainage coming from farms, and if you go down there after a heavy rain-you will notice that water actually does turn red. The other factors are that Southold Town and the North Fork in general does not have--- there are not going to be many more opportunities for marine facilities to be established or to be expanded, and this is something that is of great interest to the citizens of Southold and we all know the heritage of the water here, and with facilities that are marine service facilities being taken and converted into condominiums, of possibly, such as North Fork Shipyard in New Suffolk, Sweet's Shipyard, even though it has not been an active shipyard for many years, is another area where marine facilities could be used. I think it is going to become more and more important that the boating public have access to service facilities. And this is an opportunity to allow a larger size vessel to be able to avail them- selves of the facilities at _Ulrich Marine. In 1980 there was a petition that was signed by 36 residents of the creek and 78 boat owners who used the Ulrich Marine facilities, requesting 'that the bridge be raised to a minimum of 12 foot vertical clearance. In addition I have signatures of 27 other boat owners who have signed a petition since 1980 also attesting to their-desire to have the bridge raised at least to 12 foot vertical clearance at mean high tide. Anybody else wish to comment? 1 i Page 3 - Public Hearii - November 1, 1983 Wetland Application of Suffolk County Department of Public Works MR. JOHN WALLBERG, Southold, New York: My wife and 1 own the adjacent property to the Jockey Creek Bridge. We are very much in favor of the dredging as the representative of Mr. Ulrich said. That creek has silted in tremendously and it does have a very muddy appearance after any kind of a rainstorm. However, we're only here four years and it's only twice, maybe three times that we have had the water come up on our lawn from the creek on a high tide. It has never gone over the- bulkheading that the County put in when they built the bridge in 1935 That means we still have roughly five feet to go before the roadway will be underwater, and I don't think none of us will be living to see 100 years go by that it is covering the roadway. If the bridge is raised to 12 feet, .there's going to be a lot of inconvenience to the property adjacent to the road, grading will have to go back maybe to the school grounds and up past Pine Neck and condemnation, I'm sure, will be taking place because a lot of the property will be depreciated in value, which could never be recooped. SUPERVISOR PELL: Thank you. Anybody else wish to speak on this application at all? Anybody have any comments to make on it? Councilman Nickles wishes to speak. COUNCILMAN NICKLES: I think it's long past the time when the Town had any input--and if anybody on the Board wants to correct me--as to getting the bridge raised to 12 feet. The Town Board, I think, requested that several times over the last two years since the inception of the County bridge'study and proposal to reconstruct the bridge and the 1.3 is the net gain-of our efforts, which may seem insignificant relative to what was asked for, but in the overall consideraion of the adjacent property owners and dealing with the County Department 'of Public Works, this is the most we could gain out of that. We've always, from the day one, have .been requesting that the inlet, Jockey Creek, be dredged west of the bridge. We're well aware of the silting-in problem there, etcetera, and so on. As it relates to that we have to show some access for the public, which we're working on. So we're still pursuing, on the Town Board level, an effort to get the County to do some dredging in there, but I hope we!-re more successful than we were in coming up with greater elevation. SUPERVISOR PELL: Any..other comment on this application? MR. POLLERT: Just from a cosmetic point of view, regardless of how you build the bridge, nor how deep you dredge, you will always have a` brown layer after a rainstorm. This is just a natural function of the elements. Now, the amount of.silt that you get over the years, I suppose you need a mathematician to try to figure that out. It's insignificant, I'm sure, over a term or ten or twenty years. SUPERVISOR PELL: It depends on the rainfall. What is known as a run-off. COUNCILMAN MURPHY: This problem is going to be addressed. Mr. Dean is looking into acquiring property on the other side of Route 25 there so that a sump can be made so as to stop this farm run-off. MR. POLLERT: Well, there used to be a pond there. COUNCILMAN MURPHY: Right, and he's looking into possible acquisition, possible sump because we do have a tremendous drainage problem on that Lower Road that he's trying to control.
