The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the
Town Clerk of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims-arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees. '
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

COUNCILMAN MURDOCK: "Notice is hereby given that public hearings will
be held by the Town Board of the Town of Southold at the Southold Town
Hall, Main Road, Southold, New York, on January 19, 1982, as follows:
3: 30 P.M. o'clock in the matter of the application of Enconsultants,
Inc. for Strong' s Marine Center for a permit under the provisions of
the Wetland Ordinance of the Town of -Southold for permission to construct
a 190 ft. section of bulkhead in line with and connected to partially
completed existing bulkhead and backfill with approximately 40 cubic
yards of clean fill to be trucked in from upland source. This bulkhead
will be in inner portion of marina. Construct a total of 70 ft . of timber
bulkhead to connect to existing bulkhead on outer portion of marina to
control scouring of backfill from existing bulkhead. Property located
off Camp Mineola Road, on James Creek, Mattituck, New York. "

Letter from the Southold Town Conservation Advisory Council to
Mrs . Judith T. Terry, Town Clerk. "Dear Mrs. Terry: The following
action has been taken by the Southold Town Conservation Advisory
Council at a regular meeting held December 8 , 1981. It is the
recommendation and suggestion of the CAC that the Wetland Application
of Strong' s Marine Center, #78, extend the bulkhead of the plans sub-
mitted another 10 feet to help stabilize the erosion problem. " Signed

services to be furnished to users of the marina: fresh water, sale
of gasoline (already permitted), minor motor and boat repairs sale
of fishing tackles bait., and soft drinks and sandwiches from the
old accessory building. Permission is specifically DENIED to
operate a restaurant as defined by the Board of Health.
C. No building permit may henceforth be issued for
additional construction of any kind related to marina use on this
property without the- specificauthorization of the Board' .of Appeals
in writing.
2. The Board reserves the right to review and evaluate all
uses which have been permitted to date in order to insure their
compatibility with the surrounding use area under the reasoning
set forth in this decision.

Dear Mr. Cole:
Pursuant to this morning's meeting between myself, David Strong,
and David Fallon of the DEC, we are hereby amending our request as follows:
1. The inner bulkhead will be relocated 21', ft. tow"- do the shore
for the remaining 190 ft. between the existing unfinished bulkhead on the
south and the boat ramp on the north.
2. A 15'= ft. return will be installed at a diagonal off the
proposed bulkhead near the gas pumps on the south side of the property.
Both of these changes have been indicated on the attached
amended work plan. We look forward to your prompt issuance of the
permit.

The following action has been taken by the Southold Town
Conservation Advisory Council at a regular meeting held December 8,

RESOLVED to recommend to the Southold Town Board approval of
Wetland Application #79 submitted by Enconsultants, Inc. a/c Sal
McCarthy to construct a catwalk, hinged ramp and floating dock
secured by two piles. Property located at 40 Fox Hollow Road,
Mattituck.
It is the recommendation of the CAC that the Wetland Application
x#80 of Enconsultants, Inc. for Neil Simon be disapproved until the
CAC has been informed as to what will happen to the wetlands located
in front of the bulkhead once this application has been approved.
What guarantee is there that the wetlands will not be destroyed once
the bulkhead is in.
It is the recommendation and suggestion of the CAC that the
Wetland Application of atrong's Marine Center. #78. extend the bulkhead
of the plans submitted another 10 feet, to help stabilize the erosion
problem. Attached please find a copy of the Council' s recommendations.

This applic::tion docs not indicate just how the seventy feet of bulkhead
at the entrance to the marina would :
1) Control erosion at the site , and;
2) Prevent further erosion of adjacent wetlands.
The proposed cunfi guration of the bulkhead would seemto create another
erosion problem similar to the one to be corrected. The prevailing winds,
and storks during the winter, core from the northwest . The pre.ent erosion
problem appears to be the result of the action of wind driven waves and boat
,cakes on the land to the rigiit of and immediately behind the existing
bulkhead . The force of the waves at high tide is sufficient to scour the
fill behind the bulkhead. This clave seti.on may also be the reason why the
wetIead --rases which fringe and protect the shoreline to the north of the
bulkhead have been dammed or destroyed .

NEGATIVE DECLARATION
NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT
Dated: December 8, 1981
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR, Part 617, Section
617. 10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Board, as lead agency for
the action described below, has determined that the project , which
is unlisted, will not have a significant effect on the environment.
DESCRIPTION OF ACTION
Application of Strong' s Marine Center for a Wetland Permit for
permission to construct a 190 ft . section of bulkhead in line with
and connected to partially completed existing bulkhead and backfill
with approximately 40 cubic yards- of clean fill to be trucked in from
upland source. This bulkhead will be in inner portion of marina.
Construct a total of 70 ft . of timber bulkhead to connect to existing
bulkhead on outer portion of marina to control scouring of backfill
from existing bulkhead. Property located off Camp Mineola Road, on
James Creek, Mattituck, New York.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted with
indicated that no significant adverse effects to the
environment are likely to occur should the project be
implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation, it is assumed that there is no objection
nor comments by that agency.

Enclosed is application of Strong` s Marine Center for a
permit under the• provisions of the Wetland Ordinance of the
Town of Southold for permission to construct a 190 ft . section
in line with and connected to partially completed existing bulk-
head and backfill with approximately 40 cubic yards of clean fill
to be trucked in from upland source. This bulkhead will be in
inner portion of marina. Construct a total of 70 ft. of timber
bulkhead to connect to existing bulkhead on outer portion of marina
to control scouring of backfill from existing bulkhead. Property
located off Camp Mineola Road, on James Creek, Mattituck, New York.
This project is unlisted and our initial determination of
non-significance has been made and we wish to coordinate this,-
action to conform our initial determination in our role as lead
agency.
May we have your views on this matter. Written comments on
this project will be received at this office until November 30,
1981. We shall interpret your lack of response to mean there is
no objection by your agency.

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by written permission from the owner of the property if not
the some as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to the Permit Application)
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection,
there is a $5.00 fee for each additional inspection.
H. The Town Board upon request f he applicant f r a permit, may waive in whole or in part,
the provisions of Article II, Sectiorq subdivisions ( and ('where it finds that nature of the
proposed operations are such, that the requirements of such provisions are not necessary for a
proper consideration of a permit application.
I. Upon approval of this application the Town Clerk will issue a permit to the applicant. Such
permit shall be available for inspection at any time, upon request.
