The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, th'e holder of this permit shall not commence operations here-
under until such approval has been obtained in writing.-The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the
Town Clerk of written notice from such other governmental or municipal,authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees'.-
The
mployees:The applicant and the owner and occupants of the premises upon which the operations auth'orized'by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town m'ay deem necessary to insure that such operations are being con- .
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D., Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course-of any channel or the natural movement or flow of any-waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

will be held by the Town Board of the Town of Southold at the
Southold Town Hall, Main Road , Southold, New York, on February 23,
1982 at 3: 35 P.M. o' clock in the matter of the application of
Enconsultants, Inc. on behalf of Neil Simon for a wetland permit
to construct 190 lin. ft . of timber bulkhead generally above line
of MHW, except on the southerly side where it will tie into the
corner of existing bulkhead. Construct a 10 ft . return on the

Terry: The following action has been taken by the Southold Town
Conservation Advisory Council at a regular meeting held January 26,
1981: RESOLVED to recommend to the Southold Town Board approval of
the wetland application of Enconsultants, Inc. for Neil Simon to
construct bulkhead to existing bulkhead and to truck approximately
200 cu. yds. of clean sand fn for backfill. Council received a
letter from Mr. Simon in response to the Council' s recommendation
.of the December 8, 1981 meeting. It was an adequate answer to our

SUPERVISOR PELL: Thank you. You heard the reading of this applica-
tion of Neil Simon. Does anybody wish to be heard in favor of the
application? Mr. Haje.
MR. ROY HAJE, President, Enconsultants, Inc. for the applicant Neil
Simon: The project as proposed is to stabilize a shoreline which is
experiencing a slight bit of erosion. The main purpose for the
project, however, is to stabilize the bluff that lies in back of
the proposed bulkhead. As we have situated it a small amount of
periperal marsh grass will be allowed to remain in front of the
bulkhead. Only a very small section as has been mentioned on the
southside will tie into the existing bulkhead at its corner so as
to prevent any kind of eddy action. Other permits have been issued
or shortly,:-till be issued and we urge you to approve the project .

The following action has been taken by the Southold Town Conservation
Advisory Council at a regular meeting held January 26, 1981.
RESOLVED to recommend to the Southold Town Planning Board that the
application of James W. Dawson for a minor subdivision at Bayview be
tentatively approved after an individual evaluation has been made.
RESOLVED to recommend to the Southold Town Board approval of the
wetland application of En-Consultants, Inc. for Neil Simon to construct
bulkhead to existing bulkhead and to truck approximately 200 cu. yds. of
clean sand in for backfill. Council received a letter from Mr. Simon in
response to the Council's recommendation of the December 8, 1981 meeting.
It was an adequate answer to our questions.
RESOLVED to recommend to the Southold Town Board approval of the wetland
application submitted by Enconsultants, Inc. on behalf of William LaMorte to
maintenance dredge and place resultant 975 cu. yds. of fill behind proposed
upland retaining wall to be constructed on southerly part of parcel.
RESOLVED to recommend to the Southold Town Board approval of the wetland
application submitted by Enconsultants, Inc. for Matt-a-mar Marina to con-
struct 35 ft. by 5 ft. section of floating dock plus mooring pile extending
from the south —st corner of the property.
RESOLVED to recommend to the Southold Town Board approval of the wetland
application submitted by Enconsultants, Inc. on behalf of Walter Silbernagel
mconstruct a timber dock and elevated catwalk.
RESOLVED to recommend to the Southold Town Board approval of the wetland

Re: Tidal Wetlands Appli. No. TW-15276-0373, Neil Simon
Dear Mrs. Terry:
The location of the proposed retaining wall for Mr. Simon
was selected taking into accourft the presence of a narrow marsh fringe
along the property. The installation of the retaining wall will allow
for the continued presence of the marsh seaward of it. There are many
instances in the Town of Southold and elsewhere where this occurs and
it is quite a common construction practice.
I would refer you to the decision of the DEC in this
matter and felt that the proposal was reasonable and would cause no
undue damage to wetland resources.
Would you please reschedule this matter and inform me
of the new date.

effect on the environment for the following reasons :
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment are likely to occur should the project be
implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation, it is assumed that there is no objection
nor comments by that agency.

The following action has been taken by the Southold Town
Conservation Advisory Council at a regular meeting held December 8,
1981.
RESOLVED to recommend to the Southold Town Board approval of
Wetland Application #79 submitted by Enconsultants, Inc. a/c Sal
McCarthy to construct a catwalk, hinged ramp and floating dock
secured by two piles. Property located at 40 Fox Hollow Road,
Mattituck.
It is the recommendation of the CAC that the Wetland Application
#80 of Enconsultants. Inc. for Neil Simon be disapproved until the
CAC has been informed as to what will happen to the wetlands located
in front of the bulkhead once this application has been approved.
What guarantee is there that the wetlands will not be destroyed once
the bulkhead is in.
It is the recommendation and suggestion of the CAC that the
Wetland Application of Strong's Marine Center, #78, extend the bulkhead
of the plans submitted another 10 feet, to help stabilize the erosion
problem. Attached please find a copy of the Council' s recommendations.

A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by vvritter permission from the owner of the property if not

B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to the Permit Application)
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection,
there is a $5.00 fee for each additional inspection.
H. The Town Board upon request t e applicant for a permit, may waive in whole or in part,
the provisions of Article 11, Section9 subdivisions* and 0-r here it finds that nature of the
proposed operations are such that 'the requirements of such provisions are not necessary for a
