Dear Mr. Techet:
Mr. Silverman and Dr. Cartnick have asked meas their
. agent,to write you about their intent to file a new appli-
cation for dredging the basin as formerly proposed and a
catwalk and floating dock to the Southold Town Board of
Trustees .
Before filing this new application, they are requesting
from you in writing your suggestions or alternates to the
initial application. Your objections to the past requests
for dredging and a catwalk and dock were complied with by
Mr. Silverman, therefore it is imperative that you respond with
the above suggestions or alternates that Dr. Cartnick and Mr.
Silverman will be satisfied with on this new application.
The last design worked out by Mr. Haje and Mr. Samuels
showing a floating dock going straight from the property
36 feet out, with a mooring piling out beyond the dock
16 feet seems to be the best design to date ® The piling to
be removed when Mr. Silverman disposes of his present yacht. ;
They are asking you for a reply by November 14, 1983 ,
so that they may get on the agenda for the Southold Board of
Trustees meeting of December 6, 1983 .

At the November 2 , 1983 meeting of the Board of Town
Trustees, the following Resolutions were made in respect
to the applications of Daniel Silverman for Trustee and
Wetland Permits—
On motion made by Henry Smith seconded by John Bednoski it was
RESOLVED to rescind the Resolution adopted on June 7, 1983
granting Daniel Silverman a Trustee permit.

On motion made by Henry Smith seconded by John Bednoski it was
RESOLVED to rescind the Resolution adopted on June 7 , 1983
recommending to the Town Board Approval of the Wetland
Application of Daniel Silverman.

Gentlemen:
I am unable to move forward with a Town Board decision
on the application of Daniel Silverman (No. 144) for a Wet-
land Permit, as there seems to be a conflict in your decisions.
On June 7, 1983 you recommended approval of the Wetland
Application with certain conditions and assurances. The
assurances were subsequently received. At your October 11th
meeting you denied the Trustee application, which had been
previously granted on June 7th, without rescinding your
prior decision. ,
We now have a recommendation of approval on the Wetland
Application which states, "Resolved to recommend to the
Southold Town Board APPROVAL of the application # 144 submitted
by Enconsultants, Inc. on behalf of Daniel Silverman to maint-
enance dredge to 5 ' below MLW and to construct a timber dock
consisting of a fixed elevated catwalk, hinged ramp and three
floats in Wunneweta Pond, with the stipulation that the dredging
is to be done to a depth of 32 feet below normal high water after
the two landowners are assured that no harm will come to: 1 .
fresh water supply, 2. road, 3. bulkhead. Mr. Silverman is to
sign a letter stating that the aforementioned be protected. "
Do you feel the prior Wetland recommendation to the Town
Board should be rescinded and a new recommendation made? I

The regular meeting of the Board of Town Trustees was
held on Tuesday, October 11 , 1983 at the Town Hall, Main
Road, Southold.
Present: President Paul Stoutenburgh
Vice-President Frank Kujawski

President Stoutenburgh called the meeting to order.
On motion made by Henry Smith seconded by John DiVello and
carried, the minutes of the September 13th meeting were approved.
A discussion was held in reference to the project of Armando
Cappa, Armando' s Seafood, in Southold. President Stoutenburgh
was concerned with the maintenance of the drains that will be
installed. It was suggested that this information be recorded
in a book of record, so that a yearly inspection can be made.
On motion made by Henry Smith seconded by John DiVello and
carried, the mooring renewal permits for the month of November
were approved.
A discussion was held in reference to the mooring permit of
Mr. Conrad Volinski, Sr. It was decided that, ,due to the death
of Mr. Volinski, Sr. , this mooring shall be turned over to his
son, Conrad Volinski, Jr. , seeing that he has been paying the
renewal fee.

RESOLVED to deny without prejudice the application of Daniel
Silverman to maintenance dredge and to construct a catwalk, ramp
and float in Wunneweta Pond, Cutchogue.

There was a discussion held in reference to the aforementioned
application: It was decided that since the landowners were
not in agreement with this project, it could not be granted. If
at a later date all parties can come to agreement, the application
can come before the board again.

In compliance with the Southold Town Board of Trustees'
request, I , Daniel Silverman, do hereby certify to the follow-
ing;
mater samples are to be tested for salt water intrusion
from water wells of Mr. Frank Techet and Mrs . S . Huyler Llderd
before commencing of the proposed dredging project. One month
after total completion of dredging, the same wells of above
owners will be tested again for salt water intrusion, all
testing to be under the supervision of an approved Lab (ap-
proved by Suffolk County Health Department) . If the water
quality is found to be further deteriorated by salt water
intrusion, I , Daniel Silverman, will at my expense move
either or both wells to another location on property of either
or both owners or on land of right-of-way that either or both
owners have the right of to Wunneweta Road.
I , Daniel Silverman, also certify that after inspection
by proper authorities of present right-of-way , before dredging
begins, and inspection by same proper authorities after project
completion, will repair any damage to right-of-way caused by
dredging project. I also will repair or replace the present
bulkhead at channel entrance to basin (bulkhead length of
32+ - feet) if same collapses due to dredging channel erosion
and toe failure , not material failure , toe failure period five
(5) years . 'Present bulkhead is approximately 8 to 10 years old.
Southold Town Board of Trustees will be notified ten days
before project is started so that road inspection, conditions
of water in above wells, and condition of bulkhead at channel,
may be noted.

SUPERVISOR PELL: We move on to hearing number four, scheduled
at 3: 07. Again Enconsultants, Inc. , on behalf of Daniel Silverman
to construct a dock, catwalk, ramp and three floats and dredge at
Wunneweta Pond, Cutchogue, New York. If_nobody -objects, we will
waive the reading of the public notice.
MR. ROY HAJE, President , Enconsultants, Inc. : I speak for the
applicant Daniel Silverman. The project has been approved by
the D.E.C. and also the Southold Town Trustees, who have recommended
favorable attention by the Town Board for their Wetlands considera-
tion. We request that the dredging be done in order to allow
sufficient depth to dock Mr. Silverman' s boat and the dock itself
will be for his personal use. There will be no destruction of
wetlands or environmental effects and we ask your favorable review.
SUPERVISOR PELL: Thank you. Anybody else wish to speak in favor
of this application of Daniel Silverman? (No response. ) In
opposition to it? Yes, sir? Please come up and state your name.
MR. FRANK TECHET, Nassau Point , Cutchogue: This gentleman just
said that it was approved by the Town Trustees. As far as I 'm
concerned, it hasn't been approved because I have it listed right
here and it ' s not to approve it until they get permission from
me to okay it, because they have to give me an okay on my bulkhead,
the bulkheads there that will not be destroyed, also my water and
also a roadway that comes down to where they have to do all the
work and move about 1200--1400 yards of so-called muck--the top-
soil out here. Second of all--here they are putting in a lumber
yard, as I call it , in a small area. I don 't know if anybody is
familiar with the area where this particular dock is to be put in.
They 're going to put in something and usurp about one-third of
the pond by the time they put the bulkheading in---not the bulk-

heading-=the docks in there and the catwalk, and the boat on the
small pond and it really isn't the proper place for something like
this. I believe in somebody having a dock if it was the proper
size for a small boat , but not to move in a 50 foot yacht into a
place that is only about 130 feet wide. And there are two other
owners on this here dock, one of them is Hagen Baylis, who you
will probably hear from, who never received any notices until
recently, .and it hasn't been approved by the Army of Engineers,
and it hasn' t been approved by the Town Trustees. It hasn 't
of last week when I talked to Mr. Stoutenburgh himself . He
said it was not approved. So I don't know who' s right or who ' s
wrong.
TOWN CLERK TERRY: I have a letter from the •Town Trustees: "--at
a regular meeting held on June 7, 1983: Resolved to recommend to
the Southold Town Board approval of the application #144 submitted
by Enconsultants, Inc. on behalf of Daniel Silverman to maintenance
dredge to 5 ft . below MLW and to construct a timber dock consisting
of a fixed elevated catwalk, hinged ramp and three floats in Wunneweta
Pond, with the stipulation that the dredging is to be done to a depth

letter, they're asking him to sign a letter assuring that there
will be no damage.
COUNCILMAN TOWNSEND: I have a copy of a letter from Mr. Silverman
assessing the fact that he would be responsible for any damage to
water and so forth. It was in our mail.
SUPERVISOR PELL: Thank you. Anybody else wish to speak in
opposition to this application?
MR. WILLIAM SMITH, Southold: I would like to speak to tell you
what has happened with the letter. I 'm a broker involved in
this project, and I was at the meetings and so on with the
Trustees, and Mr. Silverman has written a letter to the Trustees
and through error it took care of the well and took care of the
road, but not of Mr. Techet ' s bulkhead, and Mr. Silverman is
going to write another letter in relation to' the first letter
guaranteeing;,, and he spoke to Mr. Samuel ' s of Rambo and he is
guaranteeing that anything happens to the bulkhead he will take
care of the bulkhead or whatever damage.
SUPERVISOR PELL: Thank you. We have to wait until we get these
communications from the Trustees. Anybody else wish to speak in
opposition to this application or be heard at all on this applica-
tion of Daniel Silverman? (No response. ) If not , I declare the
hearing closed.

State Environmental Quality Review and 6NYCRR Part 617, Section
617. 10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Board, as lead agency for
the action described below, has determined that the project , which
is unlisted will not have a significant effect on the environment .
DESCRIPTION OF ACTION
Application of Enconsultants, Inc. on behalf of Daniel Silverman
for a Wetland Permit to construct dock, catwalk, ramp, three floats,
and dredge at Wunneweta Pond, on Wunneweta Road, Nassau Point ,
Cutchogue, New York.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effect to the environment are likely to
occur should the project be implemented as planned.
Because there has been a response from the Board of Southold
Town Trustees and Southold Town Conservation Advisory Council indicating
that this project would not have a significant effect to the environment .
Because there has been no response in the allotted time from the
New York State Department of Environmental Conservation and the Southold
Town Building Department , it is assumed that there are no objections nor
comments from those agencies.

E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question 'and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection.
