The validity of this permit is or may be subject to the approval of other governmental or municipal authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the event that such approval is necessary, the holder of this permit shall not commence operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the Town Clerk of written notice from such other governmental or municipal authorities of its refusal or disapproval. The applicant does by the acceptance of this permit, assume all responsibility for operations under- taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon which the operations authorized by this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and its officers and employees to enter-upon the premises where such operations are being conducted to make such inspections as the Town may deem necessary to insure that such operations are being con- ducted in conformity with this permit. This operation will not substantially: A. Adversely affect the wetlands of the town. B. Cause damage from erosion, turbidity or siltation. C. Cause saltwater intrusion into the fresh water resources of the town. D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege- tation or the natural habitat thereof. E. ' Increase the danger of flood and storm-tide damage. F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town. G. Change the course of any channel or the natural movement or flow of any waters. H. SCHLUMPF A public hearing was held by the Southold Town Board at the Southold Town Hall, Main Road, Southold New York at 8 : 10 o ' clock P.M. , Tuesday, on May 6, 1980 in the matter of the application of Richard A. Schlumpf for a permit under the provisions of the Wetland Ordinance of the Town of Southold. Present were : Supervisor William R. Pell III Councilman Henry W. Drum Councilman John J. Nickles Councilman Lawrence Murdock, Jr . Councilman George R. Sullivan Town Clerk Judith T. Terry Town Attorney Robert W. Tasker SUPERVISOR PELL opened the hearing at 8 : 10 P.M. COUNCILMAN DRUM read the legal notice of hearing as follows : NOTICE IS HEREBY GIVEN that a public hearing will be held by the Town Board of the Tonw of Southold at the Southold Town Hall, Main Road, Southold, New York at 8 : 10 o ' clock P .M. , on Tuesday, May 6, 1980 in the matter of the application of Richard A. Schlumpf for a permit under the provisions of the Wetland Ordinance of the Town of Southold for permission to construct a catwalk and floating dock for the purpose of mooring a boat, at Howard' s Creek, Home Pike Road, Lot # 1, "Map of Point Pleasant", Mattituck, New York. All persons interested in said matter shall appear at the time and place above specified and will be given an opportunity to be heard. I have a letter from the Southold Town Conservation Advisory Council dated April 8, 1980 addressed to the Town Clerk Judith T. Terry :which reads as follows : "In answer to your request for a report of findings and recommendations with respect to wetland application #46 for Mr. Richard A. Schlumpf, we submit the following: The Conservation Advisory Council took the following action at a regular meeting held March 25, 1980. RESOLVED to recommend to the Southold Town Board approval of Wetland Application No . 46 of Richard A. Schlumpf to construct a catwalk over wetlands at private property, of the applicant at Howard' s Creek. Yours truly, Frank Cichanowicz III . I also have a letter from the Board of Town Trustees, dated April 8, 1980 and it reads as follows : "The following action was taken by the Southold Town Trustees at a regular meeting held April 2, 1980. i (2) PUBLIC HEARING May 6, 1980 WETLAND ,APPLTCATION #46.-RICHARD A. SCHLUMPF RESOLVED to recommend to the Southold Town Board approval of Wetland Application No . 46 of Richard A. Schlumpf to construct a catwalk over wetlands at private of the applicant at Howard' s Creek with the condition that the width of the catwalk and ramp be limited to three feet . Signed Anna Hataier, President of the Board of Town Trustees . SUPERVISOR PELL: Thank you Councilman Drum. You heard the reading of the legal notice. At this time I would like to ask if anybody would like to speak or be heard in favor of the application? To speak on behalf and for the application. Would you please rise and state your name . RICHARD A. SCHLUMPF: My name is Richard A. Schlumpf . I was not present at that prior meeting but I do have a letter which I would like to submit to the Board at this time that sets forth my reasons for a request for a four (4) foot wide catwalk. If you would like me to explain at this time, I will do so . SUPERVISOR PELL: Yes sir, please. RICHARD A. SCHLUMPF: My concern is based on the reasons that it would be both hazardous and not in conformity with either-.the-. recognized standards or existing similar structures in the immediate vicinity. It should be noted first that the proposed pile supported catwalk will be so located as to cross only a six (6) foot wide stretch of grass on the property and the major portion of the catwalk covers ground surface area which is visible only at extreme low tide which does not support any grass or vegetation, and I believe that that was the Trustees concern at that time. To satisfy any requirements to emit sunlight to the area below the catwalk, you should be assured that a half inch (Z") space can be left between the deck planks and the height of the catwalk above the marsh fringe will emit sunlight at varying angles . I made a tabulation of private docks, May 3rd, within a two (2) mile radius of the actual site and out of 26 docks which are constructed from a permanent standpoint with treated timber piling that is driven through at a bearing capacity and performed by a reputable construction outfit, I determined that 22 out of 26 are 4 ft . wide or wider, including the town dock which is 5ft . 3 in. and there are four which are 3 ft . wide . I have a sketch enclosed. My--concern as to the hazardous nature of a catwalk of less than four (4) foot arises out of four or five reasons which I have set forth. The first of which is that I myself have childj�en­ that are young and they intend to fish off of this catwalk itself and I feel that with a three (3) foot wide catwalk no one will be able to pass behind them and they will not be able to pass behind one another and it would be dangerous if someone brushed against one of them. Secondly, I feel that loading and unloading a pleasure boat involves people carrying gear across the catwalk and normally you are carrying heavy items such as fuel tanks, tool boxes, ice chests, folding chairs and so forth, and usually you are carrying them in both hands so that if you had a three (3) foot wide catwalk with the pilings extending above the deck area, you would probablt have to walk sidewards or you would carry the gear in front of you which would mean that you can 't see where you are stepping and you could have a tripping hazard. Thirdly, my father-in-law is an avid fisherman and he would expect to make use of the facility and he is' also a retired senior citizen and r (3) PUBLIC HEARING May 6, 1980 WETLAND APPLICATION #46-RICHARD A. SCHLUMPF he has a handicap. I have attached a copy of the handicap parking permit because he uses a walking cane. At times he must be assisted. I feel that a three (3) foot width precludes any such assistance since it automatically restricts people to walking in a single file . My fourth point that I brought up is that an adequate means of safe and rapid egress, I feel should be provided from a floating dock, in case of an emergency because of the risk of fire aboard a boat or explosion from gasoline vapors . And even if the accident does not occur at the dock itself and if it does occur on the open waters it would require returning to the dock and trying to get the victim on shore and if it necessitates someone assisting that individual , it can ' t be done on a 3 foot wide catwalk. I have researched through the New York State Building Code which sets forty-four (44) inches as minimum for any stairs, ramps , etc . which uses emergency fire exit's. Of course, this is in buildings. There is no code for catwalks, but that particular measurement is derived from twice the width of the average individual which they take as 22 inches, so they take 44 inches and they apply that in cases in buildings, but this is the basis of why I feel that the New York State Department of Environmental Conservation is agreeing with four foot as the accepted width and as a standard and which was agreed upon by the Army Corps of Engineers. Also, the American Institute of Architects, in the graphic standards, also depicts catwalks typically four (4) foot wide. I feel that because of the generally recognized standards that I have cited above and because of the existing structures in the vicinity, I am concerned that._a restriction of the proposed facility to a sub-standard width of less than four foot could conceivably result in culpritability and legal liability for me in the event of a accident or any injury to any guests of mine. For that reason I request approval of the four (4) foot width. SUPERVISOR PELL: Thank you very much. Does anyoen else wish to speak on behalf of the applicant? ROY HAJE, En-Consultants, Inc. : Yes, my name is Roy Haje . My firm is En-Consultants, Inc . , Southampton. I assisted Mr . Schulmpf in preparing his application to the town, to the state and to the Corps of Engineers. I would point out that the four (4) foot width is a standard recognized width by both the State Environmental Conservation Department for recreational docks, and the Corps of Engineers. The State has already issued their permit for this structure for a four (4) foot wide width. The comment period has expired for the Corps of Engineers; without, to my knowledge, any adverse comment . and that I am awaiting receipt of that permit, which I assume will be issued as it was requested for the four (4) foot width. Now, therefore, I would again request that the Town also issue a permit for what was granted, which is four (4) , which in my opinion is not excessive, but would be standard for a dock of this type. A width of only 3 ' would necessitate that a person laden with a typical amount of gear in both hands walk partially sideways in order to clear the unser ends of the riles or else carry thea equipment in front of him instead of to the side. In either case , there is a serious potential tripping hazard resulting from the inability to see where one is steppinn. 3. The question of safe use by a handicapped person is involved. y father-in-law, rtr. Kurt Issem, who is an avid fisherman and would no doubt expect to make use of the facility, is a retired senior citizen who has a handicap involving walking ( a copy of his Handicapped Parking Permit is attached) . lie walks with the use of a walking cane and at times must be assisted, A 3' width 'Mr-mol precludes any such assistance since it automatically restricts people to walking in a single file. 4. All Building; codes, including the New York State Building Construction Code , have set 44" as the minimum *,=7idth for stairs, ramps, etc. which are used as fire or e_,;erge-?cy exits. This figure is derived from the unit of measarem.ent for -Ta which is 7enerally specified as a multiple of 22" , the 22" measurement, havingr been determined to be the shoulder width of an average man. 'While the code mandates :minimum widths for passageways within building' an understanding of its purpose can lead to an appreciation_ of why a width of 4' has come to ' e the accepted standard and norm for over-the-water residential catwalks by the ?r'.3DMC. and agreed 1zpon by the Army Corns of Engineers. The Architectural Graphic Standards comp' led by the American Institute of Architects also dericts typical boating catwalks with widths of 41 . 5. In view of the generally recognized width standards cited above, I am concerned that restriction of the proposed facility to a substandard width of less than 4' could conceivably result in culpability and legal liability for me in the event of accident or injury to a guest.
