The validity of this permit is or may be subject to the approval of other governmental or municipal authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the event that such approval is necessary, the holder of this permit shall not commence operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the i Town Clerk of written notice from such other governmental or municipal authorities of its refusal or disapproval. The applicant does by the acceptance of this ,permit, assume all responsibility for operatio ns'under- taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the'Town, and'its officers, agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon which the operations authorized by this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and its officers and employees to enter upon the premises where such operations are being conducted to make such inspections as the Town may deem-necessary to insure that such operations are being con- ducted in conformity with this permit. This operation will not substantially: A. Adversely affect the wetlands of the town. B. Cause damage from erosion, turbidity or siltation. C. Cause saltwater intrusion into the fresh water resources of the town. D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege- tation or the natural habitat thereof. E. Increase the danger of flood and storm-tide damage. F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town. G. Change the course of any channel or the natural movement or flow of any waters. H. Weaken or undermine the lateral support of other lands in the vicinity. I. Otherwise adversely affect, the health,safety and general welfare of the people of the town. Terry, Town Clerk Re: Wetland Permit of Robert V. Rider, Jr. Attached hereto is a letter from Philip J. Cardinale, who has purchased the property of Robert V. Rider, Jr. Mr. Rider has a Wetland Permit, No. 101, which expired on May 10, 1984. Mr. Cardinale now asks that the Rider permit be extended to- June 30, 1985. You will also see correspondence from Town Trustee President Henry Smith advising Mr. Cardinale that he must reapply for a new Trustee permit. Since Mr. Cardinale is the new owner of the property, and work was not commenced by Mr. Rider under his permit, I believe Mr. Cardinale should apply for a new wetland permit in his 'own name. Rider, Jr. to construct a 4 x 50 ft . catwalk, 6 x 12 ft . floating dock, 3z x 12 ft . ramp, and to dredge 30 ft . to a depth of 6 ft . with the provision that the ratio of one to three is used in dredging. " And I notice in their minutes they say: "Recommend that the application of Robert V. Rider, Jr. #115 be revised and resubmitted. Spartina grass cannot be removed and fill cannot be placed on wetlands. Request new application be sub- mitted clarifying how this project will be done. Hallock estate. This unusual tract of 7.4 acres includes upland, creek bottom, salt meadow, and Peconic Bay beach. It is situated west of Minnehaha: Blvd. and the Southold_ Town launching ramp on the west branch of Corey CreeY* The waters east ofmy line are navigable at all tides. On the property adjacent to the launching ramp G;Moyle maintains a catwalk and floating dock withi two boats. Next.to-him O.Yaro has a fixed dock with pilings. To the vest of my property is 'the former Mott estate developed by H.Smith as. Nunnakoma Estates with &- dredged boat basin terminating -the w est branch and-containing anumber of floating docks. The creek waters within my borders are quite shallow, and for most boasts can only be navigated at high tide. To date, I have used an exiating fixed dock on the westerly half• of the .property to moor a+ centerboard sailboat which rested on the bottom at low tide. This boat -has been sold and akeel sailboat, of three foot draft purchased. This I wish to moor at my residence also but cannot do so -without sone dredging of my creek bottom. I am very aware of the significance of the wetlands within my borders, and I am concerned for their preservation. I propose to limit the dredging to a small area adjacent to the town ramp. Dredged material w ill be used to enhance an existing bank separating upland from salt meadow. To rehabilitate the bank area- I will be applying mulch and vegetation to stabilize the soil. A catwalk erected over the meadow and a floating dock w i}l provide access to my boat with, I believe, minimal environmental impact. Except for Southold Town Building Department permits for renovation of residence and addition of garage, there have been no prior operations conducted on the premisis for which lic&nses or permits were required. I have had a contractor, -Mr. T. Latham on site for an initial appraisal for the dredging. He stated that this can be done with crane and dragline/bucket, ,y but that cost figures would be predicated on how the exc&Tated materials were to.be handled.
