SNYDER 704 WIGGINS LANE, GREENPORT • SCTM# 35-4-28.24 Dear Mr. Patanjo: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, July 22, 2015: WHEREAS, Jeffrey Patanjo on behalf of CHARLES D. SNYDER applied to the Southold Town Trustees for a Transfer of Wetland Permit#91 from Frederick Raymes to Charles D. Snyder, as issued on January 11, 1983, and an Amendment to Wetland Permit#91 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated June 19, 2015, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, 2 f • BE IT FURTHER RESOLVED, that the Southold Town Board of Trustees APPROVES the Transfer of Wetland Permit#91 from Frederick Raymes to Charles D. Snyder, as issued on January 11, 1983, and, RESOLVED, that the Southold Town Board of Trustees APPROVES the Amendment to Permit#91 to construct 14 linear feet of vinyl bulkhead at top of bank; and as depicted on the site plan prepared by Jeffrey Patanjo, last dated June 9, 2015, and stamped approved on July 22, 2015. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of$50.00 per inspection. (See attached schedule.) SCTM#35-4-28.24 The proposed actions have been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. In order to gain easy access to the boat, a 3 ° x 3 ° platform will be cantilevered from the bulkhead down a 22° by 12° hinged ramp unto a 6 ° x 16° float which, will be secured lengthwise to the bulkhead.. We believe this configuration to be superior since it allows greater navigable width in the canal. In speaking with Mr. John Costello of Peconic Holding Corp. , he also would prefer this configuration. I would appreciate it if the Town could give conditional approval to either this alternative or the previous one. dated 11/7/82.. Judith Terry, Town Clerk from the Southold Town Conservation Advisory Council: "Dear Mrs. Terry: The following action was taken by the Southold Town Conservation Advisory Council at a regular meeting held Tuesday, October 26th, 1982: Resolved to recommend to the Southold Town Board approval of the wetland application #110 by Enconsultants, Inc. on behalf of Frederick Raymes to extend existing bulkhead and maintenance dredge, Greenport . " Also we have a letter dated November 29, 1982 from Peconic Holding Co. , Inc. to the Southold Town Board: "Gentlemen: After review of the notice of application on behalf of Frederick Raymes for a Wetland Permit , it is our feeling that this application was filed under false pretenses by not naming Peconic Holding Co. , Inc. as- an adjacent land owner and the owner of the land where the proposed dredging is to take place. Under these circumstances we cannot believe that the Town Board could approve this application as it now stands. " That is signed by Marion G. Latham, Secretary. SUPERVISOR PELL: You've heard the reading of the legal notice of Frederick Raymes for a wetland permit . Does anybodywishto be heard in favor of this application? In favor of? (No response. ) Does anybody wish to be heard in opposition to this application? Mr. Costello. MR. JOHN COSTELLO, Greenport , New. York: I 'm .a stockholder in Peconic Holding Corporation. The opposition to it is that the application is filed without anybody being notified by Raymes that they intended to do the work on our property. That ' s number one. This application that is described is different than the application according to the Army Engineers. They intend to do more bulkheading and it is a totally different configuration. The application that was submitted to the Army Engineers includes more work than applied for with Southold Town. On the Army Engineers application they want to construct 120 foot of bulkhead frontage, with a ten foot return on the north side, with a ten foot ramp on the north side and they intend to dredge approximately 166 cubic yards of fill off our property and it calculates like more than 250 cubic yards. I don' t know how they calculated it . They also submitted a drawing to the Army Engineers. I imagine it is the same one that was submitted to Southold Town. There are quite a few contradictions in it . The elevation of mean low water, area to be dredged. This part of- the application is very unclear, and I don't know how you can proceed without a clear application on these items. That ' s my objections. COUNCILMAN TOWNSEND: Now, Peconic Holding Corp. , is that the corporation that owns the bottom of the canal there? MR. COSTELLO: They are deeded the bottom of the canal. The scope of this work is beyond the deeded lands ,of this gentleman. - - COUNCILMAN TOWNSEND: In other words, he wants to do work on your bottom? MR. COSTELLO: Yes. SUPERVISOR PELL: On his application, if I 'read it right, it says , "Privately owned by Peconic Holding Corporation. Manmade privately owned. " Page 3 - Public Hear___; - Enconsultants, Inc . Public Notice No . 11342-82-742-L2, 'Department of the Army, New York District , Corps of Engineers, applicant : Frederick Raymes, was made a part of this record. ) COUNCILMAN MURDOCK: In reading the permission from the Board of Trustees it says he' s given permission to construct 85 feet of timber bulkheading extending from the corners of adjacent existing bulkhead to a point 8 feet from mutual property---12 feet from mutual property line and an 8 foot area of return, but on his diagram it calls for 120 feet of proposed bulkhead. So, there' s an inconsistency in what the Board of Trustees has allowed and what he has filed permission to build. SUPERVISOR PELL: The Board of Trustees instead of allowing what he applied for only allowed that amount . COUNCILMAN MURDOCK: That ' s the point I want to make that we understand he is not being given permission to dredge 120 feet as they ask---or to bulkhead 120 feet . MRS. RUTH OLIVA, President , North Fork Environmental Council : I don 't think the Trustees are aware of the Army Corps notice, I only got mine in the mail yesterday. Perhaps you should come back to the Trustees tonight and show them the discrepancy too, they might not be so anxious to grant it to him: SUPERVISOR PELL: We are holding a public hearing on this application and Mr. Costello has brought to the attention of this Board the applica- tion submitted with the Army Engineers that is different from the applica- tion we have before us and we will continue the hearing today and Mr. Costello will submit , as evidence, this notice to the Town Clerk to be put in the file TOWN CLERK TERRY: The date on the Army Engineers map is revised 11/7/82 . They revised it for the Corps and did not tell us anything about it . SUPERVISOR PELL: So there is definitely a difference between the two applications. MR. COSTELLO: Is it up to Southold Town to allow work to be done on someone else' s property? SUPERVISOR PELL: We have many questions on this, John.
