The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the
Town Clerk of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-'
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

SUPERVISOR PELL: The next hearing is on the application of Costello
Marine Contracting Corp. on behalf of Anthony Prisco. It will be
read by Councilman Murdock.
COUNCILMAN MURDOCK: "Notice is hereby given that public hearings
will be held by the Town Board of the Town of Southold at the
Southold Town Hall, Main Road, Southold, New York on the 19th day
of October, 1982 as follows: 3: 35 P.M. upon application of Costello
Marine Contracting Corp. on behalf of Anthony Prisco for a Wetland
Permit to construct timber bulkhead in front of existing bulkhead and
fill space between with clean trucked-in sand at Sunset Way, on Canoe
Inlet off Cedar Beach Creek, Southold, New York. " I have notice of
publication signed by Karen Jean Rysko on behalf of the Suffolk Times.
Notice of publication signed by Patricia Wood on behalf of the Long
Island Traveler-Watchman. Affidavit signed by Judith T. Terry, Town
Clerk representing that the notice has been posted on the Town Clerk' s
Bulletin Board.
There is a letter from the Town Board of Trustees to Mrs. Judith
T. Terry. "The following action was taken by the Board of Southold
Town Trustees at a regular meeting held September 7, 1982: Resolved
to recommend to the Southold Town Board approval of the wetland applica-
tion #104 of Anthony Prisco to re-sheath, in kind, board for board
replacement approximately 90 ft . of bulkhead directly in front of
existing bulkhead and fill the space between with clean, trucked-in
sand in Cedar Beach Creek, Southold. " Signed Paul Stoutenburgh.
Letter from the Southold Town Conservation Advisory Council to
Mrs. Terry. "The following action was taken by the Southold Town
Conservation Advisory Council at a regular meeting held August 24th,
1982: "Application #104 submitted by Costello Marine Contracting
Corporation on behalf of Anthony Prisco to construct a 90 ft . bulk-
head 4 ft . in front of existing bulkhead and fill with clean, trucked
in sand. It is the recommendation of the Conservation Advisory
Council that the new bulkhead be placed not more than 18 in. from
the existing bulkhead, and spartina grass must be transplanted. "

SUPERVISOR PELL: You've heard the reading of the public notice.
Does anybody wish to speak in favor of this application? (No
response. ) Does anybody wish to speak in opposition to? (No
response. ) Anybody wish to be heard at all on this application?
COUNCILMAN MURDOCK: Bill, I would make one comment between the=
two letters. The Board of Trustees want the bulkhead done directly
in front of the existing bulkhead and the Conservation Advisory
Council said that it should be placed not more than 18 inches from
the existing bulkhead, while the application calls for 4 feet in
front of the existing bulkhead. I call that to the rest of the
Board' s attention.
TOWN CLERK TERRY: Isn' t there a letter in the file that clears
that up? From Costello Marine, "Mr. Prisco has been notified by
the DEC that his amended application to them asking for a permit
to construct his bulkhead four feet in front of the existing bulk-
head would probably be denied. Instead of trying to fight this and
have a costly hearing, Mr. Prisco has decided to go with his original
idea of resheathing directly in front of the existing bulkhead (for
which he already has a permit) . So they amended it to resheath in
kind.
SUPERVISOR PELL: Thank you very much, Mrs. Terry. If there are
no other comments I will declare the hearing closed.

grass must be transplanted out in the waterways.
Application #104 submitted by Costello Marine Contracting Corporation on
behalf to construct a 90' bulkhead 4' in front of existing
bulkhead and fill with clean, trucked in sand. It is the recommendation of
the Conservation Advisory Council that the new bulkhead by placed not more
than 18" from the existing bulkhead, and spartina grass must be transplanted.
RESOLVED to recommend to the Southold Town Board approval of the wetland
application #105 by Enconsultants, Inc. for Robert J. Munch to construct
bulkhead, install elevated catwalk, ramp d float.
RESOLVED to recommend to the Southold, Town Board approval of the wetland
application #106 by Enconsultants, Inc. on behalf of Felix Alfano to renovate
and expand existing dock, catwalk, ramp and float.

State Environmental quality Review and 6 NYCRR Part 617, Section
617. 10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Board, as lead agency for
the action described below, has determined that the project , which
is unlisted will not have a significant effect on the environment.
DESCRIPTION OF ACTION
Application of Costello Marine Contracting Corp . on behalf of
Anthony Prisco for a wetland permit to resheath in-kind 90 ft .
of timber bulkhead directly in front of existing bulkhead and
fill space between with clean, trucked-in sand, at Sunset Way,
on Canoe Inlet , off Cedar Beach Creek, Southold, New York,
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment are likely to occur should the project be
implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation, it is assumed that there is no objection
nor comments by that agency.

Mr. Prisco has been notified by the DEC that his amended

a costly hearing, Mr. Prisco has decided to go with his
original idea of resheathing directly in front of the existing
bulkhead (for which he already has a permit) .
We would like to amend our wetlands application to
resheath in-kind approximately 90 ft. of bulkhead directly
in front of existing. This would be the same type of job

This project is unlisted and our initial determination

work is completed must be given, including a survey if required.

s E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for;elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
' on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.
r G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection,
'-�i there is a $5.00 fee for each additional inspection.
�iv' H. The Town Board upon requestapplicant for a permit, may waive in whole or in part,
