Streicher 600 Snug Harbor Road Greenport, IXW Dear Ms. Long: The folloxving action as taken by the Board of Town Trustees during a Regular Meeting, held on March 20, 2002, regarding the above matter. WHEREAS, Susan E. Long Permits on behalf of HerbertA. Streicher applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of~!he Town of Southold, application dated February 20, 2002 WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on March 20, 2002 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viexved and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code. 2 WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT. RESOLVED, that the Board of Trustees approved the application of Herbert .4. Streicher for a Wetland Permit to resheath landward side of bulkhead, install 4'x5' platform, 3'x12' ramp, 6'x20' float, lower 20' bulkhead by approx. 2' to create a 6'x20' with sheathing with one inch spacing to allow drainage. 3'x6' access steps on landward side of bulkhead construct 8'x12' utility shed and timber deck over existing slate patio with the stipulation that the pilings to the north be inward as well as a ten foot non-turf buffer the entire length. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency, which may also have an application pending for the same or similar project. Fee must be paid, if applicable and permit issued xvithin six months of the date of this notification. Javits Federal Building New York, NY 10278-0090 Attention: Eastern Permits Section Subject- This is in reference to Application No. 2002-00223-L2 by Herbert A Streicher, 600 Snug Harbor Road Greenport, N.Y. 11944 I am Dr. Maxwell Y. Simkin of 520 Snug Harbor Road, and am located on :the property adjacent to and .just north of the applicants property Please be advised that I strongly object to the application by the above Herbert A. Streicher as proposed in the above application. The reasons are as follows. I The applicant requests moving the existing piles waterward. The existing; piles are presently about 20' to 25' west of his present bulkhead. I am the owner ora 45' sailboat and have a floating 40' dock iust north of the applicants property. At present the northerly pile that is in line with the southern boarder of my property line presents an extremely difficult access to the approach to my dock. I have over time requested Mr. Streicher the applicant, to remove this pile dolphin altogether as he does not use it or have need for it, as he has two other piles to keep his smallboat off the bulkhead. To move this dolphin pile further wate~vard, would make what is now a difficult access into an impossible access problem for me. When I built nay house more than 20 years ago the present piles were in a different location They were much closer to the present bul -khead than they are now, and presented no problem at that time in docking my boat. These present dolphin piles were relocated waterward about 10' or 15' by the previous owner, Mr. Kent This relocation took place one winter while I was away from home,. At that time, [ was not informed of the change, and I believe the move was done without any permissions by the corps of engineers, as I would have been so informed.. I believe their present location is therefore in violation. 2. There is really no reason for the applicant to have any offshore piles at all, as this is not an exposed location and presents little danger ifa vessel is tied to a bulkhead. I own and operate two boats, and [ have no offshore piles and have lived in this location for more,, than 20 years and have not found any such need. 3. To move the present pile dolphins, especially the northerly one further seaward 15 ' from its Page 2 present location would bring this dolphin pile and the others about 35~ to 40' away from his bulkhead. This pile dolphin would protrude into the waterway blocking the egress to the eastern canal and would definitely create a navigational hazard to vessels moving to and fro the easterly canal, especially during the nighttime hours. I do not believe there is reason that requires any offshore piles so far out as 35' or more from the applicants bulkhead .... 4. The applicant has not drawn a scale drawing of these piles in relation to the existing structures, waterways, and traffic patterns,and the relationship to my float As such, it is not factual representation of the existing relationship to the surruonding structures. I suggest such a drawing would easily reveal the actual obstruction these piles would present. In my personal case it would reveal that the access to my float, and to my home would be all but impossible. If the applicant feels the need for three offshore piles I might suggest that he remove the present northerly pile and install it on his southerly border line. That location would bring it away from the entrance to the easterly canal, remove it from obstructing my access to my 40' float and home. 5 As to the construction ora shed at the location shown. I object to this shed as it extends beyond his western building line and blocks some of the view'. In addition there is a developers covenant that restricts any such structure beyond his building line. 6. There is also a request to resheath the landward side of his bulkhead. Since the landward side of his bulkhead abuts the landward side of my bulkhead at the south western corner of my property there is bound to be some undermining of my property at this location. What provissions have been planned to minnimize this damage? And what assurance do I have that any damages will be properly and promptly repaired? 7. Please note that the description of the location of the one dolphin pile to be moved 15' xvaterward is not located near the western property line, it is located on a line with his northern property line. and on my southerly property line. most sincerely Maxwell Y. The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable.
