The Southold Town Board of Trustees at their Regular Meeting held on Wednesday, September
24th, 2003 took the following action.
RESOLVED, that the Southold Town Board of Trustees Approve an Amendment to Permit
#5441 to include deck and den), removal of eight (8) trees the reason for the denial is that it was
a previous condition of the permit that there be a fiftY (50)foot non,turf non disturbance
bnffer adjacent to the wetlands.

CONSERVATION ADVISORY COUNCIL
At the meeting of the Southold Town Conservation Advisory Council held Tuesday,
September 23, 2003, the following recommendation was made:
Moved by Drew Dillingham, seconded by Bob Ghosio, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAl of the
Amendment application of JAMES 6AVANAUGFI to Amend Permit #5441 to include
the existing deck and DISAPPROVAL of the application for the removal of eight trees.
Located: 205 Gull Pond Lane, Greenport. SCTM#35-4-28.39
The CAC recommends Disapproval of the application for the removal of eight trees
because the nothing should be removed in the non-disturbance area. ¢

Dear Board Of Trustees:
The above referenced application is 'before you for a permit
amendment to include a deck that has already been completed
without approval, and to remove eight (8) mature, healthy
trees situated in the designated buffer area, adjacent to
the waters of the Fordham Canal.
There was a previous attempt to remove these trees, but was
stopped in time by a NYS DEC Conservation Officer who was
dispatched to the scene of the attempted violation, along
with a Southold Town Bay Constable.
As a taxpayer and riparian owner, I believe that the policy
governing natural buffer areas should not be compromised,
and here'by register a staunch OBJECTION to any consideration
thereof.

I wish to register my objection to that part of application that seeks permission to remove
eight more trees in addition to the many already removed on same building permtt Sub~act trees
are tall, healthy mature oaks within 40 feet of canal. I would urge you to ws~t s~te and see ,t first
hand before making a determination. These trees help much to filter s~ght and sound from of
nearby highway traffic to applicants property as well as those houses nearby. In addltron, they
contribute much ~;o the environment and country character of the Gull Pond area. Lor~g t~ma
residents have come to appreciate a/id str~ve to preserve these fragile dualities that have attracted
ua here. We are happy to make aware and share these quahbes with new property owners as well
I and neighbors personatly noticed a d~'amatic increase of highway f~o~se when the f,rst stand
of trees were cut down. I do understand this cuttmg was deemeo necessary to erect a modular
house on applicants site. I see no valid reason to cut c~own more of those really beautffut white and
red oaks that do contnbute to the charm of the homes on the waterway. In a few weeks tneywHI
reward you with a blaze of red and gold, doubled by their reflection on the water that wilt make you
glad you spared them. Notice too the same colors as you stowly motor down the canal, that most all
the property owners have preserved as many trees as possible to contmue that effect.
Leaving noted trees would actually enhance the applicants ~roperty and in my v~ew tr~e~r
removal would here the opposite result Very ludicrous pruning however white taking into account
sight and sound transmission could achieve a neet effect, if that is what ~s desired, while mamtammg
all the benefits of mature trees on the property,

amendment and its potentia} detrimental effect on subject an~ surroun~m~' properties, f voice and
express here my own as well as the sentiment of many nelghDors.

Dear Ms. Savage:
The Board of Toxvn Trustees took the following action during its regular meeting held on
Wednesday, October 24, 2001 regarding the above matter:
WHEREAS, Long Island Permit Service on behalf of JAMES CAVANAUGH applied to the
Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town
of Southold, application dated September 14, 200l, and,
WHEREAS, said application was referred to the Southold Toxvn Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
October 24, 2001, at which time all interested persons were given an opportumty to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the stmctnre complies xvith the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of JAMES CAVANAUGIt to
construct a 26'X 26' single-family dwelling with 20'X 22' attached garage, driveway, and septic
system, with the condition ora 50' non-turf/non-disturbance buffer, hay bales placed down
before construction, and drywells installed, all as depicted on survey dated Jul)' 16, 1999 and last
revised January 10, 2002.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire t~vo years from the date it is signed. Fees
must be paid, if applicable, and permit issued xvithin six months of the date of this notification.
Two inspections are required and the Trustees are to be notified upon completion of said project.
