Signed —� S ' E A L own Clerk, Town of Southold Date January 2, 1976 WETLAND APPLICATION #24 Public hearing was held on December 9, 1975 at 7:30 p.m. Present were Supervisor Martocchia, Councilman Homan, Councilman Rich, Justice Suter and Justice Demarest. Supervisor Martocchia called the hearing to order at 7:30 p.m. and Councilman Rich read the Notice of Hearing. NOTICE IS HEREBY GIVEN that hearing will be held by the Town Board of the Town of Southold at the Supervisor' s Office, 16 South Street, Greenport, New York, on December 9, 1975, in the matter of the following application: 7:30 p.m. upon application of Pierce Yacht Basin, Inc. for a permit under the provisions of the Wetland Ordinance of the Town of Southold for the purpose of dredging to a depth of six feet below mean low water, bulkheading, and installing piles to provide 38 additional slips for sailboats, at the Pierce Yacht Basin, Manhasset Avenue and Beach Road, on Stirling Basin, Greenport, New York. All persons interested in said matter shall appear at the time and place above specified and will be given an opportunity to be heard. BOKEN, TOWN CLERK Councilman Rich: We have affidavit signed by Sherley Katz, proof that this was published in the Long Island Traveler- Watchman. We have proof signed by Stuart C. Dorman that this was published in the Suffolk Weekly Times. We have proof that this was posted on the bulletin board at the Town Clerk' s Office. We have reports from the Conservation Advisory Council. The Conservation Advisory Council disapproves the application. We have a letter from the Board of Town Trustees, Town of Southold. Gentlemen: Please be advised that the following resolution was passed by the Board of Southold Town Trustees at a regular meeting held on August 4, 1975: "IT WAS RESOLVED that the Board of Southold Town Trustees favorably recommends the approval of amendment to Wetlands Application #24 by Pierce Yacht Basin, Inc. " This is an excellent sheltered mooring area. The Trustees are of the opinion that increasing the number of moorings in this area would be an asset to the Town. /s/ Alvah B. Goldsmith, Chairman Board of Southold Town Trustees WETLANDS APPLICATION #24 Page 2 Supervisor: You have heard the reading of';the notice; the proof of publication in the two local papers, the Suffolk Times and the Traveler; the position of the Southold Town Conservation Council where they advise to disapprove the application; the position of the Southold Town Trustees where they recommend approval of the applicant for the project. We have two letters here for the record, one from the North Fork Environmental Council and the other from the Greenport Planning Board. At this time, I will open the hearing for anyone that wishes to support the applicant' s position, whoever is representing Mr. Pierce. Philip J. Ofrias, Esq. : Good evening, gentlemen, my name is Ofrias. I live at Southold, I have an office in Riverhead, and I represent Pierce Yacht Basin, Inc. relative to this application. As the application indicates, apparently you gentlemen don't have a copy of the survey before you. I am sure you are familiar with it, though. The area involved basically is approximately 290 feet by 75 feet but I would indicate that the size of the area is only about 25% of that area which has any water in it or on it at high tide. For the most part, the area to the north aid the west which is above the area is high dry ground totally unrelated to the wetlands or wetland related interests. The application seeks to enlarge an existing marina to include room for an additional 38 sailboat slips. The reason we emphasize the sailboat slips is that it is strictly a sailboat marina. It is not power boat oriented at all. There are no fueling facilities, no facility for engine repair or what have you as marinas go. It is strictly a clean operation. The area involved, likewise, is between an existing marina, that is the present Pierce Yacht Basin and the municipal boat ramp which is to the southeast of the proposed area. The area of water between the municipal boat ramp and the existing marina is only about 35 feet wide at high tide. That' s the neck where the water starts to flow in. It' s only about 35 feet across. That' s at high water. At low water, basically, there is no water in there. The reason I indicate that is the area that is delineated to be excavated out for the piles and slips is basically all high land four or five feet above high water which is, as I say, not really related. I understand, speaking to the Building Inspector down at Town Hall, which I wanted to speak to him to verify this, the present zoning map when it went through, this particular parcel was specifically mentioned as being suitable for and its best use being that as a boatyard marina which is the use that it is presently involved in. I think very effectively so and very efficiently so. I don't think that it is an operation that causes any unhappiness for the other people in the community or the neighborhood. It is a clean operation that is well run and well maintained. We look to expand an additional 38 slips. I don't have too much more to say than that other than what is set forth in the application. Supervisor: This is an amended application, right? �J WETLANDS APPLICATION #24 Page 3 Mr. Ofrias: That' s right. The only difference between this application and the original application involves removing more of the high ground. It doesn't affect any of the low ground at all. The difference is the high ground and the four foot elevations being removed. Supervisor: Is there anyone else that would like to speak in favor of granting this application? Mr. Koch: My name is Koch. Personally, I am a disabled man and Greenport to a great extent relies on the boating industry and I know the operation of Henry Pierce very well. I think he deserves every consideration and it will be a great asset to the community and to Stirling Basin which basin is geared to accommodate sailboats and motor boats. He does alot for the community, too. You can go out there on Saturdays and Sundays and he entertains a group of young sailors that he has sailing out of this marina and I think we should support a marina of this nature because it surely does alot for Greenport and the sailing fraternity in this particular area. Supervisor: Thank you, Mr. Koch. Does anyone else wish to speak in favor of supporting this application? Mr. Douglas: I am Robert J. Douglas of Orient. I would like to put my support behind Henry' s project not as a boatman, which I am, or as a businessman but as a resident of the area who knows what it means to have a sdfd port in any kind of weather. As a resident of Orient, we have all types of water, but we have no places that you can call weather-proof. When we have problems, we come running to Henry. It' s an ideal spot. It can do nothing but improve the area by enlarging it. Anybody that likes to sit on their porch and look at boats, it' s enjoyable. I have done that from other homes in Greenport here, looked out across the Stirling and it' s a nice Sunday afternoon to just sit there and watch them go in and out. I think we need more area like this to support the economy out here. After all, the people that come out here that aren't residents, they come out for one reason, to use the water and utilize what we have. I would like to put my support behind what Henry would like to do there and hope that the Town Board will assist him in his move. Supervisor: Thank you, Mr. Douglas. Does anyone else wish to speak in support. Robert Douglas: I would like to say I am in favor of Henry. Where else can we go? Stirling Harbor cannot expand and Mitchell ' s can't expand. Where can they go? Robert Reybine: My name is Robert Reybine and I have known Henry for a couple of years and I would say that he runs an excellent operation and I think that the marina itself does not cater to the type of people that might contribute to the pollution of the L l� WETLANDS APPLICATION #24 Page 4 area. It is mostly sailboats and people that come for weekend sailing primarily at which Henry does an excellent job. I am in favor of this expansion. Supervisor: Is there anyone else in support? In opposition to granting this application? Richard Pollett: My name is Richard Pollett. I live very close to Mr. Pierce ' s marina. I have a petition here with 97 signatures of homeowners that are in protest against the marina. They all live pretty close to that marina. The diagram or plan I saw from the Army Engineers said that this proposed digging was going to be 115 feet wide, not 75 feet wide. Supervisor: 75 feet is up on the road end. It does flair out towards the water part. Mr. Pollett: It will be taking up 6 feet to sea bottom the whole length of this 290 feet so that would change it from high land to low land. Also, I remember something back in September in the Suffolk Times where it was mentioned that the Greenport Planning Board was against this destruction of wetlands. Supervisor: I have some letters here. Mr. Pollett: I admire Mr. Pierce. I know he has been good for the town. It is just that we feel the harbor is getting over- crowded and, perhaps, over-polluted. We do think it is a destruction of wetlands and we think that visually Stirling Basin has been a nice place to look at, a tourist attraction, and if it gets too crowded, it might lose some of that. Incidentally, I would like to know what you people consider a crowded harbor. Do you count the number of moorings. If so, what figure would you arrive at? I think there are alot of moorings there now. We are also worried about the people that live there in the cove. There are about 30 families around this little cove just east of Mr. Pierce' s projected waterway. With this new body of water sort of pointed at the mouth of this cove, we are worried about erosion and filling up this entrance into our cove. There are going to be, perhaps, some tidal changes that we didn't have before because this body of water will be 290 feet long, 115 feet wide and six feet below its present bottom which is quite alot of dispersal. As Mr. Pierce mentions, he will be displacing 12,000 cubic yards of seabottom. With this extra amount of footage added to the width, where they are going to change their width, there should be more than 12,000 cubic yards of dirt removed. We are worried about what reaction that might have. We also wondered what decision the Army Engineer Corps had,come to in reference to their approval or disapproval of Mr. Pierce ' s application. Also, there was something in the paper about their needing a pure water certification. I was wondering whether these two plans had been met, approved or disapproved. If you people approve of this tonight, will Mr. Pierce be able to go ahead with this proposed waterway? P WETLANDS APPLICATION #24 Page 5 Supervisor: There will be no approval tonight. Mr. Pollett: Are there any other steps outside of this one that he might need to proceed. Justice Suter: Yes, the Army Engineers and the DEC. Mr. Pollett: They haven't approved it as yet? Supervisor: I don't see it in this file. Mr. Pollett: In other words, there still will be a period of waiting before anything can be done. I approve of marinas. I think it is a lovely business, it brings people close to the water and gives a man a chance to use his boat. I was just wondering why all these marinas have to be put in this little harbor. There must be other places nearby that can be used. I would be curious as to what figure you people would arrive at to determine whether the maximum quota had been met. How many slips would you consider would be sufficient or maximum for this harbor. If someone else came along and wanted to put in another marina in the same harbor, another 200 mooring slips, would you say yes or no. How far can this expansion go? Supervisor: What I am looking for here is if there is any other correspondence from the DEC. I don't see anything. Mr. Ofrias: As far as the DEC goes, they have not yet scheduled a hearing. There will be a hearing required. Mr. Pollett: If there are to be three years of digging, as Mr. Pierce suggests, we are going to have three years of muddy water at the mouth of our cove and if this fills up with sediment, who will be responsible to correct that? Also, if it is going to take that long, I'll probably be in a wheelchair- in Miami or some place and I don't really have any personal feelings about getting any personal gain out of it but when I came- to Greenport it was so nice that I was sort of trying to save that for the other people. Supervisor: Is there anyone else in opposition? We have two pieces of communication. One is from the Village of Greenport Planning Board signed by Jonathan Richmond, Chairman. Dear Mr. Martocchia: On behalf of the Village of Greenport Planning Board I submit the following position statement in reference to the application of Pierce Yacht Basin to expand their dock facilities as per their application before the Army Corps of Engineers - #75-321, dated June 27, 1975. WETLANDS APPLICATION #24 Page 6 1. It is our position that careful consideration be given to this application relative to possible violations of the Southold Town and New York State Wetlands Ordinances. 2. In that the proposed dredging does occur in part in the Incorporated Village of Greenport, we would strongly urge that no further encroachment upon the uplands within the Village be allowed. /s/ Jonathan Y. Richmond, Chairman Village of Greenport Planning Board Supervisor: We have one from the Environmental Council. Councilman Homan: This is a letter to the Town Board from Merlon Wiggin, President. Gentlemen: The North Fork Environmental Council ' s position on the proposed dredging is as the attached letter to the New York District Corps of Engineers. /s/ Merlon E. Wiggin This basically states that they have inspected the area and find it to be a spartina marsh approximately 50 by 300 feet long and being an environmental organization they cannot endore the destruction of any marsh. Nevertheless, they also appreciate the fact that it `.is'=far more important to keep boats concentrated in Sterling Harbor than have them scattered throughout our creeks with their own dredged and despoiled mooring areas. They also understand the area is previously zoned commercial. (Goes on to read letter) Our suggestion would be to locate the marina area to the north, alongside the cemetery. This is a spoiled low area that has lost its wetland value already. The spoil from this operation could be readily put on adjacent lowlands cutting the cost of moving it as suggested in the original proposal. In summary, we regret the loss of any marshland but also realize the need for adequate boat dockage. DO HEREWITH PETITION THE TOWN BOARD OF SUPERVISORS OF THE TOWN OF SOUTHOLD; THE NEW YORK STATE BOARD OF ENVIRONMENTAL CONSERVATION, AND THE DEPARTMENT OF THE ARMY TO DENY THE APPLICATION OF PIERCE YACHT BASIN, INC. OUR OPPOSITION IS BASED ON THE FOLLOWING GROUNDS: 1. The entrance (by boat) to Sterling Harbor presently requires single file approach through a narrow opening bulkheaded on one side with a shallow sandy beach on the other side. The sandy beach side is constantly filling in, making the entrance even more shallow and narrowing the usable entrance and exit. 2. An inspection of Sterling Harbor and particularly the vicinity of the subject property will reveal that the area is presently over-utilized with many boats of large size with midstream moorings, which make it difficult and dangerous to navigate a boat from the entrance to its mooring and from its mooring to the exit. 3. The proposed application would involve the destruction of wetlands, which has become a prime environmental concern of the people and residents of New York State as well as elsewhere in the United States. This application is a flagrant violation of the New York State Law recently passed by the New York Legislature to protect the wetlands. 4 The property of the applicant is presently utilized to the fullest possible extent, and the granting of this permit would merely confer private advantage on the applicant to the detriment of all others using the harbor as well as residents and property owners in the area. ° -1- f The applicant can show no hardship and the application is based simply on a blatant attempt to increase the income from an already very prosperous boatyard operation, to the detriment of surrounding properties and other persons using the harbor. 5.
