Box 728 Southold, NY 11971 Re: SEQRA Lead Agency and Determi- nation of Significance Application for wetland permits by Enconsultants for Joseph Cavalier to dredge and create a mooring facility for , commercial vessels at Mattituck Creek, Southold, NY Dear Ms. Terxy: I am writing in response to your letter of February 10, 1982, and our recent phone conversations regarding establishment of lead agency and determination of significance in accordance with SEQRA. Although this project is opposed by staff of our Bureau of Tidal Wetlands due to its likely destruction of wetlands, we nevertheless feel that the scope, and magnitude of the wetland and water-related impacts do not require preparation of an Environmental Impact Statement as thisa impacts will be thoroughly addressed in our normal permit review procedures. I have been in contact with Mr. Paul Stoutenberg, President of the Town Trustees and he told we that the Trustee's concern for the project is not with the wetlands but with the creation of a possible hazard to navigation. I informed him of another application by the adjacent land- owners, Petersen Towing Corporation, for a similar project of which he was already aware (application also made to the Town Trustees) . I also stated we intend to schedule a combined hearing for both these projects to coincide with a map change hearing to amend our Tidal Wetland map for this area. Ms. Judith T. Resultant 1850 cu yds of spoil is to be placed on adjacent upland of applicant to raise grade and make a usable road to connect to road and parking area to south. Approx. 20 timber pilings (12"diam x 40') spaced 8'O.C. will be installed directly off new shoreline and along e/s of property to join existing line of pilings. A 3' wide walkway will be attached to pilings to permit pedestrian access to boats. Install inclined ramp 30' wide by 60 ' long to allow vehicular access to commercial boats which will be moored there. Dear Sirs: Attached please find applications to improve the present commercial facility belonging to the Petersen Towing Corporation at Mattituck. It consists of several aspects. The work proposed for the south side of the facility includes maintenance dredging of high spots along the present line of pilings to which commercial vessels tie. The work is needed to allow safe berthing. An upland retaining wall is also proposed for the south side of the parcel. It will be used to retain fill used for the parking area to prevent its erosion into the waterway. It will be located above both the line of MHW and the marsh fringe. The work on the north side of the parcel will consist of the removal of the point of land which juts out into the creek. As you will recall, the Board of Trustees had recommended this action to improve navigation around this bend in the waterway. In order to make this area usable for boats, it is proposed to install pilings and attached walkway along the shoreline in a similar manner to the remainder of the property. A ramp, also similar to existing and approved structures, is also proposed to allow vehicles to load and unload boats. To stabilize the newly created shoreline, it is proposed to place stone rip rap and plant Spartina alterniflora . As this work is quite costly, however, the owner requests he be given latitude in the time in which the work will be done. It is not anticipated that this will cause significant erosion as erosive factors tend to be greater on the outer side of bends in a waterway while this site is on the inner side. The work proposed for the Petersen property is meant to complement that proposed for the Cavalier property. As stated in an earlier letter, however, Southold Town Trustees 2 I do not believe that the two applications should be linked so that the fate d= one depends upon the other. The Cavalier property is to be developed and utilized by Northville Industries Corporation for berthing of their offshore platform equipment. The Petersen property is to be used for the berthing of commercial fishing boats. While the work proposed will expand the capacity, the manner in which it will be used will not differ. That is, no fish processing will occur. Each project must be judged on its own merits. The applicants realize that there is a good deal of public interest in both of these projects. In your review, please keep in mind that usages proposed comply with present zoning and will enable the more efficient usage of property.
