COUNCILMAN MURPHY (Deputy Supervisor) : It is now 3: 30 P.M. and we
would like to convene the public hearing on the matter of the applica-
tion of Agnes Pagnozzi for a wetland permit .
There not being a quorum present, this hearing will be recessed
until 6: 20 P.M.
This public hearing reconvened at 6: 40 P.M.

COUNCILMAN NICKLES: "Notice of Hearing. Notice is hereby given
that a public hearing will be held by the Town Board of the Town of
Southold at the Southold Town Hall, Main Road, Southold, New York,
at 3: 30 P.M. , Tuesday, September 22, 1981 in the matter of the
application of Agnes Pagnozzi for a permit under the provisions of
the Wetland Ordinance of the Town of Southold for permission to
attach existing dock to two new wood pilings and add two additional
pilings for a hoist for permanent use at her property located off
south side of Jockey Creek Drive, on Jockey Creek, Southold, New
York. All persons interested in said matter shall appear at the
time and place above specified and will be given an opportunity to

I have a letter from Anna T. Hataier;, President, Southold
Town Trustees to the Town Clerk. "Dear Mrs . Terry: The following
action was taken by the Board of Southold Town Trustees at a regular
meeting held on September 2, 1981: RESOLVED to recommend to the
Southold Town Board denial of the wetland application of A. Pagnozzi,
#71, for a permit to attach existing dock to two new wood pilings
and add two additional piles for a hoist Ifor permanent use. FINDINGS
AND RECOMMENDATIONS: Pilings and hoist are in illegally, as no
permits have been issued and the structure is to close to the
property line, violating the zoning codel. They must remove the

Town Clerk. "Dear Mrs. Terry: The following action has been taken
by the Southold Town Conservation Advisory Council at a regular
meeting held August 25, 1981 . RESOLVEDIto recommend to the Southold
Town Board approval of Wetland Application #71 of Agnes Pagnozzi to
attach existing dock to two new wood pilings and add two additional
pilings for a hoist for permanent use. ( Yours truly, Frank Cichanowicz

COUNCILMAN MURPHY: You' ve heard the relading of the notice. Is
there anyone here to speak in favor of this application at this
hearing?

AGNES PAGNOZZI: I want to know what is needed, what is wrong.
COUNCILMAN MURPHY: Do you have any statements to make as far as--
MRS . PAGNOZZI : The whole wetlands thing is approved and the Building
Department--someone said it was to close to the building line and
the Building Inspector came down and sjaid it isn't . I don't exactly
know what the problem is here. They did not find any construction
in the rear yard area that violates the zoning ordinance and I have
this permit from the environmental thing and the whole thing.

COUNCILMAN NICKLES: Do you have a permit from the New York State
Department of Environmental Conservation?
MRS. PAGNOZZI: Right here.

COUNCILMAN MURPHY: Does anyone want �to ask Mrs. Pagnozzi any
questions on the application?

COUNCILMAN MURDOCK: Very honestly, with our discussion today the
problem being what the Building Inspector said that there is no
violation of the zoning is because our zoning laws do not apply.
That structure is completely in the water and as such the Town
Board has no jurisdiction over that structure. It is strictly
in the hands of the Board of Trustee's.
MRS . PAGNOZZI : I know, but they threw it on the Building Department .

COUNCILMAN MURDOCK: I don' t believe they do. We discussed it this
afternoon with three of the five members of the Board of Trustees
and they feel the meeting notes are wrong, that the meaning was
a little confused===-the word "zoning" is wrong in their letter to
US. Albeit whether their letter is wrong or their letter is right
this Town Board has no ability to function on a structure that is
completely in the water. It is even at low tide in the water and
that bottom land is under the control of the Trustees and this Town
Board---whoever gave you the advice to file this application was
wrong. This Board doesn 't have any jurisdiction.
MRS. PAGNOZZI : But they told me at the other meeting it was the
Town Board. What are we discussing now, the rails?
COUNCILMAN MURDOCK: The hoist. The one that the public hearing is
on tonight is the hoist and the Town Board has no jurisdiction.
MRS. PAGNOZZI : I realize that. The way I understood it it was the
two applications, the rails and the hoist. The hoist I know I had
to go through the Trustees before I come to you.
TOWN CLERK TERRY: You were here for the one on the rails. You were
here for that hearing, but they just didn' t make the decision.
MRS. PAGNOZZI : Well, what is the decision on the rails? What about
the rails now?
TOWN CLERK TERRY: They haven' t made one.
MRS. PAGNOZZI: No decision on that yet either?
COUNCILMAN MURDOCK: No.
COUNCILMAN NICKLES: It is Item IV under Hearings and Decisions on
the agenda.
COUNCILMAN MURPHY: There are two . You are scheduled twice.
MRS. PAGNOZZI: Then what is this one?
COUNCILMAN MURDOCK: This is the public hearing on the hoist.
MRS. PAGNOZZI : The hoist . We that has to go to the Trustees--I
have to go back to the Trustees in October.
COUNCILMAN NICKLES: You had a hearing--meeting with the Trustees
and they recommended denial of this application.
MRS . PAGNOZZI : But then when the Building Department went- down
there--they threw it on the Building Department. They didn' t
exactly know what to do with it. They threw it on the Building
Department .
COUNCILMAN MURDOCK: No, Mrs. Pagnozzi, they didn' t put it on the
Building Department, we in the Town Board asked the Building

Department to go down there and give us a ruling and their ruling
is that it has nothing to do with zoning and that ruling is based
on the fact that that structure is in the water and the zoning
does not apply.
MRS . PAGNOZZI : He said he saw nothing wrong with it.
COUNCILMAN MURDOCK: That may be a misinterpretation in that he saw
nothing wrong with it in what our jurisdiction would apply to.
MRS . PAGNOZZI : Because the Trustees threw it on the Building
Department . I know it has to go through the Trustees again.
COUNCILMAN NICKLES: At any rate, Mrs . Pagnozzi, all of this
situation down there in front of your property was put in without
permits.
MRS. PAGNOZZI : It was put in as a temporary measure because it
was taking too long to get the rails. The boat was there and we
had to protect the boat . We have a dock, if we�'didn' t feel we had
to do something to protect it we could have tied it on that dock.
Without any further problem. But we feel it needed more: . We have
racing in the creek and we were afraid of theft. My own house is
alarmed, we are afraid of theft out here. You go down Goose Creek
and look at the house down there--- It was going to be removed
b_ut we liked the hoist better than the rails.

COUNCILMAN NICKLES : Let me just clear one thing up because the
Trustees in their letter to the Town Board said the violation of
the zoning code. The secretary when she typed this misinterpreted
what the Trustees thought was. What it violates is that it is within
15 feet of your property line and the Trustees have a regulation that
they do not wish to have docks or other structures that involve
boating within 15 feet of the adjacent property line.
MRS . PAGNOZZI : They how are they 10 feet? There are docks that
are 10 feet .
COUNCILMAN NICKLES: This is a matter that you are going to have to
take up with the Trustees and as Mr. Murdock says, how you got down
here with the Town Board on a Wetlands Application on this matter
we are not sure how that occurred but we did visit your property
today and when we visited it then we could see that this installation
for the hoist was not in the wetlands - area which is covered by the
Town Board.
MRS . PAGNOZZI : No, it first has to go through the Trustees.
COUNCILMAN MURDOCK: We have no jurisdiction at all.with that
structure.
MRS. PAGNOZZI : Only the rails, right?
COUNCILMAN NICKLES : On the railway.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6 NYCRR Part 617, Section
617. 10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Board, as lead agency for
the action described below, has determined that the project, which
is unlisted, will not have a significant effect on the environment .
DESCRIPTION OF ACTION
Application of Agnes Pagnozzi for a Wetland Permit to attach
existing dock to two new wood pilings and add two additional pilings
for a hoist for permanent use at her property located off south side
of Jockey Creek Drive, on Jockey Creek, Southold, New York.
The project has been determined not to have a significant
effect on the environment for the following reasons :
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment are likely to occur should the project be
implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation, it is assumed that there is no objection
nor comments by that agency.

Dear Judy :
In reference to your letter dated September 10 , 1981 ,
George Fisher asked me to make and inspection of the subject
premises , which I have done this date .
I did not find any construction in the rear yard area ,
(water front) that violates Zoning Ordinance .
Permits would be required , however , for the Marine
railway that has been installed and the four pilings that
provide hoist for boat .
The construction of Marine railway is in the wetlands , -
partly on their property , and partly in the creek, Town
waters . A permit is needed from Town Board and Trustees .
The structure for hoist is completely in the creek, permit
from Trustees is required .

Please conduct an inspection -on the property of Agnes
Pagnozzi, 1450 Jockey Creek Drive, Southold, and advise the
Town Board by September 18th whether or not the construction
of the hoist, pilings, etc, is a. violation of the Zoning
Ordinance. All the construction you see at the waterfront
has been installed without Trustee, Wetland or Building
Department permits.

The following action has been taken by the Southold Town
Conservation Advisory Council at a regular meeting held August
25, 1981.
RESOLVED to recommend to the Southold Town Board approval
of Wetland Application x#69 of Agnes Pagnozzi to construct 50'
of marine railway, 25 ' oh beach and 25 ' in water area to max-
imum of 2' at M.H.W.
RESOLVED to recommend to the Southold Town Board approval
of Wetland Application #70 of R. M. Kammerer, Commissioner,
Suffolk County Department of Public Works to reconstruct bridge
carrying New Suffolk Avenue over West Creek at New Suffolk on
the condition that the board see the complete plans of construc-
tion and see it staked out before the job starts so that they
will know the construction limites of the project. Any wetlands
that are damaged must be put back in their natural state after
construction is completed.
RESOLVED to recommend to the Southold Town Board approval of
Wetland Application #71 of Agnes Pagnozzi to attach existing dock
to two new wood pilings and add two additional pilings for a hoist
for permanent use.

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by writter permission from the owner of the property if not
the some as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to the Permit Application:)
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection,
there is a $5.00 fee for each additional inspection.
H. The Town Board upon reques �f tpe applicant f r a per it, may waive in whole or in part,
the provisions of Article Il, Sectio , subdivisions 6 and if where it finds that nature of the
proposed operations are such that the requirements of such provisions are not necessary for a
proper consideration of a permit application.
I. Upon approval of this application the Town Clerk will issue a permit to the applicant. Such
permit shall be available for inspection at any time, upon request.
