The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the
Town Clerk of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section _
617. 10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Board, as lead agency for
the action described below, has determined that the project , which
is unlisted will not have a significant effect on the environment .
DESCRIPTION OF ACTION
-Application of Steve Tsontakis, on behalf of Thomas and Jacqueline
Occhiogrosso, for a Wetland Permit to construct single family dwelling
and provide access for construction, driveway and off street parking
on the west side of Corey Creek Lane, Lot #28, Map of Corey Creek
Estates, Southold, New York.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effect to the environment are likely to
occur should the project be implemented as planned.
Because there has been a response from the Board of Southold
Town Trustees and Southold Town Conservation Advisory Council indicating
that this project would not have a significant effect to the environment .
Because there has been no response in the allotted time from the
New York State Department of Environmental Conservation and the Southold
Town Building Department , it is assumed that there are no objections nor
comments from those agencies.

Dear Mr. Occhiogrosso:
This office field inspected your property on December 19, 1983 and all
fill has been removed in compliance with the above stipulation.
Your permit has been extended until December 31 , 1984 as per my
letter of October 12, 1983. Your current permit calls for -construction
of a one family dwelling 13 feet from the easternmost property line and
house southernmost location a minimum of 25' from the landwardmost por-
tion of tidal wetlands along the canal. The sanitary system shall be
placed a minimum of 100' from any tidal wetland.
I am enclosing the approved plot plan for your records which is
not the same plot plan approved by the Town of Southold.

A field inspection of August 31, 1983 determined that fill
has been placed in the tidal wetlands on the northwest corner
of your property. The home location that was staked in the
field was not the currently approved location for your home.
The fill extends up to 8' from the home staked in the field
to the west and north of staked home location.
Please contact me as soon as possible so that I may discuss
the restoration of tidal wetlands that is needed to resolve
this permit violation.

Re: Property on Corey Creek Lane, Southold.
Dear Mr. and Mrs. Occhiogrosso:
At your request I visited your property on the •west side of Corey Creek Lane
in the Bayview area of Southold. You supplied me with a survey of the property
showing the proposed house, the NYSDEC permit, and the application for wetlands
permit from the Town Board.
In addition, a copy of the stop work order dated May 20, 1983 from the building
inspector was supplied. The reason given on the stop work order was that "fill has
been deposited on property and push (sic) into wetlands in violation of wetlands
permit. . . . ." My inspection indicated that a small amount of fill has entered an
area on the southwest corner which contains some high marsh species. These are
Spartina Patens, Distichlis snicata, and Iva frutescens. The extent of encroachment
appears to be between 10' and 20' long,of variable width but probably no more than
5' . It appears that the filling occurred in conjunction with site preparation for
installation of the foundation. To rectify this, I would recommend that the encroaching
fill be removed upon completion of the foundation and the previous grade restored as
closely as possible. I have found that in cases where minor amounts of fill have
entered wetland areas this procedure will allow the marsh to restore itself within
one growing season. I understand that a retaining wall will be built to contain the
fill placed around the completed house. I would anticipate the marsh to continue to
function essentially unchanged if these measures are undertaken.
I would be happy to discuss the content -of this letter with you or with the
Town in an effort to resolve the present impasse.

Since my client is an avid fisherman, he has no wish to
disrupt this land anymore than necessary.
Mr. & Mrs .Occiogrosso have been trying to build a house on
this property for the last eighteen (18) months , but have run
into many problems, some self inflicted. However, I feel that
they should be allowed to do so.'
The Town Ordinance #97-24B states that a hearing will be held
on such applications upon no less than ten (10) days notice,
and #97-24A states that the Town Board will solicit recommendations
from the Board of Trustees and The Conservation Advisory Council,
whom "shall within twenty (20) days of receipt" , make recommenda-
tions with respect to such applications. Since both these -- -
bodies are familiar with this project, they should be able to
quickly respond to this requested amendment..
Because of the nature of the subject project, and the long
history, Mr. & Mrs.Occiogrosso have suffered much loss of time
and mental anguish. I request that the Town Board pass a resolu-
tion to set the hearing date for the regular meeting scheduled
for Tuesday, July 19 , 1983. I believe that this date is
realistic and in keeping with the ' law. On the other hand further
delays, would constitute an injustice to the Occiogrosso' s.

Gentlemen:
I am hereby requesting to be heard at your next working
session meeting (July 5, 1983) , regardinq the subject permit.
On June 23, 1983, I applied on behalf of my client
Mr. Thomas Occiogrosso,for an amendment to the existing
permit. In essence the requested amendment, would modify
the existing permit to conform with the permit issued by
the N.Y.S. D.E.C.
This amendment is requested because it would be virtually
impossible for the Occiogrossos to construct their new home
in compliance with the Wetlands Permit. The permit, as issued,
did not provide for the disturbance of the wetlands outside the
perimeter of the foundation. Obviously, it is impossible to do
the work without a certain- amount of access around the building.
The D.E.C. permit on the other hand, although stringent, allows
for disturbance of the wetlands within five (5) feet of the
building, and access to the garages .
In accordance with the D.E.C. permit, my client proposes to
erect a one (1) foot retaining wall five (5) feet from the
foundation in the wetlands portion, and confine the construction
activities within this boundary. The application to amend the
permit includes a site plan showing the limits of disturbance. -

A. This application is"to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by written permission from the owner of the property if not
the some as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed projecti,;.(Note: Copies of the Pilot Plan may be made by a copy machine and attached

C. ' No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detoiled'statement of the rehabilitation and -proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-

Enclosed please find a re-application for the referenced permit.
For your information, I have enclosed a copy of the permit issued
by the N.Y.S. D.E.C. , permit #10-82-0326 , dated July 15 , 1982.
May I please bring to your attention that my client,
Mr. Thomas Occhiogrosso, did not intentionally violate the permit
but rather followed the requirements of the D.E.C. permit. Close
examination of the Town permit will show that it would be im-
possible to build a 45 x 25 house without allowing for workspace
around the building. Therefore, we are requesting that the
permit allow for a 5 foot work area on the west side to be defined
by a wood retaining wall, and an area to the north to be used to
provide access on to the property and the two required off-street
parking spaces.
Mr. Occhiogrosso has retained me to insure that the site work will
in no way violate the permit.
I pray that you find this application in order so that you may
grant this permit.
