The validity of this permit is or may be subject to the approval of other governmental or municipal authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the event that such approval is necessary, the holder of this permit shall not commence operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the Town Clerk of written notice from such other governmental or municipal authorities of its refusal or disapproval. The applicant does by the acceptance of this permit, assume all responsibility for operations under- taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon which the operations authorized by this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and its officers and employees to enter upon the premises where such operations are being conducted to make such inspections as the Town may deem necessary to insure that such operations are being con- ducted in conformity with this permit. This operation will not substantially: A. Adversely affect the wetlands of the town. B. Cause damage from erosion, turbidity or siltation. C. Cause saltwater intrusion into the fresh water resources of the town. D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege- tation or the natural habitat thereof. E. Increase the danger of flood and storm-tide damage. F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town. G. Change the course of any channel or the natural movement or flow of any waters. H. Weaken or undermine the lateral support of other lands in the vicinity. I. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effect to the environment are likely to occur should the project be implemented as planned. Because there has been a response from the Board of Southold Town Trustees and Southold Town Conservation Advisory Council indicating that this project would not have a significant effect to the environment . Because there has been no response in the allotted time from the New York State Department of Environmental Conservation and the Southold Town Building Department , it is assumed that there are no objections nor comments from those agencies. Dear Mr. and Mrs. Occhiogrosso: At your request I visited your property on the •west side of Corey Creek Lane in the Bayview area of Southold. You supplied me with a survey of the property showing the proposed house, the NYSDEC permit, and the application for wetlands permit from the Town Board. In addition, a copy of the stop work order dated May 20, 1983 from the building inspector was supplied. The reason given on the stop work order was that "fill has been deposited on property and push (sic) into wetlands in violation of wetlands permit. . . . ." My inspection indicated that a small amount of fill has entered an area on the southwest corner which contains some high marsh species. These are Spartina Patens, Distichlis snicata, and Iva frutescens. The extent of encroachment appears to be between 10' and 20' long,of variable width but probably no more than 5' . It appears that the filling occurred in conjunction with site preparation for installation of the foundation. To rectify this, I would recommend that the encroaching fill be removed upon completion of the foundation and the previous grade restored as closely as possible. I have found that in cases where minor amounts of fill have entered wetland areas this procedure will allow the marsh to restore itself within one growing season. I understand that a retaining wall will be built to contain the fill placed around the completed house. I would anticipate the marsh to continue to function essentially unchanged if these measures are undertaken. Mr. & Mrs .Occiogrosso have been trying to build a house on this property for the last eighteen (18) months , but have run into many problems, some self inflicted. However, I feel that they should be allowed to do so.' The Town Ordinance #97-24B states that a hearing will be held on such applications upon no less than ten (10) days notice, and #97-24A states that the Town Board will solicit recommendations from the Board of Trustees and The Conservation Advisory Council, whom "shall within twenty (20) days of receipt" , make recommenda- tions with respect to such applications. Since both these -- - bodies are familiar with this project, they should be able to quickly respond to this requested amendment.. Because of the nature of the subject project, and the long history, Mr. & Mrs.Occiogrosso have suffered much loss of time and mental anguish. I request that the Town Board pass a resolu- tion to set the hearing date for the regular meeting scheduled for Tuesday, July 19 , 1983. On June 23, 1983, I applied on behalf of my client Mr. Thomas Occiogrosso,for an amendment to the existing permit. In essence the requested amendment, would modify the existing permit to conform with the permit issued by the N.Y.S. D.E.C. This amendment is requested because it would be virtually impossible for the Occiogrossos to construct their new home in compliance with the Wetlands Permit.
