The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the
Town Clerk of written notice from such other governmental or municipal authorities of its refusal or
disapproval.

The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any. and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of.the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

SUPERVISOR PELL: This is a public hearing on the wetland application
of Philip Obenauer. Councilman Townsend will read the notice.
COUNCILMAN TOWNSEND: "Notice is hereby given that public hearings will
be held by the Town Board of the Town of Southold at the Southold Town
Hall , Alain Road, Southold, New York on the 7th day of December, 1982
as follows: 3: 00 P.M. upon application of Philip Obenauer for a Wetland
Permit to place 180 cubic yards of clean upland fill in a 160 ft . by
150 ft . area of his property located at Case' s Lane Extension, on West
Creek, Cutchogue, New York. All persons interested in said matters
shall appear at the time and place above specified and will be given
an opportunity to be heard. Dated: November 23, 1982 , By Order of

I have notice that it was published in the Traveler-Watchman and
signed by Patricia Wood and also the Suffolk Times signed by Troy
Gustayson. Also notice of the hearing was placed on the Town Clerk' s
Bulletin Board by the Town Clerk Judith Terry.
I 've got the following resolution from the Town Trustees: "The
following action was taken by the Board of Southold Town Trustees at
a regular meeting held November 9, 1982: Resolved to recommend to the
Southold Town Board approval of wetland application #109 of Philip
Obenauer to fill and raise grade of lot off branch o-f West Creek,
Cutchogue, as long as it is graded properly; no fill at any time will
extend past an imaginary line parallel to waterway between the two
cement boundary markers; fill will be graded to slope to conform with
existing terrain. "
I 've got notice from the Southold Town Conservation Advisory
Council. "The following action was taken by the Southold Town
Conservation Advisory Council at a regular meeting held Tuesday,
October 26th, 1982: "Resolved to recommend to the Southold Town
Board approval of the wetland application #109 by Philip Obenauer
to fill and raise grade of lot number 4, branch of West Creek,

NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT
Dated : November 5 , 1982
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6 NYCRR Part 617 , Section
617 . 10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Board, as lead agency for
the action described below, has determined that the project , which
is unlisted will not have a significant effect on the environment.
DESCRIPTION OF ACTION
Application of Philip Obenauer for a wetland permit . Permission
is requested for placement of 800 cubic yards of clean upland fill in
a 160 ft . by 150 ft . area on property located at Case' s Lane Extension,
on West Creek, Cutchogue, New York.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment are likely to occur should the project be
implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation, it is assumed that there is no objection
nor comments by that agency.

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Cleric in quadruplicate, accompanied by written permission from the owner of the property if not
the some as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to the Permit Application.')
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given; including a survey if required.
E. If permit is being sought- for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether. any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses -
were ever revoked or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection,
there is o $5.00 fee for each additional inspection.
H. The Town Board upon request9" applicant for a permit, may waive in whole or in part,
the provisions of Article 11, Section subdivisions (h and (^'where it finds that nature of the
Proposed operations are such that 'the requirements of such provisions are not necessary for a
proper consideration of a permit application.

It has been brought to my a ttention that there,
is some concern that my proposed filling of my lot may
result in some of the, fill washing down into the creek.
I would like to assure you that I will take every
precaution to prevent this for seve-tal reasons; one is
esthetics, ±x-mx±m another is, ecology and one very important
reason would be, financial, meanigg that I do not under any
circumstances want to devalue our property by ruining the
wat erf�ront. ,
This 'site tiaras inspected by yOhariau Hamilton on
August 18, 1982, prior, to the issuing of a :bBC' Permit.
1 offered to place "Rip Haps' along- the edge of the seaward
edge- of the phragmites, but he said- it wasn�t necessary
and wouldn"t look well. Anyway, the area near the creek
( about 20f, strand) can not be disturbed until after the-
bulk of the filling has been stabilized as, per the permit
from DEC.
I do not wish to bulkhead the- creek. I will
appear at your meeting on the 26th of October to try to
answer any questions you may have and to personally
assure you that T will cooperate in ax y way required of
the Council.
There is an easement over the western half of this
property allowing the golf course (Cedar"s) to pick up
golf balls, therefore, our house can not be built out near
the road. We plan to build in about 2 years. We hope to
place the house at the• emtreme- western edge of the existing
phragmites. Rowever, at this time, we are only applying for
a permit to fill , not to build.
