COUNCILMAN TOWNSEND: "Notice is hereby give that public 'hearings will ' be
held by the Town Board of the Town of Southold, at the Southold Town Hall,
Main Road, Southold, New York, on Tuesday, April '24, •1984, on the following
applications for_ a- Permit under the provisions of the Wetland Ordinance of the
Town of Southold: 3: 32 P.M. - In the matter of the application of The Land
Use Company, on behalf of North Fork Property Development, for permission
to install timber bulkhead, two returns, ramp, float dock, and dredge at a
dredged. canal leading from Deep Hole Creek, Lot No. 22 on the south side.of
Lutpon Point Road,, Mattituck, New York."
Virtually all the communications and proof of publication are identical to
the notices that Councilman Schondebare has just read. (Affidavit of publica-
tion from The Long Island Traveler-Watchman and The Suffolk Times and proof
of posting on the Town Clerk's Bulletin' Board by Judith T. Terry.) I don't
think there is 'anything additional, as a matter of fact, the disapproval by the
Board of Trustees and'the approval by the Conservation Advisory Council are
the same. That's., it.

MR. PHILIP PHOEL, Lupton Point,' Mattituck: , I live next door and second up
from this property and I object very strenuously.
SUPERVISOR MURPHY: Thank you,,' sir. Is, there anyone else would like to
speak in'opposition? (No response.) Anyone like to make any comments at
all on this? Yes?
MRS. ELEANOR BIRD, Lupton Point, Mattituck: The gentleman's proposal is '
what we're so highly against. He wants to go back into the land that exists,
which would leave us totally unprotected. We are tidal water. _ We are right
now or either at very high flood stage, or there is 'no water there at alll,!,and
we feel the way he has presented his 'proposals is 'totally unacceptable to us,
because we will be left wide open. He proposes to go back into the existing
banks and then bulkhead and leaves us, because the lay of the land goes from--
I'm a house wife, a woman--and I would say the land exists on this 'canal .'from
southeast to northwest so every party or property from the east side of this
land, just further out into the water. He goes back further into the north
and it leaves everything to the east of his 'property open and exposed for tidal.
We have a lot of tidal erosion this 'winter and we do have a natural habitat.
There's ducks, there's swans in'there now and there's great blue heron.
hate to see this '-all have to go. And we've also got a problem with water there.
We have Temik in our wells and we do not want a lot of other problems with
other, cesspools and so forth, where we have it now already in' the creek area.
SUPERVISOR MURPHY: Thank you. Anyone else would like to, comment at
this time?
COUNCILMAN STOUTENBURGH: May I ask some questions?
SUPERVISOR MURPHY: Certainly.
COUNCILMAN STOUTENBURGH: On your property, Mr. Bird, do you have a
bulkhead at all, or is there any bulkheads along that area at all?
MR. BIRD: No,_ no there's not.
COUNCILMAN STOUTENBURGH: None whatsoever?
MR. BIRD: No.
COUNCILMAN STOUTENBURGH: And this would be the only bulkhead on that
whole area? '
MR. BIRD: Right.
COUNCILMAN STOUTENBURGH: How do you prevent your land from sloping
off?
MR. BIRD: I have a retaining wall.

It was the consensus of the board that if Mr. Perricone could
get together with the neighbors in that area, he could submit
another application, for a structure similar to that inthe neighboring
area.

3. If your application is approved above, a Permit Fee is now due, and
should be made payable to the order of the Board of Southold Town
Trustees. This fee is computed below according to the Schedule of
Rates as set forth in the Instruction Sheet (Form I /1) . This fee must
be paid within 90 days or reapplication and additional fee will be
necessary.
If the Permit Fee is paid in person to the Clerk of the Board, the Permit
will be obtainable at the same time. If the fee is paid by mail, the Permit

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by written• permission from the owner of the property if not
the same as the applicant.
B. Pilot Plan must be drown to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to the Permit Application:)
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and prc posed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation 'rhan the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must- accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection.

H. The Town Board upon request Q,f tie applicant for a permit, may waive in whole or in part

the provisions- of Ar 6 11, Section _`,% subdivisions (b and (a where it finds that nature of the
proposed operations are such that the requirements of such provisions are not necessary for a
proper consideration of a permit application.
I. Upon approval of this application the Town Clerk will issue a permit to the applicant. Such
permit shall be available for inspection at any time, upon request.
