The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the
Town Clerk of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
y The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of. the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

SUPERVISOR PELL: This hearing is on the application of Enconsultants,
Inc. on behalf of Robert J. Munch. It will be read by Councilman
Nickles.
COUNCILMAN NICKLES: "Notice is hereby given that public hearing will
be held by the Town Board of the Town of Southold at the Southold Town
Hall, Main Road, Southold, New York on the 19th day of October, 1982
as follows: 3: 40 P.M. , upon application of Enconsultants, Inc. on
behalf of Robert Munch for a Wetland Permit to construct bulkhead,
catwalk, ramp and floating dock on Mattituck Creek at 2790 Westphalia
Road, Mattituck, New York. " I have notice from the Suffolk Times
of proof of publication and the Long Island Traveler. I have an
affidavit from the Southold Town Clerk Judith T. Terry that it was
duly posted on her bulletin board.
I have a letter dated October 4th to Judith Terry, Town Clerk,
from Robert N. Thurber, Senior Environmental Analyst , New York State
Department of Environmental Conservation which says , "Dear Mrs. Terry:
Please note that the above referenced project has been modified in
such a way that bulkhead will be entirely above mean high water as
authorized by the terms of the enclosed permit : Please consider
this letter as New York State Department of Environmental Conservation ' s
reply to your notice dated September 22, 1982 on the matter. " They
have a permit enclosed from the New York State D.E.C.
I have letters from, the Southold Town Conservation Advisory
Council which says, "Dear Mrs. Terry: Resolved to recommend to the
Southold Town Board approval of the wetland application #105 by .
Enconsultants , Inc. for Robert J. Munch to construct bulkhead,
install elevated catwalk, ramp and float . " .
I also have a letter from the President of the Southold Town
Trustees to the Town Clerk. "Resolved to recommend to the Southold
Town Board approval of the wetlands application #105 of Robert Munch
to construct 72 ft . of timber bulkhead generally above the line of
MHW except in one location where configuration of shoreline is
indented. Backfill with 350 cu. yds. of clean fill to ° be trucked
in from upland source and to construct a 25 ft . x '4 ft . fixed
elevated catwalk, 12 x 4 ft . hinged ramp and 8 x 16 ft . floating

dock secured by two pilings. Yours truly, Paul Stoutenburgh. "
SUPERVISOR PELL: Thank you, Councilman Nickles. Does anybody
wish to speak in favor of the application of Robert Munch? (No
response. ) Does anybody wish to speak in opposition to? (No
response. ) Does anybody wish to be heard at all on this applica-
tion?
COUNCILMAN NICKLES: I would do the same thing as Councilman
Murdock. I want to bring something to your attention. The
letter from Robert N. Thurber which puts all the bulkhead entirely
above the mean high water mark, so I would presume then the
recommendation of the Trustees would not apply in this case.
TOWN CLERK TERRY: Excuse me, yes it would. As part of the Wet-
land Ordinance the Trustees are asked for their recommendations
regardless of whether they have jurisdiction or not.
COUNCILMAN NICKLES: But they had involved something on the basis
that it was going to be at the mean high water mark or lower.
TOWN CLERK TERRY: You mean that does not appy any more?
COUNCILMAN NICKLES: That is not applicable, that condition.
TOWN CLERK TERRY: No.
SUPERVISOR PELL: If anybody else does not wish to be heard, I will
declare the hearing closed.

The following conditions apply to all Permits:
A. If any of the permit conditions are unclear, the permittee shall contact
the Division of Regulatory "ffairs at the address and telephone noted below.
B. A copy of this permit or approval and supplementary conditions shall be
available at the project site *.•7henever authorized work is in progress.
C. The permit sign enclosed with the permit or a copy of approval letter shall
be protected from the weatlier and posted in a conspicious location at the
work site until completion of authorized work.
D. At least 48 hours prior to commencement of the project, the permittee shall
complete and return the tep portion of the enclosed receipt form certifying
that he is fully aware of and understands all provisions and conditions of
this pewit. TTithir- one week of completion of the permitted work the bottom
portion of that form shall also be completed and returned.
B. For projects involving activities to be accomplished over a period or more
than one year, the permittee shall notify tide Regional Permit Administrator
in writing at least 48 hours to the commencement of resur?tion of worn each

F. If project design modifications tape place after permit issuance, the permit-
tee shall submit the appropriate plan changes for approval by the Regional
Permit Administrator prior to unriertaking any such modifications. The
permittee is advised that substantial modification may require submission of
a new application for permit.
G. All necessary precautions shall be taken to preclude contamination of any
wetlands or waterway by suspenrled solids, sediment, fuels, solvents, lubric-
ants, epoxy coatings, paints, concrete, leachate or any other environmental-
ly deleterious materials associated with the project work.
F. Any failure to comply precisely with all of the terms and. conditions of this
permit, unless authorized in writing, shall he treated as a violation of
the Environmental Conservation Law.
I. The permittee is advised to obtain anv permits or approvals that may be re-
quired from the U.S. Department of Army Corps of l,ngineers, :Tew York District,
26 Fe:leral Plaza, New Yorlt, PTY. 10007, (Attention Regulatory Functions
Branch), prior to commencing work authorized herein.
J. The granting of this permit does not relieve the permittee of the responsib-
ility of obtaining a grant, easement, or other necessary approval from the
Division of Land Utilization, Office of General. Services, Tower Building,
Empire State Plaza, Albany, NY 12.242, which may be required for any encroach-
ment upon State-owned lands under water.

' The following conditions shall apply if checked as applicable by the
Regional Permit Administrator:
R. All dredging shall be conducted so as to leave a uniform bottom
elevation free of mounds or holes.
L. All spoil material shall be disposed of either in the Atlantic
Ocean or at an approved U.S. Government Dumping Ground, as directed
by the District Engineer, U.S. Department of the Army, Corps of
Engineers. Any spoil material not intended for such dater dis-
posal shall be removed from the site and disposed of at an approved
upland site.
X M. All fill and spoil material shall be suitably contained at the work
site so as to prevent its eroding, leaching or otherwise entering,
into adjacent wetlands and waterways.
X N. All peripheral rip-rap berms, cofferdams, rock revetments, gabions,
bulkheads, etc. shall be completed prior to placement of any fill
material behind such structures.
0. All repairs to existing structures shall be confined to replacement
of existing structural elements with no change in design, dimension,
or materials, unless specifically authorized herein.
X P. The following Water Quality Certification shall apply if required
by one or more agencies of the United States Government and if
checked as applicable by the Regional Permit Administrators:
In accordance with Section 401(a) (1) of the Clean Graters Act of
1977 (PL 95-217) the New York State Department of Environmental
Conservation hereby certifies that the subject project proposal will
not contravene effluent limitations or other limitations or standards
under Sections 301, 302, 303, 306 or 307 or the Act.

configuration of shoreline is indented. Backfill with 350 cu yds of
clean fill to be trucked in from upland source.and to construct a 25 '
x 4 ft. fixed elevated catwalk, 12 x 4 ft hinged ramp and 8 x 16 ft
floating dock secured by two pilings.

The following action was taken by the Southold Town Conservation Advisory
Council at a regular meeting held August 24th, 1982.
RESOLVED to recommend to the Southold Town Board approval of the wetland
application #103 by Costello Marine Contracting Corp. for Paul Birman to
resheath in-kind approximately 40' of bulkhead directly in front of exist-
ing bulkhead and fill space between with clean, trucked in sand. Spartina
grass must be transplanted out in the waterways.
Application #104 submitted by Costello Marine Contracting Corporation on
behalf of Anthony Prisco to construct a 90' bulkhead 4' in front of existing
bulkhead and fill with clean, trucked in sand. It is the recommendation of
the Conservation Advisory Council that the new bulkhead by placed not more
than 18" from the existing bulkhead, and spartina grass must be transplanted.
RESOLVED to recommend to the Southold Town Board approval of the wetland
application #105 by Enconsultants Inc. for Robert J Munch to construct
bulkhead, install elevated catwalk, ramp & float.
RESOLVED to recommend to the Southold Town Board approval of the wetland
application #106 by Enconsultants, Inc. on behalf of Felix Alfano to renovate
and expand existing dock, catwalk, ramp and float.

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by writter permission from the owner of the property if not
the some as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and'a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to the Permit Application:)
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If -permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection,
there is a $5.00 fee for each additional inspection.
H. The Town Board upon request tJ�ie, applicant f""oa�r'� a permit, may waive in whole or in part,
the provisions of Article 11, Section9 , subdivisions cera and &where it finds that nature of the
proposed operations are such, that 'the requirements of such provisions are not necessaryfor a
