As stated in the purposes of the by-laws of our Chamber,
our aims include "fostering trade and commerce , or the interest
of those carrying on such trade or commerce ; to promote the
general welfare and prosperity of the state , territory or
community. . . ; to advance the civic , commercial, industrial and
agricultural interests of the territory where the corporation
is situate. . ." .
In view of the above , The Board of Directors of the Mattituck
Chamber of Commerce voted on August 2, 1982 to go on record
supporting the expansion of business located in Mattituck,
provided such expansion is consistent with all Town Codes and
Ordinances. The continued growth and expansion of the economic
base is vital to the growth of our community and the well-being
of its residents. Increased business brings new jobs, new
purchasing power, and increased tax revenues to our citizens
and allows our residents and their children to live and work in
their home community.
At this time, we wish to state we support T'ia.tt-aLiar
Marina' s proposed expansion as outlined in the proposal now
before the Town agencies. Mattituck is very fortunate to have
Southold' s only deep water harbor on Long Island Sound, and
we feel the rational and responsible growth of tourist and
recreational facilities on the inlet is to be greeted with
enthusiasm.

Town Hall, Main Road, Southold, New York at 3: 05 P.M. , Tuesday, August
3, . 1982 in th.e matter of th.e applications of Enconsultants , Inc, on

Wetland !Ordinance of the Town of Southold to install four "T" shaped
floating docks to allow berthing for deeper draft vessels unable to

SUPERVISOR PELL: Thank you. You have heard the reading and at
this time the Board will listen to anybody who wishes to speak in
favor of the application. In favor of the application. Mr.
Samuels .
MR. THOMAS SAMUELS: The reason that the Trustees denied the applica-
tion without prejudice is that they were seeking information on the
exact metes and bounds of the federal turning basin which is situated
directly off shore of the marina. At the time of the meeting on July
6th we did not have such information. We now have such information
which shows that the docks in question will be a considerable distance
from the federal turning basin. The Trustees also were going to look
into the existence of a possible deed from the Town of Southold to the
federal government for the federal turning basin. I don' t believe
that the Trustees ever did in fact give the federal government the
right to the bottom in the federal turning; basin, but it ' s a moot
point since the docks in question will be well short of the federal
turning basin and will be on Southold Town bottom. We have here an
original of the map, I have copies also, of the Army Corps of Engineers
which was made 26 August 1964 which shows the so-called turning; basin
at the end of the dredging project which was accomplished the follow-
ing year, I believe, 1965 . We have inked in the applicant 's property
and the existence of the dock and I think it 's fairly evidett that
we' re well short of them in every respect . Here is Matt-A-Mar' s
property and here is the federal turning basin or the limits of the
dredging that was done at that time . You can see that the proposed
docks which we 've drawn in are short of the federal basin in every
respect . Four docks are proposed. This is the actual application
drawing to the Corps of Engineers and State D.E.C. for which we
already have a permit and the Southold Town Trustees and the Town
Board.
PERSON IN THE AUDIENCE: We cannot hear.
MR. SAMUELS : I was just explaining the application drawing and
relating it to the master drawing of the Corps of Engineers .
(The Board examined and discussed the drawing. )
MR. SAMUELS : I ' d suggest that the Trustees have not received this
information yet since we just received it ourselves . As a matter
of fact the Corps of Engineers was down on the site today doing
some measurements . I would suggest that we would certainly agree
to a delay in decision by this Board pending a decision by the
Trustees . We ' ve asked them to reopen the application. Therb,:is
a me6ting tonight and there is some question as to whether we could
bring it up at that time, but we ' re certainly going to give them
this information for their consideration tonight .
TOWN CLERK TERRY: Is the proposal tonight to the Trustees exactly
the same as it was applied for before?
MR. SAMUELS : Right. If you will note on th-e original application

which was drawn by Mr. Haje of Enconsultants , we showed at that
time 200 feet from the existing bulkhead to the turning basin
and it proves out.
SUPERVISOR PELL: Thank you. Anybody else wish to speak in favor
of the application? (No response. ) Anybody wish to speak in
opposition to it?
MRS . RITA ATTINASI MURPHY, Browers Woods , Wettview Drive , Mattituck:
I have been a resident for 26 years and_ as such a taxpayer and I am
greatly opposed to any increase of any form,shape or anything of
Matt-A-Mar Marina. Having lived on the creek for years I don ' t know
where Mr. Samuels comes from or whatever, but I will give you my
thoughts . First of all when they purchased this marina, to the
best of my ability, four years ago , they were satisfied with the
96 slips. Now I presume it has enlarged. Also they were to store
15 boats . They store way more than 15 boats all winter long. There
is now a restaurant open in there ; they have a dirt road that you
can ' t even pass by with all the cars in and out and all the inconvenience
caused us . Now for the creek itself . First of all the noise of the
boats going in and out constantly at four or five in the morning and
tooting their horns is most annoying. Their boats get stuck on the
marsh in front of our homes, that causes inconvenience. Two years
ago I believe it was , or a year and a half ago, one of their boats
exploded at the dock, so they pushed this boat away, not caring where
or when, and it ended up in front of us . Our boys had to go out and
rescue this boat, pull all our boats out of the way to keep our homes
and properties from going on fire . Also there' s been drownings down
there and I just think that everything' s just getting out of hand down
there and I 'm here from the Browers Woods Association and if- you' d
like more people to come,- unfortunately we were' nt aware, but we
could certainly get other taxpayers to come. Thank you very much.
SUPERVISOR PELL: Thank you,Mrs . Murphy. Anybody else wish to speak
in opposition to this application?
MRS . DOROTHEA DELEHANTY, Mattituck: I represent the Mattituck Creek
Watchdogs . We have been unsuccessfully fighting this Matt-A-Mar
Marina ever since its inception and getting no where. Briefly, just
when are you going to stop giving in to these people? For every inch
they get they want a mile . For every mile they get they want ten
miles . The creek is terribly polluted. This is a dead end. This
was once a residential property. It never never should have been made
into a marina. The big problem here is there 's no stopping this and
I want to know what right one individual has to take over the entire
end of that creek. I can recall when my son went down there several
times in his boat he was told to get lost because he was interfering;
with the boats that were moored around that peninsula. This does not
belong to Matt-A-Mar Marina. It belongs to the people of the Town of
Southold. No one individual has the right to take over the way this
organization _has taken over and not for the better for anyone and with
a total disregard for the people who live there . I represent all these
families and we are all very much opposed to this entire business and
any further increase of any kind on the creek and I do feel we all have
a right to pure water, to the use of the creek and for someone to be
spreading out like an octopus, like a cancer in every direction. . Why
tolerate it? When are you going to stop giving; in to these individuals?

I and every family I represent oppose this very strongly. Thank

MRS . RUTH OLIVA, President , North Fork Environmental Council : May
I just suggest to the Board that we recess this hearing; until the
Trustees have an opportunity to review this new material that ' s just
been handed to us. Thank you.
SUPERVISOR PELT: The Board will consider that , yes . Anybody else
wish to speak in opposition to the application? Mr. Frank Bear.
MR. FRANK BEAR, Southold: I ' d just like to add to what Ruth Oliva
has said, I only think that the Trustees should have an opportunity
to review this before this Board takes any action and I would like
for the Board itself to look into the question of the map and all
the other aspects of the problem so far as the turn around is concerned,
as far as pollution is concerned, and as far as the inconvenience to
people who live in the area. Thank you.
SUPERVISOR PELL: Anybody else wish to speak in opposition to? (No
response. ) Anybody wish to be heard at all on the appli-ation?
MR. JAMES DELEHANTY, Mattituck: I have more or less a question . I
wonder why the Trustees don' t have full control of this matter? This
proposed action is to take place on the bottom of the creek which I
understand the people own and the people elect Trustees to administer
this and the Trustees have said that the people don' t want this action
taken on their land. Why isn ' t that the end of it?
SUPERVISOR PELL: Mr. Delehanty we are going to review the whole
application.
MR. DELEHANTY: I ' m talking about the question of ownership as much
as I don't want you to do something on my front law. I don 't need
a reason. I own the front lawn and I say no, I don ' t want you to do
this on my front lawn. Ish 't it true that the people own the bottom
of the creek? And don't we elect::Trustees to administer matters
concerning this land?
SUPERVISOR PELL: This point was raised and the Town Board is going
to review the entire situation. If we find your situation is right
then we ' ll address the issue .
MR. DELEHANTY: I ' d rather be swimming, Why do I have to come here
when I elect and pay people to represent me in these matters? We
own this land and we don' t want this man. He has his property , let
him uses his property . We don' t want him to use ours .
SUPERVISOR PELL: Thank you for your comments . Anybody else wish
to be heard on this application?

MR. BEAR: I would--before you close it it would seem to me that
if you' re going to close it and the Trustees come up with something
which requires public comments , then we ought to have an opportunity
to do that . If you close the hearing at this time you won ' t have the
opportunity.
SUPERVISOR PELL: Thank you very much.
MR. SAMUELS : The question of the Town 's Wetland Ordinance is in
essence being challenged by a ruling at this time . The question has
come up innumerable times whether the Town Wetland`Ordinance applied
in a good many cases and it has been the Town Board' s position that
it did. I know of no legal action that 's been taken which removes
floating docks from the Town ' s Wetland Ordinance so I must assume that
unless the Town Board does make a decision to amend this ordinance,
that it does in fact apply and that is why we applied for a Town
Wetland permit. I don ' t believe that the Town can say on this particular
application that it does not--that the ordinance does not apply without
changing the ordinance, and I would have to ask Mr. Tasker to comment
on that . I don' t believe--we feel we would like to have a Town wetland
ordinance . We feel that we would like a Town Trustee' s ordinance and
since in the past we have been required to get both of them we would
like to at least have the opportunity to get both of them in this case.
I would think it would be the applicant 's position in the event of
denial, he certainly could challenge the ordinance, but you can' t
challenge the protestors I would think not challanFe the ordinance
when the Town has been administering it as such .
SUPERVISOR PELL: The application was made before this Board to
hold a wetland hearing. We have held the hearing. Now, as I said
to Mr. Delehanty or somebody before, we are going to review the
entire file on this , entire remarks that you have made , and we will
at this time close the hearing.

Dear Roy:
With reference to your letter of July 23, 1982
concerning the scheduled public hearing �on the Matt-A-
Mar Marina wetland application, I do not have such an
opinion of the Town Trustees indicating that "no wetlands
were involved and therefore no Town Board permit was
required" .
At the time I received the Trustees' recommendation
(attached) concerning the wetland application, I scheduled
a public hearing upon resolution of the Town Board. I
do not see how such a public hearing can be cancelled at -
this point in time since it has already been published in
the newspapers. I- had previously received the Conservation
Advisory Council' s recommendation (attached), and when both
recommendations are received the public hearing is sched-tiled.
This process is followed in each wetland application.
As far as the application fee being refunded, that is
entirely up to the Town Board, but I cannot see it happening
after the publication costs have been incurred, However, I
will bring it to their attention.

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by writter permission from the owner of the property if not
the same as the applicant.
B. Pilot Plan must be drawn to scale on the reverse Eide of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to the Permit Application.')
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revolted or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection,
there is a $5 00 fee for each additional inspection.
H. The Town Board upon reques�qW applicant for a permit, may waive in whole or in part,
the provisions of Article 11, Section' subdivisions A and (`where it finds that nature of the
proposed operations are such that the requirements of such provisions are not necessary for a
proper consideration of a permit application.
I. Upon approval of this application the Town Clerk will issue a permit to the applicant. Such
permit shall be available for inspection at any time, upon request.

Re: Matt a Mar Marina "T" docks
Dear Sirs:
Enclosed please find application and associated material relating to
the proposed construction and installation of "T" docks at Matt a Mar
Marina, Mattituck.
The purpose of the project is to allow for the berthing of deep draft boats,
primarily sailboats, which are not able to approach the present bulkhead -and
finger piers .
You will note that the proposed docks are similar to one which has
been in existence for Reny years.
For informational purposes, I enclose a copy of the NYSDEC permit
which was granted for the project.
Please notify me of any hearing which may be scheduled.
By copy of this letter, I am requesting similar action from the Town
Board on their wetlands application.

16. The Applicant shall require all boats leasing or renting dockage space
to meet the applicable Federal and State regulations for Marine heads
and shall by specific contractual clause prohibit the discharge of
sewage from any boat docked at the Marina. Violation of this condition
shall be cause for initiating revocation proceedings for this permit.
17• The pilings and timber used in construction under this permit shall be
copper chrome arsenate (CCA) treated. Creosote shall not be used.
SPECIAL NOTE — Water Quality Certification
Based upon a review of the above application and a request for water
quality certification pursuant to Section 401 of the Federal Clean Water
Act of 1977, Public Law 95-217 (the "Act"), public notice for which has
been duly given and based upon a public hearing held pursuant to Article
25 of the Environmental Conservation Law, the Department of Environmental
Conservation hereby certifies that the Applicant will comply with
applicable provisions of Sections 301, 302, 306 and 307 of the Act,
provided that:
(1) There are no future changes in any of the following that
would result in non—compliance with Sections 301, 302,
306 and 307 of the Act :
(a) the project as modified herein,
(b) the water quality criteria applicable to such
waters, or
(c) applicable effluent limitations or other
requirements, and
(2) The applicable provisions of the State law and regulation
are complied with.
