Southampton, NY 11968 BROADBLUE, LLC 230 WIGGINS LANE, GREENPORT SCTM#35-4-25&28.37 Dear Mr. Hemnann: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, April 30, 2003 regarding the above matter: WHEREAS, En-Consultants, Inc. on behalf of BROADBLUE, LLC applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated November 22, 2002, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Heating was held by the Town Trustees with respect to said application on April 30, 2003, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board membem have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of BROADBLUE, LLC to construct a two-story, one-family dwelling with attached garage and patio; install a pervious driveway, sanitary system, d_rywells, and public water service; place approx. 250 cy. of clean fill to raise grade of center portion of lot; and establish a 50' non-disturbance/non-fertilization buffer adjacent to the apparent high water line/tidal wetland boundary, as depicted on the survey prepared by John Ehlers last dated November 21, 2002. Construct approx. 151 linear fi. of vinyl bulkhead (to be tied into adjacent bulkhead returns at property lines) and backfill with approx. 75 cy. of clean sand to be tracked in from an upland source; and construct a timber dock to be extended offproposed bulkhead, consisting ofa 4'X 11' fixed catwalk; 3'X 12' hinged ramp; and 6'X 20' float secured by (2) 8" diameter pilings, all as depicted on the project plan prepared by En-Consultants, Inc. last dated January 2, 2003. The Board of Trustees will entertain an application to amend the permit to dredge adjacent to the upland of the property, in order to shorten the dock. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $5.00 per inspection. (See attached schedule.) The construction is within a severely bulkheaded canal that, I feel, offers little if any habitat value. Though the project site itself is not bulkheaded, the resulting scouring and sloughing of the bank caused by the neighboring bulkheads has made it difficult for any wetland vegetation to establish itself. The project now incorporates a "low sill" bulkhead and Spartina alterniflora plantings that will allow the establishment of a small fringe marsh. This will bring a bit of much needed aquatic habitat to the canal. The decision whether to issue a perruit will be based on an evaluation of the probable impact, including cumulative impacts, of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historical properties, fish and wildlife values, floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, enei'gy needs, safety, food and fiber production, mineral needs, consideration of property ownership and,in general the needs and welfare of the people. The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. CENAN-OP-RE PUBLIC NOTICE NO. 2002-01519-L2 WORK DESCRIPTION The applicant, Broadblue, LLC, has requested Department of the Army authorization to construct a bulkhead and a pier assembly and to undertake plantings. The site is in Fordham Canal, Shelter Island Sound at Greenport, Town of Southold, Suffolk County, New York. · The work would involve construction of a 151 linear foot bulkhead that would be backfilled with 75 cubic yards of sand from a state approved upland source. The work would also involve construction of a pier assembly consisting of a 4' by 11' pile- supported, fixed timber pier, a 3' by 12' hinged ramp, and a 6' by 20' float, chocked to maintain 2 feet of water under it at all tidal stages. The float will be secured by two (2) guide pilings. - The project would also involve planting 1500 square feet of Spartina alterniflora. The area would extend approximately 10 seaward of the proposed bulkhead and the full length of the proposed bulkhead. Approximately 151 linear feet of staked fiber roll would also be installed to create the proposed 1500 square feet of intertidal marsh. The stated purpose of this project is to prevent erosion and provide a mooring facility. The proposed work could have a minor adverse impact on Essential Fish Habitat (EFH) and EFH-managed species as a result of a temporary increase in turbidity during installation of pilings. Although this may adversely affect the feeding success of some EFH-managed species or their prey, it is expected that fish populations would avoid the area of disturbance. The proposed structure would provide attachment surfaces for encrusting organisms, which could increase the forage base for EFH-managed species or their prey. Specifically, as you know, the Board indicated to my surprise at your 18 December 2002 public hearing--at which time the application had already been reviewed by the Board; the site inspected; and the plan modified to comply with your requests~that the application would not yet be approved but would instead be reviewed pursuant to SEQRA and approved in January 2003, provided that I immediately complete and submit a Long Environmental Assessment Form. I hand-delivered the LEAF to your office on December 24, 2002. At your 22 January 2003 meeting, however, you advised us that the application would again not be approved, but would instead be tabled due to a then hours-old moratorium. But you also assured me that you would work with us to fred a way to ensure that the Board's previous representations were honored and the application approved, as it should have been in December. However, aside from my brief conversations since that time with Lauren Standish and Brownell Johnston, who have assured me that your intent has not changed, I have seen no progress toward this end and my client is growing impatient. And now, issuance of a Tidal Wetlands Permit by the New York State Department of Environmental Conservation is being delayed due to the fact that the Town has not properly completed its end of the SEQRA coordinated review process, as necessitated by your lead agency declaration. Specifically, after I advised Ms. Standish that the DEC was awaiting a Declaration of Non-Significance t~om your office that did not appear to be forthcoming, a letter was forwarded to the DEC from Scott Hughes on behalf of the Board offering "thoughts regarding the project" (copy enclosed). Although I appreciate Mr. Hughes' honest assessment of the project, his letter is unfortunately inadequate since it does not represent a formal declaration from your Board that the project will have "no significant impact on the environment." Without such a formal declaration, the DEC cannot issue their permit. Therefore, I must request that Mr. Hughes' letter be redraffed and forwarded to the DEC, specifically declaring that it is the Board of Trustees' formal determination that the project will have "no significant impact on the environment." I must note that the Board's apparent unfamiliarity with the SEQRA coordinated review process; your apparent lack of involvement in the process itself; and the Town's inability to properly complete its coordinated review make it that much more difficult for my client to accept the fact that you requested us to engage in this process exactly one month before a moratorium was to take effect, when you had not been requiring it bom any other applicants prior to December. Frankly, it appears to my clients~who had already cooperated with the Board and revised their project design in accordance with your requests~that they were forced to engage in an essentially meaningless undertaking in paperwork that served no purpose other than to prevent them from obtaining their Town wetlands permit prior to enactment of the moratorium. Therefore, I believe that they deserve a proper explanation and some remedy to what I believe is a terribly inequitable situation. Undoubtedly, given the events and representations made by the Board with respect to this application, Broadblue, LLC should be afforded the opporttmity to petition the Town Board for an exception to the moratorium so that this situation can be resolved without litigation. Though I have no doubt that you and the other Board members have in fact acted genuinely and in good faith throughout this process, things have turned out very differently for my clients from what we were led to believe and I am obligated to continue pursuing their interests.
