It is our intention to follow the direction of the D.E.C.! Town Trustees and Army Core of Engineers. Preliminary time schedule for removal of existing dock is upon D.E.C. approval. (copy enclosed). Soundings taken on June II, 2003 indicated adequate water depths for this modification. The Board of Trustees recognizes that Fordham Canal is a man-made canal with underwater lands in private ownership. Please indicate area dredged on the amended plans submitted. The Trustees issued a permit to remove the shoal seaward of the bulkhead. 2. DEC personnel met with the Trustees, on site, along with approximately 8 concerned homeowners and Mr. Fragola. I was also present. 3. The DEC Issued a permit. However, removal of the shoal wa& not permitted. A controver&y halO ari&en. 4. Aerial photography and documentation prove that Fordham Canal wa& created in 1964. 5. Aerial photography indlcate& that all dock& are parallel to the bulkhead or &horeline on Fordham Canal. There are no catwalk& allowing Interference with &afetyand navigation. 6. I believe that under the DEC'& regulation dated May 2000 (&ee enclo&ed) &hould have allowed the dredging and the dock &ecured to the bulkhead. There would have been no controver&y a& the homeowner'& them&elve& have the &ame &tructure& (&ee aerial photograph&). 7. It appear& that the permit expedltor wa& unaware of the change in regulatlon& In May of 2000 and the DEC did not advi&e him of hi& error but proceeded to proce&& the application a& per the 1995 regulation&. AI, we met last Fall on the site with town trustees present, two representatives of the DEC, and seven residents of adjoining properties to this project. All of us heard the DEC give Mr. Fragola and Rambo Marine Contracting the permission to place their float back. and in line with, the adjoining Rutkowski property. I consider the installation as it is now, which was placed by Rambo Marine, to not only be a contradiction to the allowance of the DEC, but to be an outright hazard to navigation and a danger to any boat attempting to negotiate this condition. Mr. Fragola is planning to put a 34 foot boat with a twelve foot beam at this dock. This will place the boat well into the center ofthe canal with no consideration for the property on the opposite shore or those who must attempt to pass in between. This is not acceptable. Mr. Fragola and Rambo Marine Contracting should be held to the original plan as set forth on location by the DEC last Fall. I consider this installation to be a danger and a hazard to my family and will hold all parties present at that Fall meeting responsible. AI, when Mr. Preston took this property and made a canal. it was his primary intention to provide a navigable waterway, not a weed farm or a clam nursery. Most of all, he was concerned with safe boating. All else is secondary. There were no clams here. There were no weeds here. These are benefits derived from his undertaking. Please have another meeting and I recommend that we meet at the Rutkowski property where the hazard of this installation is best viewed.
