pervious driveway, and septic system, and all as depicted on the survey prepared by
John T. Metzger last dated October 27, 2003.

I would like to request an extension of my Southold Trustees Permit- 5587.
Issues concerning my DEC and Health Department Permits have not been fully
resolved to date. I am in communication with these two agencies and hope to have
these Permits approved and finalized in the next several months .
I understand this request will be reviewed at the next scheduled Trustees meeting and I
would like to be notified of the date and time in order to attend the meeting.

REASONS FOR BOARD ACTION:
1. Merger of Lots 067 a6d468 occuned with the Town Board's adoption (11/28/95)of
Local Law No. 23,which bboame effective January 1, 1996. Prior to January 1, 1996,
all lots In the Fzsb0 ,'Shq= Subdivision, Including the applicant's Lots #67 and #68,
were excepted fro.m the 461: area and lot width requirements of the Zoning Chapter.
The exemption existed for'74 years,since 1973.
2. The apRNcant,s4bmIftd,:plans In 1993 to the Town Trustees and the New York
State DEC to tlDnstuct a single-family residence on Lot#67, Indicating lot#68 as a
vacant and single and separate lot.

3. The applicant has testified that he only became aware that the two lots had merged
this year when he sought to reactivate his building permit.
RESOLUTIONIACTION: Accordingly, on motion by Member Tortom, seconded by
Member Collins, It was
RESOLVED, to GRANT the Waiver of merger in accordance with the application for
the following reasons:
1. Most of the Eastern Shores Subdivision is developed with single-family residences
on lots similar in stze to each of the two lots that would be reoogntzed,by this waiver of
merger.
2. The two lots were created by subdivision and protected on the Town's Exception
List from 1993 until 1997.
3. The. waiver will not result In a significant increase in. ,the density, of the
neighborhood.
4. No adverse environmental conditions are anticipated that:wpuld-.not otlw wise he
addressed by the Town Trustees or the State DEC.

The following action as taken by the Board of Town Trustees during a Regular Meeting, held on
July 24. 2002, regarding the above matter.
WHEREAS, Arthur R. Torell applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold, application dated June 19, 2002
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
July 24, 2002 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code.
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approved the application of Arthur R. Torell for a
Wetland Permit to construct a single family dwelling with an attached garage with a pervious
driveway and septic system with the condition that there be no turf on the site, there be no
clearing except for the driveway below the 8' contour, and that there be a staked row of haybales
before construction to be left in at the 8' contour. .
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Fee must be paid, if applicable and permit issued within six months of the date of this
notification.
If inspections are required, at a fee of$5.00 per inspection (See attached schedule).
