Box 1179 Southold, NY 11971 APR 1 ~ Re: Roy and Joan Berman~ Wetlands Permit No. 5001 Dear Mr. King: The captioned permit was issued on 26 May 1999 to authorize the reconstxuction of an existing dwelling and later amended on 23 January 2003 to authorize the installation of a new sanitary system. Though the originally permitted work was completexl prior to the issuance of the amended permit, the septic work authorized by the amendment has not yet been undertaken. Because the Bermans now plan to commence the septic work so long after the permit was amended, I am writing to request that the Board issue a brief statement indicating that the work may still be undertaken pursuant to the 23 January 2003 permit amendment, provided that there are no changes to the approved site plan prepared by Joseph A. Ingegno, L.S., last dated March 12, 2003. A copy of that site plan is attached hereto, along with current photographs of the site. For your information: After receiving, reviewing your'hotice", and speaking with Jim McMahon and Lauren on Fri. 4/16/99 regarding the planned construction, we are bringing the following concerns to your attention: 1. That the integrity of our property line/lines be completely respected and not encroached. Unfortunately, we had a bad experience with the immediate prior owner of the Berman's house. 2. That construction "in the same footprint" be strictly followed, according to the specifications as shown on the plans. Please notify us if any modifications or changes are made, when applicable. 3. That the proper set-back code be utilized. 4. That the property line be accurate and specifically shown on the plans. We can't determine from the plans if the 2'5" measurement is from the Berman's house to our walkway, or to the property line. Our property line is approximately 1' west/riqht of our walkway and continues out to the high water mark in the bay. Also, the property line goes ona slight slant from Rabbit Lane to the bay (not parallel to the walkway). This is according to our last survey. 5. That we be shown additional elevation plans.
