Krupski, President Town Hall 53095 Main Road P.O.Box 1179 Southold, NY 11971 Dear Mr. Krupski: As recommended by the Town Council at last night's meeting the SEQRA process was discussed in great length in regards to our applications for Cleaves Point Marina and that of Nancy Walzog. The Cleaves Point Marina application was processed and the hearing was closed. Whereas Nancy Walzog's remained open for submittals and revised drawings. The Trustees declared themselves the lead agency and both projects as "unlisted". The Board requested that Short Environmental Assessment Forms be submitted. Please note that Short Environmental Assessment Forms had been submitted with the original application on 11118/98 for the Nancy Walzog application and 2/26/99 for the Cleaves Point Marina application. Unfortunately had I known or the Board had known that this process was going to be implemented at the commencement of last night's hearing, a brief review of either the Town's file or our own would have concluded this process. We would like to request that the denial of the Nancy L. Walzog application be rescinded and the application request reopened and proceed as per Chapter 97 "Wetlands" of the Southold Town Code. Personally, I am not sure that the regulations exclude docks as outlined in "State Regulations 505" or the Town code. My discussion with Boyd Kaler at the NYSDEC Albany office projected a different interpretation than that of the Southold Town Trustees. I respectfully request that the Town Board review and interpret this section of the Town Code as to their intentions. If this is being interpreted properly by the Trustees, .!!Q docks would be allowed in Orient or Fisher's Island without a successful appeal to the Town Board of Trustees. While I agree with much of your letter, the code clearly states "no development of the near shore area," and defines that area. As Administrators of the code for the Town of Southold, we, as a Board, found that part of the code to be clearly defined and straight forward. You are certainly free to appeal to the Town Board, in their capacity, as "Board of Appeals", or any state agency with proper authority regarding this code. Box 1179 Southold, NY 11971 Re: Nancy Walzog SCTM #1000-31-14-15 Dear Mr. Krupski: As a follow up to my letter, dated December 21, 1998, and my visit to your office December 28, 1998, I would like to request a Grandfather Permit for the following existing structures that exists on the Walzog property: · The easterly jetty is 36' 4", with approximately 9' of rock jetty at the end. The elevation is approximately 12" above beach grade on the west side and approximately 16" on the east side. · The westerly jetty is 41' with approximately 8' rock jetty at the end. The west side is approximately 18" above beach grade and approximately 24" on the east side. There are two shorter jetties in the center of the property, one on each side of the existing 5' x 14.5' dock. · There is an existing stairway that extends ITom the top of the bulkhead to the lower dock. The stairway is 5' wide and has a rise of 31. 5". · There is a preexisting portion of decked dock ITom the bulkhead 5' x 14.5' (noted above). It is approximately I' to I '5' above beach grade. . . Albert 1. Krupski, Jr., President December 31, 1998 Page 2 of3 · There are 4 undecked pile bents existing encompassing 26' in length, 3 of which have cap timbers installed. The elevation starts at I' above beach grade and proceeds to 3' above beach grade. · There is an existing deck over the beach that is 6' wide and 36' 8" in length. · There is an existing bulkhead 115' long with a 29' 8" east return. The bulkhead is approximately 4' above beach grade. · We would also like to have the Grandfather Permit include the house which is closer to the water than present zoning allows. Also, please be advised that I have, with legal counsel, thoroughly reviewed in its entirety, the contents of the Southold Town Code, Chapter 37, Coastal Erosion Hazard Areas. It is my interpretation that the Board of Trustees is the "Administrator" of permit applications and the Trustees are able to grant approvals within the coastal erosion hazard area. Nowhere do I read that a dock is not allowed. At last months meeting a brief discussion in regards to our application where there may be restrictions that exist in the Coastal Erosion Hazard Areas, Chapter 37 of the Southold Town Code that do not allow docks to be constructed in designated hazard areas, and my lack of knowledge of that code required me to withdraw our application for the proposed dock on the Nancy Walzog property (SCTM #1000-31-14-15). After reviewing the entire Chapter 37 and its stated purpose, I find that the Southold Town Trustees are specifically designated as "Administrators" of the code and the Town Board is designated as the "Board of Review" for appeals. As to the "Purpose" stated in Section 37-4: Paragraph "A" cannot possible refer to a dock structure wherein the code is trying to minimize damage to structures from flooding or erosion. It is obvious that docks are constructed to allow for tidal fluctuations and can be completely immersed in water during storm conditions. I believe the purpose is to protect homes and upland structures including natural resources. ·Paragraph "B", again, refers to flooding and erosion where the purpose if to minimize damage and destruction and to protect human life. I am sure that this paragraph specifically refers to either revetments, bulkheading or upland residences too close to the waterfront they may be damaged in storm conditions. Again, a properly constructed dock is designed to allow ice conditions and storm conditions to exist without incurring damage or jeopardizing any human life. . . Albert 1. Krupski, Ir., President December 31,1998 Page 3 00 *Paragraph "c" cannot and does not refer to docks in particular. It is obvious that "placing them a safe distance rrom active erosion and the impacts of coastal storms" this is only referring to upland structures; docks are obviously built on the coast out into the water. *Paragraph "D", again refers to facilities and activities of residences in the Coastal Erosion Hazard Areas. The only monies invested in this proposed dock structure are rrom private individuals and not public funds. The Department of State Division of Coastal Resources, who initiated the adoption of the Coastal Erosion Hazard Areas throughout New York State, has stated they have no objection to the Army Corps approving the project by a "Letter of Permission". The Department of State also states to the Board of Trustees that the project is consistent with the Coastal Policies. As you are also aware, the Southold Town Conservation Advisory Council unanimously recommends approval. It should be obvious to everyone that all docks are constructed in an area that is going to be rrequented by severe weather conditions. Hopefully the Board will "reschedule a public hearing" for our original application which remains on file in the Trustee's office at Town Hall. I am enclosing 3 checks representing the Grandfather appliction fee and resubmittal of the Wetland and Coastal Erosion application fees. Of concern to this Board in particular is: 97-28-B - Cause damage from erosion, turbidity or siltation. 97-28-0 - Adversely affect fish, shellfish or other beneficial marine organisams, acquatic wildlife and vegetation or the natural habitat thereof 97-28-F - Adversely affect navigation on tidal waters or the tidal flow of the tidal flow of the tidal waters of the town. This dock application also represents a structure placed in an area unsuitable for the safe dockage ofa boat in the normal "boating season", because of the open area it is located in and the direction of the prevailing winds. Of special concern is the existing public shellfish opportunity that this dock, which would monopolize the area, would eliminate. Whereas, Chapter 37 defines the "nearshore area" in Chapter 37-6. Whereas 3 7-14-C states that" All development is prohibited in the nearshore area unless specifically provided for by this chapter." Whereas the purpose as stated in Chapter 37-4 states that in A -" Establish standards and procedures for minimizing and preventing damage to structures from coastal flooding and erosion and to protect natural protecti ve features and other natural resources." And 3 7 -4-C - "Regulate new construction or placement of structures in order to place them a safe distance . - . . 2 from areas of active erosion and the impact of coastal storms to ensure that these structures are not prematurely destroyed or damaged due to improper siting. as well as to prevent damage to natural protective features and other natural resources." It is clear that the CEHA - Chapter 37 prohibits structures in the nearshore area to prevent erosion and protect natural resources such as historic shellfish grounds on Dublic property.
