WHEREAS, Land Use Ecological Services, Inc.. on behalf of Joseph Chernushka applied to the Southold Town Trustees for a pennit under the provisions of the Wetland Ordinance of the Town of Southold, application dated December 14,2002 WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on January 22,2003 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code. . 2 . WHEREAS, the Board has detennined that the project as proposed will not affect the health, Safety and general welfare of the people of the town. NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approved the application of Joseph Chernushka for the Wetland Pennit to reconstruct and add onto the remains ofan existing catwalk 3'x82' of catwalk is proposed over an area of existing 56 linear feet of deteriorated timber catwalk - catwalk is proposed to be elevated a minimwn of2-1/2' above the wetlands and is proposed to be supported by (25) 4"x4" CCA timber dock posts with the stipulation that there not be an "L" - new plans submitted January 28,2003 BE IT FURTHER RESOLVED that this detennination should not be considered a determination made for any other Department or Agency, which may also have an application pending for the same or similar project. Fee must be paid, if applicable and pennit issued within six months of the date of this notification. If inspections are required, at a fee of$5.00 per inspection (See attached schedule). The purpose of this project is to provide the applicant with waterway access and a mooring facility for recreational vessels. WATERWAY: Marion Lake, Gardiners Bay LOCATION: East Marion, Town of Southold, Suffolk County, NY As this is minor in nature, authorization may be by Letter of Permission. This is in accordance with current Federal Regulations governing work in navigable waters of the United States.
