Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, without a permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion Hazard Area would require permits from this office. Krupski, President October 20, 2003 Re: Request for a letter of non-jurisdiction To the members of the Board of Trustees:' I have prepared a survey and plot plan for a slngle-~y residence located in East Marion that I am submitting for your review. The lot is approximately 6.5 Acres and fronts on the Main Road as well as E. Marion Lake. All grading, construction, and other ground disturbance will be beyond the 100' setback from the wetlands boundary as delineated by the NYDEC. The design of the house allows for several construction techniques that will limit the impact of the construction further. For example, by taking advantage of the natural change in elevation on the site, the garage floor will be at the same elevation as the basement floor under the main part of the house. This will allow excavation to take place from inside the footprint and out to grade at the basement location when necessary to avoid disturbance near the wetlands setback. Topsoil and fill can therefore be stockpiled well away from the non-disturbance zone. The foundation walls will be built using ICFs {Insulated concrete forms). These modular foam forms are braced using special metal braces on the interior sides of the walls. The forms stay in place pea'uanently. With this technique I will require only a maximum of three feet overcut in the excavation since exterior bracing and stripping of forms is not required. Staked bales and polyethylene sheets or other strategies suggested by the Trustees will be used along the wetlands setback line.
