all necessary precautions are taken to prevent any sadime~i~n or other
alteration or disturbance to the ground surface or vegotatf~ within Tidal

This is to request an Administrative approval for the addition
of one (1) fender pile at the south end of my existing dock,
measuring 8"x25' and which will be in-line with the outer edge
of the float.
The need for the pile is for tie-off purposes and will not
interfere with normal docking activity, and to be used as
needed.

Your recent request to modify the above pemfit has been reviewed pursuant to 6 NYCRR Pall 621
(Uuitbnn Procedures Regulations). It has been determined that tbe proposed modifications will
not substantially change the scope of the permitted actions or existing permit conditions.
Therefore, the permit is modified to autborize:
Installation of one ( 1 ) mooring pile as shown on the plans prcparcd by Tlieodore Angell on

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 24, 2002 regarding the above matter:
WHEREAS, THEODORE ANGELL applied to the Southold Town Trustees for a permit under
the provisions of the Wetland Ordinance of the Town of Southold, application dated March 21,
2002, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
April 24, 2002, at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has deterufined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of THEODORE ANGELL to
reconstruct 100' of timber bulkhead and to backfill structure with +/-10 cy. of clean sand to be
trucked in from an upland source, with the condition that the old pilings are pulled out and the
plastic sheathing is placed directly against the bulkhead, the old bulkhead is straightened where it
is bowed out, and there is to be a 10' non-turf buffer.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire t~vo years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified upon completion of said project.

the Trustees office and made an inquiry about an application under the name of Theodore
Ange[h
Mr Tomaino asked if Mr. Angell had all the proper permits for work being done on his property
located on 305 Gull Pond Lane in Greenport. He said that he was at Mr. Angell's property and
noticed a pile of fill and wondered what he was doing with it. He also claimed that he was a
neighbor at one thne of Mr Angell and that Mr. Angell had turned him in for a violation in the
past, x~bich re.,,uhed in heavy fines, and that this was "sort ora payback".
We assured him that all pernfits were in place. Mr. Tomaino seemed satisfied as he did not ask
to sec the file himselt~
