Dear Mr. Cuddy:
The following action was taken by the Board of Town Trustees during a Regular Meeting, held
on September 19,2001, regarding the above matter.
WHEREAS, Charles R. Cuddy, Esq. on behalf of Shawn Tully applied to the Southold Town
Trustees for a permit under the provisions of the Wetland Ordinance of the Town of South old,
application dated August 30, 2001
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
September 19, 2001 at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code.

WHEREAS, the Board has detennined that the project as proposed will not affect the health,
Safety and general welfare of the people of the town,
NOW THEREFORE BE IT.
RESOLVED, that the Board of Trustees approved the application of Shawn Tully for a Wetland
Permit to build a 55 foot stairway no larger than 4 feet in width along bluff to replace staÜway
removal of damage stairway to an approved upland source.
BE IT FURTHER RESOLVED that this detennination should not be considered a detennination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Pennit to construct project will expire two years ITom the date it is signed. Fees must be paid, if
applicable, and permit issued within six months of the date of this notification.

Two inspections are required and the Trustees are to be notified when project is started and on
completion of said project.

At the meeting of the South old Town Conservation Advisory Council held Tuesday,
September 11, 2001, the following recommendation was made:

marked the site with stakes. However. he suggests that in inspecting the site, you begin at the toe
of the bluff on the beach. since it is easier to see the stakes ITom that position.

§ 58-1. Providing notice of public hearings.
VI'henever the Code calls for a ;JUblic hearing, this section
shall apply. Upon determining thac an aµplication is complete,
the board or commission reviewing the same shall fix a time
and place for a public hearing thereon. The hoard or commission
reviewing an application shall provide for the giving of notice:
A. By causing a notice giving the time, date, place and
nature of the hearing to be published' in the official
newspaper within the period prescribed by law. .
B. By requiring the applicaJlt to erect the sign provided by
the town, which shall be prominently displayed on the
premises facing each public or private street which the
property involved in the application abuts, giving no"tice
of the application, the nature of the approval sought
thereby and the time and piace of the public hearing
