Dickerson Dear Trustees: I write to request your permission to correct an as-built location error in the berm you reviewed and approved for our "Snack Bar" parking lot at the Orient Poim ferry terminal, in conjunction with the Site Plan review and approval process we participated in with the Southold Planning Board. This request tbllows a phone conversation I had with Art Foster, in which I described our predicament. Specifically, it appears the contractom that installed the berm and berm plantings referenced their measurements from an existing fence comer post. This fence post is approximately 10 feet waterward of the sign post which is the designated reference point. As the contractom were working from 3~d and 4~ generation copies of our approved site plan. it is understandable that the reference point was confused as the end of the fence rather than the location oftbe sign post. This location error was brought to my attention by Ed Forrester, who inspected the site. After I reviewed the berm construction and plantings, l proposed to Mr. Forrester that we remedy the problem by simply extending the width of the berm in the landward direction approximately 10 feet so that the landward edge would fall in the specified location. With this approach, the body of the berm does not have to be disturbed, thereby protecting the plantings, which have already taken mot and begun to "grow into" the snow fence. Mr. Forrester suggested that I contact the Trustees and obtain your approval. I appreciate your consideration of this matter and would be glad to answer any questions you may have. Dear Mr. Daley: My office represents Cross Sound Ferry Services, Inc. who currently owns property in Orient, Town of Southoid, New York. Cross Sound Ferry Services, Inc. is currently before the Town Planning Board for Site Plan approval for some modifications to a parcel containing a pre-existing gravel parking lot, a portion (approximately one-quarter) of which is located seaward of the Coastal Erosion Hazard Area line. I was asked by the Planning Board to contact you to ask for an opinion about a question that has arisen on this matter. Cross Sound Ferry is before the before the Planning Board for site plan approval for some specific improvements to their parking area, to include the continued routine ragrading of the gravel/dirt parking surface, an enhancement of native buffer landscaping that surrounds the parking area, instalhtion of railroad tie curb stops to protect the plant material that exists or is to be installed, and installation of iow intensity site lighting for pedestrian safety (not to be installed below the CEllA · portion of line). During an informal discussion about this matter, a question has arisen whether the the ~ gravel parking area which is located seaward of the CELIA line can be used for vehicle parking under the CELIA regulations. The following might be helpful in your consideration of this matter. 1. The area in question is and has bean used for parking since prior to the enactment of the CEHA requirements by the Town of Southold. The Town of Southold adopted Chapter 37 of the Town Code, Coastal Erosion Hazard Area regulations in October of 1991. This area was clearly used for parking and the temporary dredge spoil disposal prior to the date of adoption. 2. Tbe parking surface is gravel/dirt/sand . _ none if it is formalized with asphalt. NEVV YORK 11969-1201 · 631-283-S958 · FAX: 631-283-5974 The parking area is used for daily parking of patron's cars when they are passengers on the Cross Sound Ferry. The seaward pordon of the parking area is occasionally used during the off- season as a temporary dredge spoil holding area when the owners are required to remove sediments from the two ferry slips. When dredging occurs within the slips, the resulting sand/gravel spoil is loaded on trucks and taken to the Orient Point State Park for beach nourishment. Due to the level of public utilization of this facility during summer months, all of the available parking is critical to the operation of Cross Sound Fern. The portion of the site seaward of the ~ line is used dally for the parking of patron's vehicles (as is the remainder of the property). From my review of the definition of"regulated activity" as well as my understanding of the purpose of the Coastal Erosion Haz,~d Area regulations, I believe that the continuation of parking within this area is allowed (or would not precluded). I believe the following supports my beliet~ The parking end spoil holding area pre-dates the adoption of the Town CEHA regulations. The parking envisioned is temporary (daily), and does not include the location of"structures" seaward of thc CEliA line. The parking su~ace is informal - sand and gravel surfaced. It is not asphalt, hard surfaced nor impermeable. No structures are proposed to be erected or installed. Only a periodic regrading of the existing surface would occur on an as-needed basis (seasonally?). No natural protective features would be disturbed by the continued utilization of this portion of the site for parking. The owners would continue to grade the parking surface on an as-needed basis, as has been done historically. Other areas on the East End which are located seaward of the CELIA Line are used as public parking areas. For example, the Shinnecock Inlet County Park (on the east side of Shinnecock Inlet) is entirely seaward of the CEliA line, yet it is used for vehicle parking (campers, trucks, 4 wheel drive vehicles throughout the summer as a recreational park. Some trailers stay for weeks at a time. When you have a chance, would you please consider this information and call me to discuss this matter. Since the Planning Board is considering this application, they want to be sure that they do not act inappropriately if they choose to approve the plan that includes parking below the CEHA line. Post Office Box 1201 36 Nugent Street Southampton, New York 11969-1201 RE: Cross Sound Ferry Terminal, Orient, Town of Southold, New York Dear Mr. Warren: Pursuant to your letter of 11 April 2000 on this same subject, I concur with your analysis that continuation of ferry terminal parking within the identified CEHA is not affected under the CEHA requirements adopted by the Town of Southold. Inasmuch as the Town essentially adopted the Model Local Law distributed by this office I will refer to the minimum standards contained within the State's Coastal Erosion Management Regulations (6NYCRR Part 505) in the following comments. Parking, by itself, if it has no effect on the inherent protective nature of the land feature upon which it is located, is essentially an unregulated activity [505.5(hh)]. Periodic grading, and other activities associated with normal maintenanc~ are similarly um'egulated activities. However, enhancement of native buffer landscaping and installation of railroad tie curb stops within the parking area, although of relatively minor impact, should be subject to a CEHA permit issued by the Town. A properly displayed Permit would have the dual advantage of informing the public that land use regulations are in effect in that area and that the Town is diligently administering those regulations. The activities, as described in your letter, would be permitable generally under the standards of section 505.6 and more specifically under the requirements of section 505.8(b). While the parking lot is not truly a beach, it is the regulatory intent behind those regulations that most nearly fits the parking area. ("SCSR"), I submit this information for the Planning Board's consideration in connection with its review of the Site Plan Application of Cross Sound Ferry Services, Inc. CCSF"), as requested in your letter of July 17, 2001. This letter should be read to incorporate SCSR's previous statements and submissions concerning CSF's most recent Site Plan Application, including those made at the July 16, 2001, heating. In addition, we believe that much of what SCSR has submitted to the Planning Board concerning CSF's previous Site Plan Application is germane to this application, particularly as it relates to traffic, water quality and the environmental impact of CSF's activities and its proposed projects. Because the revised Site Plan Application does not meaningfully address the environmental and other concerns raised by the previous application, SCSR's previous submissions concerning the environment surrounding the site and how it may be affected by CSF's activities and projects should be considered by the Planning Board at this juncture as well. SCSR strongly believes that CSF's Site Plan Application is clearly a Type I action under the State Environmental Quality Review Act (SEQRA), and therefore the Planning Board has no alternative but to make a determination that a proper environmental review must be conducted before further consideration of the Site Plan Application. In its application, CSF contends that the 10 Reasons for the Original Positive Declaration no longer apply. In fact, the contrary is true--all 10 Reasons continue to be relevant to the Site Plan, which is why this is a Type I action. Reason #1: "The project is a Type 1 action" and it "is located adjacent to the surface waters of Gardiners Bay, which comprises a portion of the Peconic Bay Estuary, and lies within the Orient Point Critical Environmental Area". "In addition, the project is in proximity to the Orient Beach State Park and 48+ acres of County Owned Land". Simply removing the Trust Property from the Site Plan Application changes none of this. Thus, the current proposal, like the previous one, may very well "impair the environmental characteristics of this CEA". Reason #2: "The proposed action will cause a significant increase in the intensity of land use on the project site, as a function of the expanded parking, demand for parking in connection with ferry operations and on-site traffic circulation for parking access." CSF contends, misleadingly, that because the proposed action consists only of "improvements" to the site and not "expanded parking", the action should be approved without any environmental review. CSF neglects to mention that the West lot had been approved in 1995 for 69 spaces, and that there has never been any approval for any parking on the Snack Bar lot. The Site Plan Application seeks to legitimize the current levels of parking on both the West lot and Snack Bar lot--which dramatically exceed anything that has ever been approved before. If the Site Plan Application were up front about what it was hoping to achieve, it would state that it seeks to expand the approved parking on those lots from a total of 69 to current levels. Notably, the Site Plan Application deliberately omits any reference to the number of parking spaces involved. Field investigations by Schneider Engineering have shown the following numbers of parked cars at the respective lots: Date Snack Bar West 2 Hour SR 25 7/6/01 235 72 8 36 7/15/0l 283 80 12 71 7/20/01 249 63 9 21 7/28/01 226 85 21 26 The total number of cars at the Snack Bar and West lots was 307 (Friday, July 6, 2001), 363 (Sunday, July 15, 2001), 312 (Friday, July 20, 2001) and 31 l (Saturday, July 28, 2001). In addition, a significant number of cars were parked on SR 25 on those days, and it would be reasonable to conclude that the overwhelming preponderance of those cars were associated with CSF's business as well. These numbers represent dramatic increases in the amount of parking at the site, and are more than enough to meet the 25% threshold under SEQRA to be deemed a Type I action. Reason #3: "The proposed action may change the need and use of public and pedestrian transportation services (including existing bike trail), and may increase the demand for other community services including fire, policy, recreational facilities and utilities." Nothing has changed in the revised site plan with respect to the plan's potential impact on these items, which is self-evident given the sheer magnitude of the increase in traffic and parking, as described above. $OUTHOLD TOWN: A DESTINATION, NOT A CORRIDOR A GATEWAY, NOT A THRUWAY SOUTHOLD CITIZENS FOR SAFE ROADS, INC. BOX 797 GREENPORT, NY 11944 Reason #4: "The proposed action **,ill cause a significant increase in the number of vehicle trips which utilize off-site infrastructure facilities primarily including existing transportation systems". Nothing has changed as a result of the revisions to thc site plan; the increase in traffic parallels the increase in parking at thc site, as described above, and the removal of thc Trust Property from the plan does nothing to address the traffic concerns. Reason #5: "The project may adversely change noise and air quality as a function of increased traffic, and/or may substantially increase solid waste generation". Again, the revisions to the site plan do nothing to address these issues. Reason #6: "Increased intensity of site use for high speed ferry service will increase the use of on-site facilities, particularly sanitary flow and water use, and may result in an adverse impact on the environment." Again, the revisions to the site plan do nothing to address these issues. Reason #7: "The project may impact visual and aesthetic resources, particularly as regards lighting, and use during both daytime and night time hours." at the site. The Site Plan Application contemplates increasing the amount of lighting Reason #8: "The proposed project may cause growth inducing aspects associated with the proposed project. In addition, the study of mitigation of potential environmental impacts and alternatives would be facilitated by the preparation o fa Draft ElS." This continues to be true for the current Site Plan Application. A proper environmental review would aid in the study of the impact the projects would have and potential alternatives. Reason#9: "Theprojectinvolvesmultipleagencyjurisdictionsand permits, and the comprehensive review of potential impacts would be facilitated through the preparation o fa Draft EIS. " CSF concedes that NYSDOT and the Town Trustees may be involved in addition to the Planning Board in this proceeding, and certainly a Draft ElS would pose no impediment to any regulatory process. Reason #10: "Impact of passenger only jet boats on marine environment." Nothing in the revised Site Plan Application addresses this concern. Without a Draft EIS, there will be no way to determine whether the quality of the water in this Critical Environmental Area is adversely affected. CSF is attempting to seek back-door approval of the dramatic increase in parking at the West and Snack Bar lots without the appropriate environmental review that without question would have been required had it openly requested the kind of expansion in parking that is contemplated here. The Planning Board should not reward CSF for neglecting to include the number of parking spaces in its Site Plan Application, when it knows full well that had CSF included that number, there would be no question that the project is a Type I action. TEI~M1NAI.,. o!nn~NT, NEW YORK. Dear Mr. Daley: My office represents Cross Sound Feny Services, Inc. who currently owns property in Orient, Town of Southoid, New York. Cross Sound Feny Services, Inc. is currently before the Town Planning Board for Site Plan approval for some modifications to a parcel containing a pre-existing gravel parking lot, a portion (approximately one-quarter) of which is located seaward of the Coastal Erosion H*7*rd Area line. I was asked by the Planning Board to contact you to ask for an opinion about a question that has arisen on this matter. Cross Sound Ferry is before the before the Planning Board for site plan approval for some specific improvements to their parking area, to include the continued routine regrading of the gravel/din parking surface, an enhancement of native buffer landscaping that surrounds the parking area, installation of railroad tie curb stops to protect the plant material that exists or is to be installed, and installation of Iow intensity site lighting for pedestrian safety (not to be installed below the CEHA line). During an informal discussion about this matter, a question has arisen whether the portion of the pre-existino gravel parking area which is located seaward of the CEHA line can be used for vehicle parking under the CEHA regulations. The following might be helpful in your consideration ofthis matter. Thc area in question is and has been used for parking since prior to the ena~,ent of the CEHA requirements by the Town of Southold. The Town of Southold adopted Chapter 37 of the Town Code, Coastal Erosion Hazard Area regulations in October of 1991. This area was clearly used for parking and the temporary dredge spoil disposal prior to the date of adoption. The parking surface is gravel/dirt/sand - - none if it is formalized with asphalt. No fomud drainage structures nor curbing exist. The seaward portion of the parking area is occasionally used during the off- season as a temporary dredge spoil holding a~a when the owners are r~qulred to remove sediments ~om the two feny slips. When dredging occurs within the slips, the resulting sand/gravel spoil is loaded on trucks and taken to the Orient Point State Park for beach nourishment. Due to the level of public ut;l;=*tlon of this facility during summer months, all of the available parking, is ~iilcal to the operation of Cross Sound Fern'. The portion of the site seaward of the ch'ltA line is used daily for the parking of patron's vehicles (as is the remainder of the property). From my review ofthe definition of"reguinted a~tivity" as well as my understanding of the purpose of the Coastal Erosion HaT*rd Area regulations, I believe that the continuation of parking within this area is allowed (or would not precluded). I believe the following supports my belief: The parking and spoil holding area pre-dates the adoption of the Town CEHA regulations. The parking envisioned is temporary (daily), and does not include the location of"structures" seaward ofthe CELIA line. The parking surface is infonusl - sand and gravel surfaced. It is not asphalt, hard surfaced nor impermeable. No structures are proposed to be erected or installed. Only a periodic regrading of the existing surface would occur on an as-needed basis (seasonally?). No natural prate.dye features would he disturbed by the continued utilization of this portion of the site for parking .Tho owners would continue to grade the parking surface on an as-needed b~,!~, as has been done historically. Other areas on the East End which are located seaward of the CEHA Line are used as public parking areas. For example, the Shinnecock Inlet County Park (on the east side of Shinneco~k Inlet) is entirely seaward of the CELIA line, yet it is used for vehicle parking (campers, trucks, 4 wheel drive vehicles throughout the summer as a recreational park. Some trailers stay for weeks at a time. When you have a chance, would you please consider this information and call me to discuss this matter. Since the Planning Board is considering this application, they want to be sure that they do not act inappropriately it'they choose to approve the plan that includes parking below the CEHA line. Raynor, P.E. The drainage notes indicate that the major portion of the run-off generated will be absorbed bythe nature of the permeable surface provided. It is also noted that a secondary overflow drainage system has been proposed to ensure adequate drainage and that this system was not the result of actual drainage calculations. The proposed stone blend parking area may be somewhat permeable but the Town standard Run-Off coefficient for this type of surface is (0.6) or sixty percent. If the actual area of proposed stone blend parking areas are calculated and multiplied by a two inch rainfall with a run-off coefficient of 0.6, the amount of required volume storage for drainage would be considerably more than that proposed by the empirical design indicated on the site plan. At this time it is recommended that new drainage calculations be provided and the proposed drainage system be revised and to meet the current Town Standard. At this time, it is also recommended that the Town Trustees have the ability to comment on the location of the proposed "Staked Utility Pole Barrier" and any expansion of the parking areas that may be within their jurisdiction.
