Dear Ms. Martin:
The Southold Town Board of Trustees reviewed the site plan prepared by Fairweather-
Brown Design Assoc. dated April 26, 2004 and determined the proposed single-family
dwelling to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland
Code and Chapter 37 of the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, without a permit. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and
Coastal Erosion Hazard Area, which may result from your project. Such precautions
may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay bale berm.
However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion
Hazard Area would require permits from this office.

Enclosed is an application submitted by the above-referenced for a letter of no-
jurisdiction to construct a dwelling, garage, and swimming pool.
A Notice of Violation was issued to the property owner on October 10, 2003 for clearing
without a permit and the violation was never resolved. Since that time, the Bay
Constable reported that the area has "somewhat re-vegetated itself". The Board
respectfully requests you inspect the property in order to determine whether or not the
property has adequately re-vegetated itself.

Chairman Al Krupski and members of the Board of Trustees,
Attached please find my application in behalf of the above named property owner. This is
for a new single family residence to be constructed on what is now vacant land.
The proposed residence is to be constructed 100 fi. from the bluff and 75 ft from the
coastal erosion hazard line. There is an existing well on the property which has been
certified to be producing potable water and thus we have designed the septic system to be
the appropriate distance to meet Health Dept. standards.
There will be dryweIls as drawn to catch all roof/rainwater runoff from the residence by
gutters and/or French drains. An erosion barrier of hay bails or other approved protection
shall be in place during construction. Driveway surfaces shall be of a pervious material.
A fall, 2004 start is expected for this project
