SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 1.4 +- acre lot has frontage along three streets: (a) 300.85 feet along the east side of Oriental Avenue, (b) 344.15 feet along the south side of The Gloaming, (c) 156.89 feet along the south/west side of Montauk Avenue, Fishers Island. The property is improved with an existing single-family dwelling with deck and swimming pool, and accessory garage, as shown on the 11/10/2003 survey prepared by Richard H. Strouse, L.L.S. BASIS OF APPLICATION: Building Department's December 17, 2002 Notice of Disapproval, citing Section 100-33, in its denial of the location of a proposed accessory garage/greenhouse in a front yard location, and Notice of Disapproval amended November 13, 2003, citing Section 100-244 in its denial of the location of a proposed addition with a front yard setback at less than 55 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 18, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: About December 17, 2002, the applicant applied for a building permit to construct a detached 24' x 30' garage with an 8' x 24' attached greenhouse, the northeast corner of which will be 15 feet from the northerly front lot line (along The Gloaming), as shown on the 8/16/03 site plan, amended 10/30/02, prepared by Richard H. Strouse, L.L.S. ADDITIONAL INFORMATION:AMENDED RELIEF: During the September 25, 2003 public hearing, the applicant was requested by the Board to consider an alternative that would be more conforming to the code's minimum front setback requirement of 50 feet. On December 17, 2003, the applicant submitted a revised plan to attach the proposed 26' x 30' addition with 8' x 30' porch, at the northeast section of the dwelling, increasing the front yard setback from 15 feet to 27.5 feet from the . .Page 2.—January 8,2004 App;. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant needs a garage for parking of their private vehicles, since the existing detached garage, located in the northwesterly yard area, will be converted to storage for the applicant's family, rather than for parking of their vehicles. The property has three front yards and a single rear yard, all of which require greater setbacks than would be required for a side yard. The applicants have increased the setback which provides direct access from the owner's driveway rather than from The Gloaming. The property is extensively landscaped and an inground swimming pool and sanitary system are established in the westerly yard area, behind the house. The driveway to the dwelling is in the easterly yard area facing Montauk Avenue, and the alternative plan shows easy access from the applicant's driveway, without a need to back out onto the street. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The dwelling is only 57-60 feet from both The Gloaming and Montauk Avenue, which limits any conforming area for a garage as an addition to the dwellina ..ice granted herein is substantial. The required minimum front yard setback is 50 feet, relief granted is a 22+-ft. reduction. 4. The difficulty was self-created when the additions were designed without conforming to the current Town Code requirements. 5. No evidence has been submitted to suggest that a variance in this residential community will. have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition for an addition and porch, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Orlando, and duly carried, to DENY the variance as applied for, and to ,Page 3,—January 8, 2004 Appl. To locate the accessory structure in the designated rear yard is not practical due to the topography and lack of space . To locate it in the designated front yard on Montauk Avenue would not be aesthetically pleasing and in reality this is the actual front yard. To locate it in the front yard on Oriental Avenue would be also be disadvantageous due to the golf balls that are hit in that yard area during the golf season from the Hay Harbor Golf Club. Further, from a safety point of view, backing a car out onto Oriental and Montauk Avenues is not a good idea as they are very busy thoroughfares . The front yard facing The Gloaming is in reality a side yard and is not a busy street at anytime of the year. Therefore, a car pulling in and out of The Gloaming will not be a safety hazard. Furthermore, The Gloaming is fairly level as it borders applicant ' s property so there is adequate visibility. (6) CONTINUED. The existing garage fronting on The Gloaming is used primarily for storage as it is too small for two cars . In other words, they moved it up 3 another 12 . 5 away from the road, and, in fact, from a numbers point of view, it' s really a 50 4 percent request now as opposed to the other number before for the variance in the front 5 yard in this area. Miss McLean wanted to be here, but a glitch in her scheduling didn' t 6 allow it, and she' s kind of talked to Mr. Horning, and she' s kind of thrilled with 7 the rethinking of the project, because not only does it give her the storage that before 8 she was upset about that they didn' t have, but it' s given them additional living space . It' s 9 worked out quite nice, and she' s quite happy with the amendment as you have it before you. 10 So I think not to belabor the record, for all the reasons that I gave you before that meet 11 the statutory criteria to give the area variances required and the balancing test 12 apply not only here again, so I won' t belabor that and I just ask respectively that you do 13 approve the application with this reduction as you have before you today. 14 CHAIRWOMAN OLIVA: Thank you, Mr. Lark. Just to put 8 everything in reference before she speaks, the Board is familiar with this property, having 9 granted the relocation of the residence under appeal Number 4764 . And it' s one of the 10 unique properties in the entire town in that it' s got three front yards and very little 11 rear yard on which it' s has been designated because of the three front yards . 12 The proposal before you was created by her designer, BD Design, because 13 the McLeans sought more storage space in their house for their premises there, and what they 14 proposed was the garage, I won' t speak to the application per se because you've all reviewed 15 it and spoke to the applicant, and it' s a verified petition and you' re well aware of 16 what' s in it . The existing garage that' s being 17 utilized, as we speak today, is going to be converted to storage. Now, the problem that 18 we have here is that this is in an R80 zone, and to the existing house today is right at 19 161 feet as shown by the site plan from the gloaming. So anything that' s done in that 20 area because it is a designated front yard, would require a variance, and I understand 21 that Mrs . McLean has been talking about the y. Board, Board members concerning it . 22 What concerns me is in the thinking here this morning at this hearing is 23 what the Board would allow as a permissive front yard variance, considering the fact that 24 the existing garage on the gloaming is 21 feet at its closest point . MCLEAN: Okay. CHAIRWOMAN TORTORA: The Board 6 members did inspect this site at our annual meeting in August . 7 MRS . MCLEAN: Right . CHAIRWOMAN TORTORA: And the owner 8 was at the site at the time, and the Board members did clearly express concern that at a 9 15 foot setback from the road that cars would be backing out into the road, and the Board 10 members were very concerned and asked Mrs . McLean at that time to give serious 11 consideration, since it is new construction, to consider moving it further back, so that we 12 would not have what amounts to a traffic hazard on that road. 13 You know, I recognize that it is not a major thoroughfare; on the other hand, d4 14 we also have to think down the road in the future and certainly not to try to create a 15 situation that would be a potential hazard to people who are using the road. And having 16 said that, please give us your thoughts? MRS . MCLEAN: I think that' s a 17 very fair point that you've raised, and in considering all that, my husband and I have 18 had unfortunately just preliminary conversations with our builder and architect, 19 but in order to move the building back, which we understand why it' s necessary to do and 20 we'd be happy to do, we' re really getting into an issue of it getting so close to the house, 21 and thinking we therefore have to attach it to the house . And as I understand it, that 22 changes the whole situation in terms of what it actually is what we' re-asking for a 23 variance for. CHAIRWOMAN TORTORA: Actually, if 24 you' re thinking of incorporating this as part of the house, it would no longer be an • , 25 accessory, it would be a detached accessory building. Remember, this is a 64, 000 square foot lot, and there 11 are a lot of options, and I think the board member on Fisher' s Island has correctly stated 12 the Board' s feeling. BOARD MEMBER HORNING: It is a 13 hilly area, however I will say I am inclined towards the applicant revising their plan and 14 attaching it to the house and working with the Aie building department, and we' ll see what they 15 come up with, and they would be better suited for our decision at that point I think. The problem is we have a 10 garage as it now stands, but it' s so filled with stuff, garden furniture, whatever, that 11 we can' t store our cars in it . So we' re looking for a place to store cars . We' re now 12 beginning to think the other way, that maybe what we should be building is an addition we 13 can use for storage and go back to putting the cars in the garage . 14 CHAIRWOMAN TORTORA: Mrs . No. 4764 - LOCKE McLEAN STREET& LOCATION: Oriental Avenue, Fishers Island DATE OF PUBLIC HEARING: December 14, 1999 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The applicant's lot is 1.4+- acre in size with frontage along three streets: Oriental Avenue, The Gloaming, and Montauk Avenue. The lot is improved with a single-family dwelling (to be relocated herein) and an accessory garage. BASIS OF APPLICATION: Building Inspector's March 24, 1999 Notice of Disapproval based on Article XX, Section 100-244 of the Zoning Code and applicant's request to relocate the existing dwelling and construct an addition. The reasons stated in the Notice of Disapproval are: (a) the proposed front yard from Montauk Avenue is approximately forty-five (45) feet instead of the required fifty-five (55) feet, with the October 14, 1999 construction plans showing the proposed patio will be raised above natural grade on fill; and (b) the proposed rear yard setback is thirty-five (34) feet instead of the required seventy- five (75) feet. AREA VARIANCE RELIEF REQUESTED: Applicant requests a Variance in this relocation of an existing dwelling, with a proposed rear yard setback at thirty-four (34) feet. Also, the map submitted initially to the building department had a patio proposed at 45 feet for a front yard setback at its closest point. On December 14, 1999, a modified plan was submitted to the Board showing removal of the entire patio and conformity for all front yard lines from the proposed dwelling. REASONS FOR BOARDACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection,the Board makes the following findings: 1. Moving of this single-family to another location on the applicant's R-80 Residential parcel will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because the one neighboring house is also located on the highest elevation within its own parcel, and is a considerable distance from the proposed location of the dwelling. 2. The benefit sought by applicant cannot be achieved by some method, feasible for appellant to pursue other than an area variance. The applicant seeks to relocate an existing single-family residence to another location on the same parcel. The proposed relocation site is 165+- feet from the Town right-of-way called Oriental Avenue, where the existing building is set back 31 feet. This change is explained by the applicant Page 2- December 14, 1! l L ZBA Appl. No. 4764- Locke McLean Parcel 1000-10-10-5 at Fishers Island as being necessary to create a larger buffer between the house and Hay Harbor Golf Course immediately across the street, also on Oriental Avenue. The applicant wants to retain a southwesterly view of the Sound by moving the building away from the Sound and locating it on higher elevation than where it now exists. Because of the irregular shape of the property and the fact that the property contains three front yards, an area variance is necessary for the applicant to proceed with this plan. 3. The requested area variance is substantial. The proposed rear yard (34 feet) is an approximate 55% reduction from the R-80 Code requirement of 75 feet. However, the applicant's difficulty in locating a conforming rear yard is greatly exacerbated by the existence of three front yards and no side yard. 4. There is no evidence that grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because there will be only one single-family dwelling on this parcel and there are no wetlands or other significant environmental features on the property that will be adversely affected by the proposed dwelling re-location. 5. In considering this application, the Board deems this action to be the minimum necessary and adequate to enable the applicants to enjoy the benefit of a new location for a dwelling, while preserving and protecting the character of the neighborhood and the health,safety, welfare of the community.
