REASONS FOR AREA VARIANCE:
1. An undesirable change will NOT be produced in the character of the neighborhood or a det-
riment to nearby properties, if granted BECAUSE:
Most properties within 500 feet on the same side of the road have accessory structures in
the front yard with setbacks similar to the existing structure we propose to renovate. The
property immediately to the north has a two-story structure closer to the road
2. The benefit sought by the applicant CANNOT be achieved by some method, feasible for
the applicant to pursue,other than an area variance BECAUSE:
The structure resulting from the proposed renovations could not be located anywhere on
the property in such a way that an area variance would not be required
3. The amount of relief requested is not substantial BECAUSE:
A building of the size and configuration proposed would be acceptable as an accessory
structure were it not for the setback situation. The location is defined by the existing
building and it is not proposed to expand the footprint
4. The variance will NOT have an adverse effect or impact on the physical or environmental
conditions in the neighborhood or district BECAUSE:
The building already exists and has existed for many years in the same location. The pro-
posed renovation will not have any adverse impact on the stated conditions in the
neighborhood.

Is returned herewith and disapproved on the following grounds:
The proposed construction, on this non-conforming 24,821 square foot lot in the R-40 District, is not
permitted pursuant to Article XXIV Section 100-242A which states:
"Nothing in this article shall be deemed to prevent the remodeling, reconstruction or
enlargement of a non-conforming building containing a conforming use,provided that such
action does not create any new non-conformance or increase the degree of non-conformance
with regard to the regulations pertaining to such buildings."
The construction survey for this accessory structure indicates a 14' front yard setback. Pursuant to the
ZBA's interpretation in Walz (#5309), such 2nd story addition will thus constitute an increase in the
degree of non-conformance.
Therefore, the 2nd story addition&alteration are not permitted pursuant to Article III Section
100-33C which states that in the case of a waterfront parcel, accessory' buildings & structures may be
located in the front yard,provided that such buildings tures meet the front yard setback
resuirements as set forth b this Code. The re•uir,• front yard s tback for this lot per 100-244, is 40'.
Furthermore,the prQQposed alteration is non-conforming and not permitted pursuant to Article III,
Section 100-31A which states:
Permitted Uses
"One Family detached dwelling , not to ex one per lot."
The proposed plans constitt'a second dwell' g unit.
The total lot coverage is less than 20 percent.

Based on the information you have submitted,the New York State Department of Environmental Conservation
has determined that: The portion of property, located landward of the functional bulkhead,which is more than
100 feet in length and was constructed prior to August 1977 as shown on the aerial photograph by Aerographics
#74-2073 dated March 24, 1976 is beyond the jurisdiction of Article 25 (Tidal Wetlands).
Therefore,in accordance with the current Tidal Wetlands Land Use Regulations(6NYCRR Part 661)no permit
is required under the Tidal Wetlands Act. Please be advised,however,that no construction,sedimentation,or
disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary,as indicated above,
without a permit. It is your responsibility to ensure that all necessary-precautions are taken to prevent any
sedimentation or other alteration or disturbance to the,ground surface or vegetation within Tidal Wetlands
jurisdiction which may result from your project. Such precautions may include maintaining adequate work area
between the tidal wetland jurisdictional boundary and your project(i.e.a 15'to 20'wide construction area)or
erecting a temporary fence,ban ier, or hay bale berm.
Please be further advised that this letter does not relieve you of the responsibility of obtaining any necessary
permits or approvals from other agencies. .

County Tax Map No. 1000 - Section 53 Block 6 Lot 19
Is returned herewith and disapproved on the following grounds:
The proposed construction, on this non-conforming 24,821 square foot lot in the R-40 District, is not
permitted pursuant to Article XXIV Section 100-242A which states:
"Nothing in this article shall be deemed to prevent the remodeling, reconstruction or
enlargement of a non-conforming building containing a conforming use,provided that such
action does not create any new non-conformance or increase the degree of non-conformance
with regard to the regulations pertaining to such buildings."
The construction survey for this accessory structure indicates a 14' front yard setback. Pursuant to the
ZBA's interpretation in Walz (#5309), such 2nd story addition will thus constitute an increase in the
degree of non-conformance.
Therefore, the 2nd story addition& alteration are not permitted pursuant to Article III Section
100-33 C which states that in the case of a waterfront parcel, accessory buildings &structures may be
located in the front yard, provided that such buildings and structures meet the front yard setback
requirements as set forth by this Code. The required front yard setback for this lot per 100-244, is 40'.
Furthermore, the proposed alteration is non-conforming and not permitted pursuant to Article III,
Section 100-31A which states:
Permitted Uses
"One Family detached dwellings, not to exceed one per lot."
The proposed plans constitute a second dwelling unit.
The total lot coverage is less than 20 percent.

INSTRUCTIONS
a.This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 3
sets of plans, accurate plot plan to scale.Fee according to schedule.
b.Plot plan showing location;Qf lot and of buildings on premises,relationship to adjoining premises'or public streets or
areas,and waterways.
c.The work covered by this application may not be commenced before issuance of Building Permit.
d.Upon approval of this application,the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e.No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f.Every building permit gha1l expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date.If no zoning amendments or other regulations affecting the
property have been enacted in the interim,the Building Inspector may authorize,in writing,the extension of the permit for an
addition six months Thereafter,a new permit shall be.required. ,
