Property Location: 3630 North Sea Drive, Orient; Parcel 15-1-1.
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without an adverse effect on the environment if the project is implemented
as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 29,626+- sq. ft. parcel has 110 ft. frontage
along the north side of North Sea Drive in Southold. The property is improved with a single-family,
two-story frame dwelling as shown on the October 31, 1979 survey prepared by Roderick VanTuyl,
P.C.
BASIS OF APPLICATION: Building Department's November 17, 2003 Notice of Disapproval,
amended November 21, 2003, citing Sections 100-242A and 100-244 in its denial of a building
permit application concerning additions and alterations proposed at less than 15 feet on one side
and less than a total of 35 feet for both side yards. The applicant has submitted a former survey and
site plan information to indicate the setback from the top of the bluff at 65 feet.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on January 22, 2004, at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a second-floor addition
over the existing westerly one-story section of the house. The proposed setback reduction area
involves 3 feet on the west side, at the same 12 ft. side setback, and a 4 ft. reduction on the total of
both side yards, to the same 31 ft. total. No reduction on the bluff side of the house is requested,
and the applicant proposes the addition to remain within the existing building line of the house in
order to provide for a handicap bathroom and bedroom.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the relief requested will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The applicant's house is one of the few single-

story houses left among the larger two-story houses in the neighborhood along North Sea Drive.
The existing side yard setback of 12 feet on the west side of the house will remain the same, as well
as the existing total side yards, unchanged, at 31 feet.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to
pursue, other than an area variance. This particular lot is narrow and long, which leaves the side
yards with little room for expansion, leaving the most feasible design over the first story of the
existing house.
3. The requested area variances are minimal, resulting in 11.4% reduction from the total side yards,
and 20% reduction on the single side setback. The addition, as applied for, is not proposed to
extend closer toward the bluff than the existing dwelling.
4. The difficulty was self-created when the property was purchased with the knowledge of tight side
yard tolerance.
5. There is no evidence that the grant of the relief will have an adverse effect or impact on physical
or environmental conditions in the neighborhood or district. The area slopes slightly slopes away
from the bluff toward the house, and overland water flow is directed away from the bluff. The
applicant will be installing gutters with down spouts and drywells to properly contain water and to
reduce any threat of erosion on the bluff or flooding around the house.
6. Grant of the side yard setback relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of an addition, while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by
Chairwoman Oliva, and duly carried, to
GRANT the variances as applied for, as shown on the site plan (received and stamped
December 2, 2003), and elevation drawing prepared by Jeffery T. Butler, P.E. November 3,
2003, SUBJECT TO THE FOLLOWING:
Installation of gutters with down spouts and drywells to properly contain water and to
reduce any threat of erosion on the bluff or flooding around the house.
This action does not authorize or condone any current or future use, setback or other feature of the subject
property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly

The proposed addition/alteration to a non-conforming single family dwelling, on a non-conforming
29,626 square foot parcel in the R-40 District, is not permitted pursuant to Article XXIV Section 100-
242A which states;

enlargement of a non-conforming building containing a conforming use, provided that such
action does not create any new non-conformance or increase the degree of non-conformance
with regard to the regulations pertaining to such buildings."
The existing single-family dwelling notes an existing single side yard setback of+/- 12 feet and a total
side yard setback of+/- 31 feet. The new addition will maintain those setbacks.
Therefore, the proposed addition is not permitted pursuant to Article XXIV, Section 100-244,which

Dear Chairwoman Oliva:
A site inspection of the McGuire property(ZBA—5465, SCMAP 15-1-1) at 3630 North Sea
Drive Orient, New York was completed on December 31, 2003. It was requested that the
visit be conducted in response to a second story addition of handicap bathroom with
attached bedroom.
It was determined that the proposed addition would be located approximately 35 feet
away from the top of the bluff, not 61'-11" inches as indicated on the site plan map.
There is also active erosion occurring on the top portion of the bluff forming an
overhanging lip.
The area between the bluff and house slightly slopes away from the bluff towards the
house. Thus, overland water flow is directed away from the bluff. The western side of
the bluff where the addition is to be located is very sparsely vegetated, unlike the bluff
face to the east of the patio, which is fully vegetated with Rosa rugosa and Montauk
daisy plants. Thus, the distance to the bluff and its active erosion at this location are
both cause for concern with the building addition.
Further inspection revealed that the existing house is fitted with gutters and down
spouts in combination with dry wells. Since-the existing house is fitted with this
equipment, it appears that the bluff erosion is occurring due to natural forces instead of

recommended that action be taken to stabilize this eroding bluff.
Vegetation such as Rosa virginica should be planted to stabilize the bluff and the
overhanging lip on the bluff should also be cut back to reduce future erosion. Literature
on how to prevent bluff erosion is included with this letter and the homeowners can
contact our office directly for further assistance.

It is our further recommendation that any addition to the house should
be fitted with the gutters, down spouts and drywells in order to
compensate for the increase in runoff caused by an increase in
impermeable area. Such installation will help reduce the threat of
erosion on the bluff and flooding around the house.

Dear Sir or Madam:
Please find enclosed a copy of the Legal Notice describing your recent application. The Notice
will be published in the next issue of the Long Island Traveler-Watchman newspaper.
1) By January 5th: Please send the enclosed Legal Notice, with both a cover letter including
a contact person and telephone number, and a copy of your survey filed with this application
which shows the new construction area, CERTIFIED MAIL, RETURN RECEIPT REQUESTED,
to all owners of land (vacant or improved) surrounding yours, including land across any street,
railroad tracks, or right-of-way that borders your property (please see revised Town Code Ch. 58
enclosed). Use the current addresses shown on the assessment rolls maintained by the Town
Assessors' Office located at Southold Town Hall (765-1937) and the County Real Property
Office at the County Center, Riverhead. If you know of another address for a neighbor, you may
want to send the notice to that address as well. If any letter is returned to you undeliverable,
you are requested to make other attempts to obtain a mailing address or to deliver the letter to
the current owner, to the best of your ability and to confirm this in either a written statement, or
at the hearing, with the returned letter. Please either mail or deliver to our office your Affidavit
of Mailing (form enclosed) with parcel numbers, name and addresses noted, and return it
with the white receipts postmarked by the Post Office. (Also, when the green signature cards
are returned to you by the Post Office, please mail or deliver them to us as soon as possible
before the scheduled hearing.) If any signature card is not returned, please advise the Board at
the hearing and return it when available. These will be kept in the permanent record as proof of
all Notices.
2) By January 12th: Please make arrangements to place the enclosed poster on a sign board
such as plywood or similar material, posting it at your property for at least seven (7) days; the
sign should remain up until the day of the hearing. Securely place the sign on your property
