The difficulty was not self-created. The topography of this lot is such that it has a steep increase in grade from the front lot line to approximately 100 feet into the lot. Building any structure closer to the front lot line will require expensive retaining walls and grading. Building the garage in the rear yard after setting the house back to avoid the steep grade will reduce the usable space in the rear yard and render the front yard useless. 3. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance, because town code requires that accessory structures be constructed in the rear yard. Due to the topography of the lot, placing the garage in the required rear yard would reduce much of the usable space. 4. The variance granted herein is not substantial. The minimum front yard for a principal structure in this zone in 40 feet. The applicant proposes to place the garage 118.8 feet from the front lot line.. This represents nearly a 300% increase in the distance from the front lot line required by the code. 5. No evidence was submitted during the hearing or in the written record to indicate that the grant of the variance will have an adverse effect or impact on physical or environmental conditions in the neighborhood or district. Setting the garage and house back, away from the steep grade will require less disturbance to the physical and environmental conditions of the neighborhood. 6. Grant of the relief requested is the minimum necessary and adequate the enable the applicant to enjoy the benefit of a detached garage, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. • RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Chairwoman Oliva, and duly carried, to GRANT the variance as applied for, as shown on the June 8, 2000 survey, amended May 24, 2004 by Joseph A. Ingegno, L.S. (and referring to the 5/21/04 plans prepared by Thomas E. Kosonen, R.A., SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the south and east sides of the garage be landscaped with evergreen trees such as spruce or pine or similar), and be continuously maintained in good condition. That the Board reserves the right to inspect the landscaping for conformity to this decision. 3. I have consulted with the owner, Mr. Kevin Miller regarding this request. It is Mr. Millers' position that the garage as proposed is well below the height that is allowable by code. He has already limited the height of this building with his initial application and feel that lowering it any further will compromise the architecture as well alter his usability of the structure. Inherent in the design that is before you is a low slope dormer with a 2 on 12 pitch. Additionally, for the record it should be noted that the garage doors as labeled on the plans as "front" are not facing the street. Mr. Miller considers the front of the garage to be as he would enter it from the driveway side. These doors will face North.
