SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 1.4 +- acre lot has frontage along three streets: (a) 300.85 feet along the east side of Oriental Avenue, (b) 344.15 feet along the south side of The Gloaming, (c) 156.89 feet along the south/west side of Montauk Avenue, Fishers Island. The property is improved with an existing single-family dwelling with deck and swimming pool, and accessory garage, as shown on the 11/10/2003 survey prepared by Richard H. Strouse, L.L.S. BASIS OF APPLICATION: (1) Building Department's March 4, 2004 Notice of Disapproval citing Section 100-33, in its denial of the location of a proposed accessory garage/greenhouse in a front yard location, and Notice of Disapproval amended November 13, 2003, citing Section 100-244 in its denial of the location of a proposed addition with a front yard setback at less than 55 feet, and (2) in addition, a rehearing was granted concerning Appeal #5388, to include and clarify the purpose of the new construction, as shown on the March 9, 2004 revised construction details. Both the previous greenhouse plan and new garage were eliminated, and in its place and stead is an addition to the dwelling for additional living area with basement below and porch. The proposed construction will be less than 55 feet from the front lot line at The Gloaming. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 22, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: PRIOR RELIEF/ZBA #5388: About December 17, 2002, the applicant applied for a building permit to construct a detached 24' x 30' garage with an 8' x 24' attached greenhouse, the northeast corner of which will be 15 feet from the northerly front lot line (along The Gloaming), as shown on the 8/16/03 site plan, amended 10/30/02, prepared by CME Associates Engineering & Land Surveying, PLLC. During the September 25, 2003 public hearing, the applicant was requested by the Board to consider an alternative that would be more conforming to the code's minimum front setback Page 2—May 6, 2004 Appl. On December 17, 2003, the applicant submitted a revised plan to attach the proposed 26' x 30' addition with 8' x 30' porch, at the northeast section of the dwelling, increasing the front yard setback from 15 feet to 27.5 feet from the front lot line along the Gloaming, shown on the 11/10/03 amended site plan, prepared by Richard H. Strouse, L.L.S. AMENDED REQUEST: In this Petition, the applicants request a 26' x 30' 1-1/2 story addition with living area on the second floor and basement below, and 8'x30' addition for a porch, at the northeast section of their dwelling. The addition is proposed to be 27.5 feet from the front property line, as shown on the February 9, 2004 elevation and floor sketches. Although the setbacks conform to the November 10, 2003 map prepared by CME Assoc. Engineering, and Surveying, PLLC, the February 9, 2004 building diagrams were modified by applicant with removal of plans for a new garage area. (See Building Inspector's December 17, 2002 and November 13, 2003 Notices of Disapproval regarding construction of a garage/greenhouse addition). The applicants intend to expand the living and storage areas of the home, to add a new porch, and to utilize the existing detached garage located in the northwesterly yard for parking of their private vehicles. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. During the last 12 months, the Board considered different plans. The February 9, 2004 site plan before the Board was the subject of the Building Inspector's March 4, 2004 Notice of Disapproval, and is for a proposed 1-1/2 story addition at the north side, 26' x 30' in size, and elevated above the existing grade, to be even with the first floor of the dwelling. The lower part of the addition is a basement. There will be no backing out of cars onto the street. After site visits of the area and this site, the Board concluded that the amendments as described will not be undesirable or cause any change in the character of the neighborhood. 2. The property has three front yards and a single rear yard, all of which require greater setbacks than the code requirement on a single side. The property is extensively landscaped and an in- ground swimming pool and sanitary system are established in the westerly yard area, behind the house. 3. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The dwelling is only 57-60 feet from both The Gloaming and Montauk Avenue, with a large landscaped driveway area in front of the house, which limits any conforming area to add onto the dwelling. 4. The variance granted herein is substantial. The required minimum front yard setback is 50 feet, and the relief granted is a 22+-ft. reduction. Page 3—May 6, 2004 - r Appl. No. 5510—Locke McLean CTM#10-10-5 • 5. The difficulty was self-created in that this 63,000 sq. ft. lot has three front yards. 6. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 7. Grant of the alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Chairwoman Oliva, and duly carried, to GRANT the application as applied for, as shown on the 11/10/03 site/survey map and 2/9/2004 elevation/floor sketches, prepared by CME Associates Engineering & Land Surveying, PLLC. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board of Appeal ' s rendered a decision on January 8, 2004, which was corrected on 2/4/04, which granted your Petitioners the alternative relief as set forth in the 11/10/2003 site plan for a proposed 26 ' x 30 ' addition and a 8 ' x 30 ' porch which are to be attached to the dwelling in the front yard area and the Board approved a variance of 27 . 5 foot setback from The Gloaming. Due to some confusion, the corrected decision contained a misconception that the reason for the proposed amended application for an alternative relief is for a garage to be attached to the dwelling. As stated at the hearing, your Petitioners intend to keep and utilize the existing detached garage at its present location as shown on the site plan. Instead of proposing a detached 24 ' x 30 ' garage and a 8 ' x 24 ' greenhouse in the front yard area, the Petitioners are now proposing a 26 ' x 30 ' addition and 8 ' x 30 ' porch both of which would be attached to the dwelling. The needed storage area would now be located in the basement of the proposed addition as shown on the floor plan and elevations dated 2-9-04, copies of which are attached hereto as Exhibit 1 . 6 . SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 1.4 +- acre lot has frontage along three streets: (a) 300.85 feet along the east side of Oriental Avenue, (b) 344.15 feet along the south side of The Gloaming, (c) 156.89 feet along the south/west side of Montauk Avenue, Fishers Island. BASIS OF APPLICATION: Building Department's December 17, 2002 Notice of-Disapproval, citing Section 100-33, in its denial of the location of a proposed accessory garage/greenhouse in a front yard location, and Notice of Disapproval amended November 13, 2003, citing Section 100-244 in its denial of the location of a proposed addition with a front yard setback at less than 55 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 18, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: About December 17, 2002, the applicant applied for a building permit to construct a detached 24' x 30' garage with an 8' x 24' attached greenhouse, the northeast corner of which will be 15 feet from the northerly front lot line (along The Gloaming), as shown on the 8/16/03 site plan, amended 10/30/02, prepared by Richard H. Strouse, L.L.S. ADDITIONAL INFORMATION:AMENDED RELIEF: During the September 25, 2003 public hearing, the applicant was requested by the Board to consider an alternative that would be more conforming to the code's minimum front setback requirement of 50 feet. On December 17, 2003, the applicant submitted a revised plan to attach the proposed 26' x 30' addition with 8' x 30' porch, at the northeast section of the dwelling, increasing the front yard setback from 15 feet to 27.5 feet from the Page 2,—January 8, 2004 Appi. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant needs a garage for parking of their private vehicles, since the existing detached garage, located in the northwesterly yard area, will be converted to storage for the applicant's family, rather than for parking of their vehicles. The property has three front yards and a single rear yard, all of which require greater setbacks than would be required for a side yard. The applicants have increased the setback which provides direct access from the owner's driveway rather than from The Gloaming. The property is extensively landscaped and an inground swimming pool and sanitary system are established in the westerly yard area, behind the house. The driveway to the dwelling is in the easterly yard area facing Montauk Avenue, and the alternative plan shows easy access from the applicant's driveway, without a need to back out onto the street. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The dwelling is only 57-60 feet from both The Gloaming and Montauk Avenue, which limits any conforming area for a garage as an addition to the dwelling. 3. The variance granted herein is substantial. The required minimum front yard setback is 50 feet, and the relief granted is a 22+-ft. reduction. 4. The difficulty was self-created when the additions were designed without conforming to the current Town Code requirements. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition for an addition and porch, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Since the latest application of the applicant.#5388 had riot been concluded upon the expiration of my term with the ZBA, the decision carried over into this year. Mr. I,ark therefore asked me for some insight into my perspective of that application based upon my familiarity with the situation at that time_ Quite frankly,without seeming unduly critical of this applicant, some of the confusion regarding the current situation stems from the fact that this property has been subject to several variance applications in very recent years_ The applicant seemed to have proceeded to put together a piecemeal approach to site development, rather than a comprehensive plan that would have included consideration for what they really wanted to do well in advance, and thereby eliminate the necessity for the series of different applications the Board has considered. With regard to the status of application#5388 at the end of 2003,the applicant had recently submitted an updated and revised site plan dated 11/10/03 which was included in the official ZBA file just prior to the December public hearing, and a decision was pending from the Board, based upon consideration of all final submissions by the applicant, sometime after my term expired. As best as T can recall,the original application #5388 had been siotifcantly revised by December of 2003_ initially, in the previous spring, applicant had requested a front yard variance for a proposed detached garage to be constructed upon this large residential property,which is bounded by public roads on three sides,and therefore the parcel has three designated front yards_ At the time the Board pointed out several concerns about the applicant's site plan as it had been submitted. The requested 15 foot front yard setback was deems to be quite substantial, especially with a direct egress onto a public road,and no ability to turn around near the proposed garage accessory building. The existing,small single story garage located in the same front yard of this parcel, and with it's own non-conforming setback, was also in question,and may have become an issue with the Board, if the applicant was granted a variance to construct a new larger garage,while still expecting to retain the existing nonconforming structure as well. 04/19/2004 15:26 FAX 631 788 7798 FITELEPHONE a003 • Based upon the Board's site specific concerns, and written and oral testimony presented to the Board prior to the December meeting,the applicant had been strongly encouraged to reconsider the details of their requested variance,and perhaps adopt an alternative plan based upon suggestions from the Board. Subsequently, a process began whereby the applicant decided to completely revise their proposal, to now include an attached addition to their home,with a proposed fiont yard setback of 27+-feet from the street designated as The Gloaming,a cross road between Montauk and Oriental Ayes. This plan replaced the original plan to construct a detached garage/greenhouse accessory building with a setback of 15 feet as they had originally proposed. I believe that the applicant fully intended to continue to use the existing garage in seeking alterative relief from the Board with their revised application, along with constructing the new inhabitable addition to their home,providing that they were able to obtain the appropriate variance for a 27+- front yard setback to their principle dwelling. This new site plan proposal became the subject of the Board's decision of 01/08/04. I hope that this information will help clarify the present situation, and enable the Board to make a decision satisfactory to all involved parties. Just to put 8 everything in reference before she speaks, the Board is familiar with this property, having 9 granted the relocation of the residence under 10 appeal Number 4764 . And it' s one of the unique properties in the entire town in that it' s got three front yards and very little 11 rear yard on which it' s has been designated because of the three front yards . 12 The proposal before you was created by her designer, BD Design, because 13 the McLeans sought more storage space in their' .) house for their premises there, and what they 14 proposed was the garage, I won' t speak to the application per se because you've all reviewed 15 it and spoke to the applicant, and it' s a verified petition and you' re well aware of 16 what' s in it . 17 The existing garage that' s being utilized, as we speak today, is going to be converted to storage. Now, the problem that 18 we have here is that this is in an R80 zone, and to the existing house today is right at 19 161 feet as shown by the site plan from the gloaming. So anything that' s done in that 20 area because it is a designated nated front would require a variance, I understand 21 that Mrs . McLean has been talking about the Board, Board members concerning it . 22 What concerns me is in the thinking here this morning at this hearing is 23 what the Board would allow as a permissive front yard variance, considering the fact that 24 the existinggarage gara e on the gloaming is 21 feet at its closest point . MCLEAN: I think that' s a 17 very fair point that you've raised, and in considering all that, my husband and I have 18 had unfortunately just preliminary conversations with our builder and architect, 19 but in order to move the building back, which we understand why it' s necessary to do and 20 we' d be happy to do, we' re really getting into an issue of it getting so close to the house, 21 and thinking we therefore have to attach it to the house . And as I understand it, that 22 _ changes the whole situation in terms of what it actually is what we' re asking for a 23 variance for. BOARD MEMBER GOEHRINGER: Because 5 you have that topography there and you could make use of that in the plan, and then you 6 could buffer it around it, and I don' t think you' d have to change the position of it, as 7 long as the cars came in where it says proposed 18 by 24 foot greenhouse, and 8 actually enter the building from that side? MRS. MCLEAN: I think the real 9 issue is this building was being built for storage purposes . The problem is we have a 10 garage as it now stands, but it' s so filled with stuff, garden furniture, whatever, that 11 we can' t store our cars in it . So we' re looking for a place to store cars . We' re now 12 beginning to think the other way, that maybe what we should be building is an addition we 13 can use for storage and go back to putting the cars in the garage . 14 CHAIRWOMAN TORTORA: Mrs . McLean Save us all time here. I think what we' re/ 15 hearing is you'd like to consider other / options and the Board is perfectly open to 16 that . As long 23 as we don' t encroach on that and come back to that, they' re going to utilize the new 24 structure as a garage, as the old structure the ingress and egress is off the road.
