The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the
Town Clerk of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

LaMorte: The project consists of two aspects. One is the maint-
enance dredging of a small inlet to the southern arm of the creek.
The other is the construction of an upland retaining wall. The
maintenance dredging is required since the present condition has
totally closed off that access of Jockey Creek to Southold Bay.
We forsee a potential water problem if the area is not opened up
to Southold Bay and the water is not permitted to circulate.
That ' s the reason for the dredging aspect of the project. The
upland retaining wall is merely to stabilize an upland section
and is well above mean high water and beyond any wetland areas in
the vicinity. Other permits have been issued or shortly will be
issued for the project and we urge your approval of it .

SUPERVISOR PELL: We have the application of Mr . William LaMorte
that will be read by Councilman Murphy.
COUNCILMAN MURPHY: This is the application of Enconsultants on
behalf of William LaMorte for a wetland permit to maintenance
dredge and place resultant fill behind proposed upland retaining
wall to be constructed on the southerly part of parcel off North
Bayview Road, on Jockey Creek and Southold Bay, Southold. I have
proof of publication in the Long Island Traveler-Mattitizck Watchman
and I have proof of publication in the Suffolk Times and also from
the Town Clerk Judith Terry of notice on the Town Clerk' s Bulletin
Board. I have a letter from Paul Stoutenburgh, President of Southold
Town Trustees with the resolution: "RESOLVED to recommend -.to the
Southold Town Board approval of the wetland application, #81, of
William LaMorte to maintenance dredge an area 110 ft . by 60 ft. to
100 ft. to a depth of 4 ft. below MLW and place resultant 975 cu.
yds. of fill behind proposed upland retaining wall to be constructed
on southerly part of parcel . " I have also a resolution from Frank
Cichanowicz of the Conservation Advisory Council: "RESOLVED to
recommend to the Southold Town Board approval of the wetland applica-
tion submitted by Enconsultants, Inc. on behalf of William LaMorte
to maintenance dredge and place resultant 975 cu. yds. of fill
behind proposed upland retaining wall to be constructed on the
southerly part of parcel. " That should be it . There is no other
correspondence on it .

Dear Mrs. Terry:
The following action has been taken by the Southold Town Conservation
Advisory Council at a regular meeting held January 26, 1981.
RESOLVED to recommend to the Southold Town Planning Board that the
application of James W. Dawson for a minor subdivision at Bayview be
tentatively approved after an individual evaluation has been made.
RESOLVED to recommend to the Southold Town Board approval of the
wetland application of En-Consultants, Inc. for Neil Simon to construct
bulkhead to existing bulkhead and to truck approximately 200 cu. yds. of
clean sand in for backfill. Council received a letter from Mr. Simon in
response to the Council's recommendation of the December 8, 1981 meeting.
It was an adequate answer to our questions.
RESOLVED to recommend to the Southold Town Board approval of the wetland
application submitted by Enconsultants, Inc on behalf of William LaMort - to
maintenance dredge and place resultant 975 cu. yds. of fill behind proposed
upland retaining wall to be constructed on southerly part of parcel.
RESOLVED to recommend to the Southold Town Board approval of the wetland
application submitted by Enconsultants, Inc. for Matt-a-mar Marina to con-
struct 35 ft. by 5 ft. section of floating dock plus mooring pile extending
from the south ._st corner of the property.
RESOLVED to recommend to the Southold Town Board approval of the wetland
application submitted by Enconsultants-, Inc. on behalf of Walter Silbernagel
tconstruct a timber dock and elevated catwalk.
RESOLVED to recommend to the Southold Town Board approval of the wetland
application submitted by Enconsultants, Inc. on behalf of Strong' s Marine
Center to maintenance dredge two contiguous rectangular areas.
Application of Cheryl Pagnozzi is being tabled until the February meeting
at which time the council will make a report.

NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6 NYCRR Part 617, Section
617 . 10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Board, as lead agency for
the action described below, has determined that the project , which
is unlisted, will not have a significant effect on the environment .
DESCRIPTION OF ACTION
Application of Enconsultants, Inc. on behalf of William LaMorte
for a wetland permit to maintenance dredge and place resultant fill
behind proposed upland retaining wall to be constructed on southerly
part of parcel off North Bayview Road, on Jockey Creek and Southold
Bay, Southold, New York.
The project has been determined not to have a significant
effect on the environment for the following reasons :
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment are likely to occur should the project be
implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation, it is assumed that there is no objection
nor comments by that agency.

Dear Sirs:
I should like to request an interpretation of your jurisdiction
and that of the Town Board on the maintenance dredging project referenced
above.
If you refer to the work plan, you will note that the project
entails removal of sand which has built up on the Southold Bay side of a
small pedestrian bridge.
As you normally do not have jurisdiction over work on the bay, I
request that you find in that manner in this instance as well. Should you
interpret otherwise, however, I enclose completed forms for you to process.
Should they not be needed, they can either be discarded or returned with my
check as desired.
By copy of this letter,, I am requesting that the Town Board take
similar action.

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by written permission from the owner of the property if not
the some as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to the Permit Application:)
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known .prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection,
there is a $5.00 fee for each additional inspection.
H. The Town Board upon requesj f t�e applicant fQr a permit, may waive in whole or in part,
the provisions of Article II, Sectiorf ,subdivisions X) and Orwhere it finds that nature of the
proposed operations are such that the requirements of such provisions are not necessary for a
proper consideration of a permit application.
I. Upon approval of this application the Town Clerk will issue a permit to the applicant. Such
permit shall be available for inspection at any time, upon request.
