NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT
Dated: May 22, 1984
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section
617. 10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Board, as lead agency for
the action described below, has determined that the project , which
is unlisted will not have a significant effect on the environment .
DESCRIPTION OF ACTION
Application of John P. Kowalski for a wetland permit . Permission
is requested to construct catwalk on property located at 930 Ole Jule
Lane, on tributary of James Creek, Mattituck, New York.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental- assessment has been submitted which indicated
that no significant adverse effect to the environment are likely to
occur should the project be implemented as planned.
Because there has been a response from the Board of Southold
Town Trustees and Southold Town Conservation Advisory Council indicating
that this project would not have a significant effect to the environment .
Because there has been no response in the allotted time from the
New York State Department of Environmental Conservation and the Southold
Town Building Department , it is assumed that there are no objections nor
comments from those agencies.
Further information can be obtained by contacting Mrs. Judith T.
Terry, Southold Town Clerk, Southold Town Hall, Main Road, Southold,

Dear Mrs. Terry:
The following action was taken by the Conservation Advisory

The Conservation Advisory Council has tabled application #192
submitted by Stanley R. Gould on behalf of Francis S . Perrone to

Honorable Judith T. Terry

Dear Judy:
The trustees discussed the application of John P. Kowalski
and felt that there would'nt be a problem with the wetlands.
Mr. Kowalski agreed to move the structure over, there is an
ox-bow there, it goes into a slightly narrow width where he
origionally staked it and he is approximately 35 ' off his
west plot line now and he was concerned that the Trustees would
not let him go any closer than that. In talking with Mr. Kowaslki
the Trustees indicated to go a little more to the westerly direction,
hugging the bank more, therefore not diminishing the right of
a boat to go through the creek up further to the east.
Therefore the following resolution was offered:
RESOLVED to recommend to the Town Board APPROVAL of the
Wetland Application #196 submitted by John P. Kowalski, to construct
a nature walk, in a stream from James Creek, Mattituck, all in
accordance with the application submitted, with the provision that
the structure is moved over to the 'S"w and to hug the bank, therefore
he would not diminish the right of a boat to go through the creek
up further to the 1460t.
