The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in•writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the
Town Clerk of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

on application of Fritz C. Kohn for a wetland permit . It will be
read by Councilman Townsend.
COUNCILMAN TOWNSEND: "Notice is hereby given that public hearings
will be held by the Town Board of the Town of Southold, at the
Southold Town Hall, Main Road, Southold, New York, on March 22,
1983, as follows: 3: 30 P.M. o' clock in the matter of the application
of Fritz C. Kohn for a permit under the provisions of the Wetland
Ordinance of the Town of Southold for permission to install 65 feet
of bulkheading to control erosion and provide docking for private
pleasure boat at canal to Schoolhouse Creek, off Old Harbor Road,
New Suffolk, New York. All persons interested in said matter shall
appear at the time and place above specified and will be given an

I have notice that the legal notice appeared in the Suffolk
Times on March 10th and in the Long Island Traveler-Watchman also
on March 10th. Notice from Judith T. Terry, Town Clerk that it
was affixed to the Town Clerk' s Bulletin Board--the aforesaid
notice.
I have a letter from the Board of Town Trustees with the
following resolution: "Resolved to recommend to the Southold
Town Board approval of wetland application #121 of Fritz Kohn
to construct a bulkhead 60 ft . long in Schoolhouse Creek, Cutchogue. "
I have a report from the Conservation Advisory Council which
reads as follows: "Resolved to recommend to the Southold Town
Board approval of the wetland application #121 by Fritz C. Kohn,
to construct 60 ft . of bulkheading provided that the return from
the bulkhead be extended from 5 feet to at least 15 feet . "

Dear Mr. Tuthill,
At their monthly meeting, on March 1st. , 1983 the Board
of Town Trustees asked me to write to you concerning the
Fritz Kohn Wetland Application #121 .
On their monthly inspection, on February 24, 1983 the
above wetland application was to be reviewed, and depending
on the circumstances, judgment would be made at their March
lst. , 1983 meeting whether the permit should or should not
be granted. Much to the dismay of the Trustees, -they found
the proposed bulkhead already in without a town wetland permit.
Needless to say, this is a violation of the Town Wetlands
Ordinance.
After much discussion, it was agreed that the wetlands
permit would be granted, but with the stipulation that in the
future any operation of this kind without the proper town
permit or permits will not be tolerated.
It has been the policy of this board to cooperate, and
extend every possible helping hand to all Marine Contractors,
and it is hoped that, in the future, they will cooperate in
respect to following the procedure set by the town to protect
these most valuable resources.

Yesterday, March 22nd, the Southold Town Board held a
public hearing on the Wetland application of Fritz C. Kohn.
During this hearing Mrs. Ruth Oliva addressed the Board
informing them that 'Mr. Kohn' s requested bulkhead has already
been constructed. Not having been advised of this by the
Trustees prior to the hearing, the Town Board was hesitant
to make a decision on this application.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section
617. 10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Board, as lead agency for
the action described below, has determined that the project , which
is unlisted will not have a significant effect on the environment .
DESCRIPTION OF ACTION
Application of Fritz C. Kohn for a Wetland Permit to install 65
feet of bulkheading to control erosion and provide docking for
private pleasure boat at canal to Schoolhouse Creek, off Old Harbor
Road, New Suffolk, New York.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effect to the environment are likely to
occur should the project be implemented as planned.
Because there has been a response from the Board of Southold
Town Trustees and Southold Town Conservation Advisory Council indicating
that this project would not have a significant effect to the environment.
Because there has been no response in the allotted time from the
New York State Department of Environmental Conservation and the Southold
Town Building Department , it is assumed that there are no objections nor
comments from those agencies.

Dear Mr. Kohn:
An inspection of your property adjacent to Schoolhouse Creek, Little
Peconic Bay at New Suffolk, Suffolk County, New York by a representative of
this office revealed that you have constructed a bulkhead as you originally
proposed disregarding the environmental concerns of the Federal Agencies.
You are directed to remove the unauthorized bulkhead and restore the area
to its condition prior to construction. Failure to comply with this directive
will leave us no alternative than to forward this case to the United States
Attorney for appropriate legal proceedings.
A reply as to the action you intend to take in this matter is requested
within 7 days of receipt of this letter. Your reply should include the
commencement and completion dates of the project and refer to the case number
indicated above.

NOTICE IS HEREBY GIVEN .that public hearings will be held by
the Town Board of the Town of Southold, at the Southold Town Hall,
Main Road, Southold, New York, on March 22 , 1983, as follows:

C. Kohn for a permit under the provisions of the Wetland Ordinance
of the Town of Southold for permission to install 65 feet of bulk-
heading to control erosion and provide docking for private pleasure
boat at canal to Schoolhouse Creek, off Old Harbor Road, New
Suffolk, New York.
3: 35 P.M. o ' clock in the matter of the application of John
Geideman on behalf of Robert and Patricia Troxel for a permit under
the provisions of the Wetland Ordinance of the Town of Southold for
permission to construct 65 feet of bulkheading on canal off James
Creek, at 2800 Ole Jule Lane, Mattituck, New York.
3: 40 P.M. o ' clock in the matter of the application of En-
consultants, Inc. on behalf of John Bubany for a permit under the

The following action was taken by the Southold Town Conservation
Council at a regular meeting held on Tuesday, January 25 , 1983 .
RESOLVED to recommend to the Southold Town Board approval of the
wetland application #112 by Phil Marco to construct a dock for
private boat, Cutchogue.
RESOLVED to recommend to the Southold Town Board approval of the
wetland application #114 by Ken Hahn on behalf of Boatmen' s Harbor
Marina to construct new bulkhead and dredge. Cutchogue.
Recommend that the application of Robert V. Rider, Jr. #115 be
revised and resubmitted. Spartina grass cannot be removed and
fill cannot be placed on wetlands. Request new application be
submitted clarifying how this project will be done. For every
foot down dredged should be at least two feet away from the
existing spartina grass .
RESOLVED to recommend to the Southold Town Board approval of the
application #116 by Enconsultants , Inc. on behalf of Lawrence
D. Byron, Jr. to construct dock, ramp and float. Cutchogue.
RESOLVED to recommend to the Southold Town Board approval of the
wetland application #117 by Enconsultants, Inc. on behalf of
Robert K. and Jean Fairlie to replace timber bulkhead and backfill
with clean sand fill. Southold.
RESOLVED to recommend to the Southold Town Board approval of the
wetland application #118 by Lane Use Company for Virginia G. Jones
to construct dock and ramp. Southold.
RESOLVED to recommend to the Southold Town Board approval of the
wetland application #119 by Port of Egypt Marine, Inc. to rearrange
existing dockage inside of marina, pull and reset anchoring pipes
on floating docks. Southold.
Recommend that the wetland application #120 by Abigail A. Wickham,
Esq. on behalf of Constantine P. Georgiopoulos , to fill lot with
approximately 1000 cubic feet of off-site fill , in order to raise
elevation 5 feet and construct single family dwelling, be tabled
until it can be clarified what type of retainers will be used to
keep the fill in place.
Recommend that the wetland application # 121 by Fritz C. Kohn, to
construct 60 ' of bulkheading, be revised so that the returnlirom
the bulkhead by extended from 5 feet to at least 15 feet.

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by writter permission from the owner of the property if not
the some as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to the Permit Application.)
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection.
there is a $5.00 fee for each additional inspection.
H. The Town Board upon request 4 t� applicant for a permit, may waive in whole or in part,
the provisions of Article II, Section , s

proposed operations are such that the requirements of such provisions are not necessary for a
proper consideration of a permit application.
