DESCRIPTION OF ACTION Application of Enconsultants, Inc., on behalf of Paul Kelly, for a Wetland Permit to replace timber bulkhead arid backfill with clean sand at property located on right-of-way on the south side of New Suffolk Avenue, at Great Peconic Bay, Mattituck. New York. The project has been determined not to have a significant effect on the environment for the fOllowing reasons: An environmental assessment has been submitted which indicated that no significant adverse effect to the environment are likely to occur should the project be implemented as planned. Because there has been a response from the Board of Southold Town Trustees and Southold Town Conservation Advisory Council indicating that this project would not have a significant effect to the environment. Because there has been no response in the allotted time from the New York State Department of Environmental Conservation and the Southold Town Building Department, it is assumed that there are no objections nor comments from those agencies. We have a letter from the Conservation Advisory Council: "Resolved to recommend to the Southold Town Board approval of the wetland application 11181 submitted by Enconsultants. Inc. on behalf of Paul Kelly to replace bulkhead. Great Peconic Bay. Mattituck." There's an affidavit here stating that it was posted on the Town Clerk's Bulletin Board signed by Judith Terry. We also have affidavits of publication from The Suffolk Times and The LDng Island Traveler-Watchman. Page 2 - Public Heare- Wetland Application . Enconsultants, Inc. on behalf of Paul Kelly . SUPERVISOR MURPHY: You've heard the official reading. Is there anyone here who would like to speak in behalf of the application of Paul Kelly? MR. ROY HAJE, President, Enconsultants, Inc.: The application simply requests permission to replace an existing bulkhead. We have requested that permission be granted for construction within 18 inches of the old structure, while leaving the old structure in place. The reason for this is that if the old structure were to be removed it could result in loss of backfill, which could imperil the house. The construction technique, therefore, is determined by the proximity to the house and we request that you apporove it in that fashion. It has already been approved by the New York State DEC and the Corps of Engineers as requested. COUNCILMAN STOUTENBURCH: May I ask a question? SUPERVISOR MURPHY: Sure. COUNCILMAN STOUTENBURCH: If the permission to grant the bulkhead was given only in place, what would be your problem then? MR. HAJE: It would involve removal of the old structure and the backfill then would be lost. COUNCILMAN STOUTENBURCH: It couldn't be removed part by part? In other words, and then added? In other words, not taking the whole thing down at one time? In other words, I spoke to a contractor who said that this is a possibility that it could be done and that way you do not lose all of the back- fill. The possibility that we're giving away 18 inches of someone elses property besides the owner's property is always a concern, and this is the reason it was originally suggested to be in pl.ace. MR. HAJE: Well, to do that would entail a significant amount of additional work. COUNCILMAN STOUTENBURCH: on waterfront property. Rambo Dock Building, MR. THOMAS SAMUELS,ICutchogue: Roy,. Absolutely. That's one of the costs of living can I speak to that point? SUPERVISOR MURPHY: Sure. MR. SAMUELS: We investigated the possibility, after the Trustees suggested that that would be the way to go. Unfortunately there are two problems. Number one, there isn't any room to place the excavated fill unless it were on the right-of-way adjacent to the property, which isn't owned by the applicant. Number two, you'd have to bring a crane in on that right-of-way, and bucket the fill and heap it, remove the bulkhead, build the structure. Anything can be done, but it will essentially double the cost of the construction and presents problems in that we're not sure that the owners of the right-of-way would acquiesce in our request to use their property as a storage site for the fill. It would have to be excavated in full back at least as far as the tie-rods and in some areas we'd be within eight feet of the foundation of the house. COUNCI LMAN STOUTENBURCH: Are you going to excavate to get the tie-rods, the new ones, in? Page 3 - Public Hear. Wetland Application Enconsultants, Inc. on behalf of Paul Kefly . . MR. SAMUELS: Wefl, you'd have to--no, no, you jet in the tie-rods, the jetting procedure, there's no excavation required if we can build within 18 inches. There are practical problems. You're familiar with the area, I know, and the houses are cheek to cheek, so to speak. COUNCILMAN STOUTENBURGH: The problem I see is down the road twenty years from now we put another 1'8 inches out, anotner twenty years we--the man's got a nice front yard and continuafly keep moving out, when do we stop? When you and I aren't around. MR. SAMUELS: Theoretically I guess that's true. However, we would like to think tnat a timber structure of the quality that Judge Kelly'S making is 3S years. so I'm putting it off 70 years. CuUNl.lLMAN ~TOUTENBUKGH: I knew I could count on you. MK. SAMUeLS: It is a proDlem throughout tne Town, especiafly where Trustee'~ bottom IS concerned. In tnis particular case it's--it sets a precedent and it's-- it is State bOttom that we're concerned witn. State beach, etc. It sets a precedent, but in this particular case the practical aifficultles are severe. Thank you. SUPEKVI:.OR MURPHY: Is there anyone else would like to speaK in ravor? MR. JIM GRA V, Cutchoque: I was a nelghoor of Judge Kelly tor twenty-some years and I replaced my bulkneaa at the same time he replaced nis, Now, he haa it aone by a non-professional. I had It done Dy a protessional. My Dulkhead, which is next door to hiS, IS still standing and lOOkS like It was put in yesterday, so I know that if you"re replaCing the Dulkhead, and It wlfl De done Just liKe mine, because or a profesSional, It wlfl last another thirty years, and I was a neighoor twenty years, and that's thirty years ago, and It'S thirty years old already, mine is, ana mine looks brarid new. They recommend that the bulkhead be replaced in place. You will note that the application requests permission to install the bulkhead immediately in front of the existing struc- ture (within 18"), Construction of a new structure immediately in front of an existing structure is a standard construction technique and a requirement where loss of backfill resulting from the removal of the old structure would endanger the house. In this instance, the house is extremely near to the bulkhead and could be endangered by removal of the existing bulkhead. Approval of replacement within 18" has been granted by the DEC (copy enclosed). We do not feel that our request is un- warranted especially in light of the situation and ask that it be granted as applied for. '~i ;'''-'' Roy L. Raje '(1 RLH:EF Enclosures ,. '. There's an affidavit here stating that it was posted on the Town Clerk's Bulletin Board signed by Judith Terry. We also have affidavits of publication from The Suffolk Times and The Long Island Traveler-Watchman. Page 2 - Public Hear~t - Wetland Application Enconsultants, Inc. on behalf of Paul Kelly SUPERVISOR MURPHY: You've heard the officia! reading. COUNCILMAN STOUTENBURGH: May I ask a question? SUPERVISOR MURPHY: Sure. COUNCILMAN STOUTENBURGH: If the permission to grant the bulkhead was given only in place, what would be your problem then? MR. HAJE: It would involve removal of the old structure and the backfill then would be lost. COUNCILMAN STOUTENBURGH: It. couldn't be removed part by part? In other words, and then added? In other words, not taking the whole thing down at one time? In other words, I spoke to a contractor who said that this is a possibility that it could be done and that way you do not lose all of the back- fill. The possibility that we're giving away 18 inches of someone elses property besides the owner's property is always a concern, and this is the reason it was originally suggested to be in place. MR. HAJE: Well, to do that would entail a significant amount of additional work. COUNCILMAN STOUTENBURGH: Absolutely. That's one of the costs of living on waterfront property. Rambo Dock Building, MR. THOMAS SAMUELS,/Cutchogue: Roy,, can I speak to that point? It would have to be excavated in full back at least as far as the tie-rods and in some areas we'd be within eight feet of,the foundation of the house. COUNCILMAN STOUTENBURGH: Are you going to excavate to get the tie-rods, the new ones, in? Page 3 - Public Hear - Wetland Application Enconsultants, Inc. on behalf of Paul Kelly MR. SAMUELS: Well, you'd have to--no, no, you jet in the tie-rods, the jetting procedure, there's no excavation required if we can build within 18 inches. There are practical problems. You're familiar with the area, I know, and the houses are cheek to cheek, so to speak. COUNCILMAN STOUTENBURGH: The problem I see is down the road twenty years from now we put another 1'8 inches out, another twenty years we--the man's got a nice front yard and continually keep moving out, when do we stop? When you and I aren't around. MR. SAMUELS: ,heoretically I guess that's true. However, we would like to think tnat a timber structure of the quality that Judge Kelly's making is 35 years, so I'm putting it off 70 years. CuUNL, ILMAN :3TOUTENBUKGH: I knew I could count on you. MI~. SAMUELS: It is a problem throughout the Town, especially where Yrustee'~ bottom is concerned. In tills particular case it's--it sets a precedent and it's-- it is State bottom that we're concerned witl~. State beach, etc. It sets a precedent, but in this particular case the practical aifficultms are severe. Thank you. SUPEI~VI~OR MURPHY: Is there anyone else would like to speak in favor? MR. JIM GRAY, Cutchoclue: I was a neighbor of Judge Kelly tor twenty-some years and I replaced my bulkneacl at [he same time he replaced Dis. Now, he ha(~ it (~one I~y a non-professional. I had .t done Dy a protessional. My I~ull~head, which is next door to h.s, is still standing and Iool~s like ~t was put in yesterday, so I know [hat if you're replacing the Dul~(head, and ~t will De done just like m~ne, because ota professional, it will ~ast another tl~irty years, and I was a neighbor twenty years, and [hads thirty years ago, and it's thirty years old already, min~ is, and mine looks brand new. They recon~end that the bulkhead be replaced in place. You will note that the application requests permission to install the bulkhead immediately in front of the existing struc- ture (within 18"). Construction of a new structure immediately in front of an existing structure is a standard constructlon technique and a requirement where loss of backfill resulting from the removal of the old structure would endanger the house. In this instance, the house is extremely near to the bulkhead and could be endangered by removal of the existing bulkhead. Approval of replacement within 18" has been granted by the DEC (copy enclosed). My wife Georgene and I are the current owners of the above property which we purchased from Paul Kelly. Our property's bulkhead incurred damage as a result of the recent nor'easter storm on April 15, 2007. We have made temporary repairs to the bulkhead and are requesting that the existing permit be transferred to us so that we may proceed to permanantly repair the bulkhead utilizing the same materials or a suitable composite that will match the existing bulkhead. I am enclosing pictures of the bulkhead for your review. You are welcome to inspect the property at your convenience.
