I am authorized to place our Association on record as completely opposed to the application of one GEORGIOPOLIS to fill his parcel of land on the corner of Lake Drive and Lake Court on Great Pond in Southold, Long Island. I understand that his prior application was rejected and I know of no change of conditions that requires the granting of his latest application. We look to you to protect our natural resources and wetlands . We consider the repeated application of Mr. Georgiopolis a threat to those wetlands and Great Pond itself. Your administrative determinations are entitled to finality unless properly appealed and that rule applies to Mr. Georgiopolis . A reading of the Draft Environmental Impact Statement dated September 4 , 1984 is so overwhelmingly contrary to the requested application that its ' very submission raises serious questions as to its bona fides ! I refer you to the paragraph entitled Water Resources under "Adverse Environmental Effects That Cannot Be Avoided" if the project is implemented. The litany of environmental horrors recited therein should be enough to merit denial out of hand. " Page 2 - Public aring - Wetland Applicati #120 - Georgiopoulos I have a letter to the Town Clerk, Mrs. Terry, from the Conservation Advisory Council . "Dear Mrs. Terry: Resolved to recommend to the Southold Town Board approval of the wetland application #120 submitted by Abigail A. Wickham, Esq. on behalf of Constantine P. Georgiopoulos, to fill the lot in order to raise elevation provided measures are taken to retain the fill so it does not wash away. Yours truly, Frank Cichanowicz, Chairman, Southold Town Conservation Advisory Council. " There are a mumber of letters in the file expressing objection to this application. SUPERVISOR PELL: You heard the reading of the public notice for this application. Does anybody wish to speak in favor of this application? ABIGAIL A. WICKHAM, ATTORNEY, Mattituck, New York: I am the attorney for the applicant . I ' d just like to briefly review the application for you. This is a portion of an unfiled map of "Southold On The Sound" which is a single and separate lot . I have a vacant land Certificate of Occupancy from the Town, Z11132, which indicates that the Zoning Board of Appeals granted undersize lot approval and the Planning Board grandfathered it , subject , of course, to any zoning restrictions. This property juts out into Great Pond. Surveys by Van Tuyl and field investigations by the Department of Environmental Conservation have indicated that it is largely a wetland piece, it is a freshwater wetlands within the jurisdiction of the D.E.C. and the Town. The proposal is to do something which is similar to what appears to have been done on some of the surrounding lots, which is to raise the elevation of the lot in order to construct a residence. I understand it is in the A10 flood zone, requiring an elevation of 11 feet . Since the property is essentially at zero elevation, it seemed appropriate, rather than constructing on pilings with break- away walls to an extent of 11 feet , to bring the fill up part way and we propose five feet and then build the house above that in accordance with flood zone regulations. There are applications pending before the Department of Environmental Conservation and, of course, the Board of Health will also have to be consulted and applied to regarding any sewer and water approvals. If the Board has any questions I would be glad to answer them. SUPERVISOR PELL: Thank you. Any questions anybody of counsel? (No response. ) Anybody else wish to speak in favor of the applica- tion? In favor of? (There was no response. ) In opposition to this application? MR. GERALD JACOBSON: I have a house adjoining this piece of wetlands. The property in question, right now, is completely under water. It is not only wetlands, it is almost part of the lake at this point . I have photographs that have been taken over the last two weekends showing the condition of the property and showing also the condition of the only non-wetland part of the property, which is also under water. (Exhibit I - Six photographs of the Georgiopoulos property at 180 Lake Court , Southold, submitted by Gerald Jacobson. ) Page 3 - Public wring - Wetland Applicati #120 - Georgiopoulos MS. WICKHAM: Might I see a copy of them? MR. JACOBSON: I also have a letter from the Department of Environ- mental Conservation. The letter is dated October 7, 1977 and it closes with saying that "approximately 90 per cent of the property in question contains wetland vegetation protected under Article 24. Based on this fact , this Department is obliged to object to any disturbance of the vegetation on the above described lot . " I submit that too. Meo , 2326 Royce Street , Brooklyn, New York 11234. ) MR. JACOBSON: I have another letter dated March 23rd, 1983 from the D.E.C. and the jist of that was that this was based on the two acre plots; my lot and the wetland in question, and it said that the only buildable part is where my house was. There are some other things in the letter, but that is the jist of- it. They still maintain that that ' s the only buildable part of the lot. JACOBSON: In addition, I ' d like to say that this is the only remaining part of unconstructed area of the lake left and as such it serves as a public beach, it serves, in effect , a wildlife preservation. The pictures in question show carp that are actually on the property now . There are fish swimming on the property and ducks, birds, everything nest there at all times of the year, even when the water level drops. There is some question whether if these reeds were filled in whether adjoining properties might suffer some severe erosion damage, and as such I would also object as my house is on a higher elevation than this lot and could summer some foundation damage if the reeds were removed. I respectfully request that this permit be denied. SUPERVISOR PELL: Thank you. Anybody else wish to speak in opposition to? MR. GEORGE BAMBRICK: I reside at the intersection of Lake Court and Lake Drive and I strongly object to the granting of this application. I think Mr. Jacobson outlined our basic oposition to this application. I would like to add a few more points. First of all , you have in your possession now other letters from neighbors in the surrounding immediate area and I would ask that at some point during this hearing Page 4 - Public __aring - Wetland Applicati #120 - Georgiopoulos they be read into the record also. If that ' s not possible, I 'm sure you will take them into your consideration when you make your decision. SUPERVISOR PELL: They are part of the record. They have been distributed to the Board. MR. BAMBRICK: In conversation just to clarify a point I have, maybe you can clarify it if I 'm incorrect , under Article 24 the State is responsible for preservation of wetlands. In addition to that Towns also have responsibility in this area. And while they cannot lower the standards as stipulated in Article 24 they can and should at least meet them or, as I understand it , they can exceed it within - their own jurisdiction. As indicated by Mr. Jacobson, in the letter we have and have submitted for your consideration dated October 7, 1977, the Environmental Analysis Unit for the New York State Department of Environmental Conservation statesthat, "Approximately 90% of the property in question contains wetland vegetation protected under Article 24. Based on this fact , this Department is obliged to object to any disturbance of the vegetation on the above described lot . " I think this is the strongest piece of documentation that we, the immediate neighbors, have in reference to this particular application, and I strongly urge you to consider it in your decision. I would like to comment on the statement made by the attorney for the applicant recently when she stated that the surrounding properties appear-- filling in of the surrounding properties appears to have been done. It is my experience and the experience of people in this immediate vicinity that all the property--the houses that have been erected on property in the surrounding areas have conformed with both local and state law and the grade level has been caused by natural causes, that is wind, moving sand, shifting sand and things of that nature, not artificial filling-in of a piece of property. I would also go on record that I am a elected governor of the Kenney 's Beach Civic Association and I would like that to be taken into consideration that we as a community in the Kenney' s Beach Civic Association feel very strongly that the Town elected officials have an obligation to protect and ensure that both the state and local laws are strongly followed. We're very concerned. We fear that we have to draw the line at some point and this is the particular point that we feel that a stand has to be made before further incursions are made that would damage our environmental structure in this area which is a very fragile situation. This particular piece of property is a natural spawning ground, as the pictures Mr. Jacobson has submitted for your review, show. It is also a bird habitat and is a natural link in the food chain for the animals in this particular area. I think this is a very important point that should enter into your consideration and again I wish to go on record that I strongly oppose this application. Thank you very much. SUPERVISOR PELL: Thank you. MR. CHARLES WILD: I live directly across the street from the property that ' s in question. I would just like to add that I have these pictures also of the carp that spawn every spring across the street from my property and probably right now you can go swimming in it , that ' s how deep it is. RUTH OLIVA, President , North Fork Environmental Council : We would object to any filling of any wetlands and go with the decision of the Trustees. We would also not favor this filling-in because I believe it has been mentioned as a possible source of public water and we certainly don ' t need any further pollution than is already there. I am also enclosing a copy of the survey submitted to us with the current application to build on this property. For your information, a Freshwater Wetlands Permit (FW 15273-0068) was issued on January 29, 1976 to Mr. James Meo, the owner of record at the time, to construct a single family house on the only buildable part of the lot. The property in question has been classified as wetlands by the State Department of Enviornmental Conservation. (Please see enclosed copy of a letter dated October 7, 1977 from the DEC to James Wo). A visit to the site at different times of the year will reveal many of mother nature's activities taking place - such as fish spawning, birds nesting and feeding, and many kinds, of wild grasses and plant life, all of which contribute to maintain the very delicate balance of the eco-systems of the lake and surrounds. Great Pond today is one of a very few remaining fresh water lake on Long Island. We should not permit activities to occur which will diminish its wetlands content, no matter how small or.minor some may judge such activities to be. We urge you not to permit the land filling or building construction, for which your approval is sought, to take place. I wish to register my vehement opposition to the application of Mr. Georgiopoulos which would adversely affect the wetland adjoining Lake Court Drive. I fish Great Pond constantly and consider it and its adjoining wetlands as a natural treasure that is not to be dissipated or tampered with. Surely the applicant must have known the fragile nature of this property when he acquired it. Tax "lap Sec. 59 - Block5 - Lot 31) . This lot is one of the last open spaces on Great Pond Lake in Southold. It is a wildlife refuge and overflow tributary of Great Pond. During the spring months the area encomoassed within this lot is a spawning ground for the fish in the lake. It is also one of the few remaininq natural habitats of nany birds and other animals. I have often witnessed several hundred birds sleeping on the rushes. If you allow these areas to be built upon the cummulative effect on the local enviornment with respect to our drinkinq water, our soil contamination and a safe haven for our wildlife will be arreparable. I strongly urge you to vigorously enforce our existing laws and regulations established to protect areas such as this lot from destructive development. I am hoping and praying my local town authorities will also exercise their duties in the regard.
